Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below As expected, these statements are not true I don’t owe [redacted] k (owner) or [redacted] (manager) of “A Day in the Sun” one penny and the job is still not completedI paid with a cashiers check and/or personal checks and have documentation to prove every payment Thankfully, I didn’t pay cash as requested to help them pay less taxes That should have been my first red flag, what kind of reputable business/contractor ask for cashI did review the contract with ***, [redacted] and my family sitting in my living room So many promises were made that contradicted the contract but taking the [redacted] s at their “word”, I signed the contractMy neighbors took [redacted] at his word too when their side yard was damaged during construction [redacted] promised it would be fixed, but still has notMy dog had an underground fence that they were made aware of, they said it shouldn’t be a problem Within the first day or two I came home to a beeping noise and found the underground wire sliced in several areas, my dog’s fence was inoperableI had made my first huge installment within days of signing the contract but still had two more big installments to pay at certain stages of construction per the contract So “the goodness of their hearts” equals they had not got all my money yet and were still making promises and actually working and communicating They broke my flood lights while working so yes they put new ones in but I swept up the glass so my children or dog wouldn’t get cut I had to clean up my patio and yard several times after it was apparent the crew had been there and left their trash and equipment everywhere Again pictures were taken at just about every stage of this process and can be provided I never asked anyone to move the playset and was never told the playset needed to be moved I have pictures showing the playset before sitting far behind the outlines were the pool would be located I came home to find it moved and broken and called ***, he again promised it would be fixed Not only did they damage it when they pushed/dragged it, they also did not put in on level ground and it blew over causing further damage due to their negligence My son was years old when this process started in December and he has still not got to play on his playset and is now years old How can someone do that to a child? The next issue of the backwash; [redacted] promised it would be outside of my fenced area and drain into the open field behind my house The inch wide and inch deep hole was placed within my now fenced backyard, which is danger for anyone walking/running and it floods the back corner every week when the pool has to be flushed [redacted] ran over the equipment/maintenance one time in a very rushed minutes and I wasn’t able to take notes he went so quickly but he promised I would have the manuals and he would mark the pipes so I would know which was what I was given a liner sample book to look at to choose the liner I wanted but then when I chose the one I wanted it wasn’t the one he had on hand He put an extra $on the cost with the promise again that he would sell it for me and reimburse me the $900, this still has not happened I absolutely never planned to have a wrought iron fence, I always planned on a standard ftwooden privacy fence During the review of the contract meeting it was agreed that [redacted] would install my fence after completion of my pool and that was added on the contract, hand written by *** I asked a friend who owns his own fencing company to monitor [redacted] and his crew when they were setting posts and doing the fence to make sure it was done correctly, since [redacted] stated he knew just enough about fences to be dangerous My friend showed up several times and [redacted] and his crew were nowhere to be found or contacted When [redacted] did put posts in the ground less than inches, my friend was present and explained to [redacted] the posts were incorrectly positioned and [redacted] got upset and told my friend he was not his boss My friend advised me of this and showed me the posts that were not placed correctly nor set far enough into the ground to support the fence I addressed this with [redacted] and he then told me he didn’t have time to do this and if my friend wanted to do it, let him do it instead of him At this point there is no more “goodness of their hearts” left since I had made all my scheduled payments My friend installed the fence for me and only charged me $1,and [redacted] should be liable for this since he agreed to this but never finished the job per the contract The concrete issue is probably the worst since makes everything look horrible on my patio and it was the second most expensive line item on the estimate ***’ original concrete guy had quit so [redacted] decided he could do it himself, they were pouring in some spots with no forms in place and guess what I came home from lunch and took pictures of this process too The concrete is uneven, rough and cracking So he promised to fix it and not charge me any extra His fix was to seal it with a color sealant, well I currently have a three colored patio since he ran out of sealant And once again his crew left their trash, used rollers and empty cans for me to clean up Again, I had no idea what to expect so I called the builder inspector, [redacted] and the concrete is not up to code I plan to have Mr [redacted] come out again and inspect everything else to see what else could be wrong Mr [redacted] stated he would testify in court on my behalf since the concrete job was so bad and not up to code Lastly, I was promised that until the job is complete and I was 100% happy I would not have to make the very small last installment The [redacted] s owe me money and have not done what they promised contract or no contract their word means nothing I don’t know if I will be reimbursed or any kind of restitution will be made, but if nothing else if someone does their homework, unlike myself since I had a personal reference, I hope they will read this and the way these unprofessional contractors respond and don’t settle their complaints I hope they run far away from “A Day in the Sun” owned by [redacted] k and [redacted] I have met and spoke with others that have had even worst experiences with these people and hope they file a complaint as well to help others stay clear of these people Regards, [redacted]

A Day in the Sun has tried to resolve this matter by allowing the customer to keep the remaining money that she owes (exact amount is $1850) avoiding her requests to violate building codes by extending the backwash line onto someone else's property, putting a fence on the property line instead of ft from the line etc Her contract was gone over thoroughly and she was aware of all the construction guidelines She was given separate pool schools; by the owner and by his wifeAt this point this complaint is being handled by the Warren County Contractors Licencing Board

Customer still owed us 2500$ at the completion of the jobAsked us to do jobs above and beyond what we were contracted to do, such as, changing bulbs in her flood lights around her house, paying for the fencing for her dog, moving her playset etc.The playset was damaged during moving it, however
the customer was aware that she was responsible to move it, but ask us to do so while we had a backhoe presentThe plasyset should have been taken down and moved by the customer. Our contract was signed and reviewed with the customerShe was aware that she was responsible for any and all obstructions aboveground and underground where the pool construction will take placeAfter the construction was completed the customer continued to ask us to bury the dog line (which we paid for and ran out of the goodness of our heart)Also, the customer requested for us to extend the backwash line onto someone else's property so that it would drain into the fieldWe did not feel comfortable doing thisWe went over how to use the pool equipment 3x with the customerThe first time the customer took notesIn our contact it is stated that the yard will be left in rough gradeThe customer is responsible for finishing the landscape/yard workWhen we signed the contract with the customer she understood that she was buying a package pool (was already pre put together) and that if she wanted to changed the liner it would be an extra chargeThe customer chose to do so and the the extended cost was refunded into the concrete cost when the other liner was soldThe customer originally was going to purchase a standard rout iron pool fence from Lowes and have her step dad install the fence and we would help on the days that we were not working on a pool (weekends and such), again out of the goodness of our heartThe customer changed her mind and decided to hire someone to build a wood fence and still wanted us to come build itWe helped one day and the person that was supposed to be building the fence never showed up that dayWe discussed with the customer that we were not going to build this type of fence and that is not what we agreed to doShe was upset at us, but not at the guy who didn't even show up to help build the fence, but was hired to do soThe 2500$ she still owes us is plenty of reimbursement for whatever she thinks is wrong with her pool

I don't owe "A Day in the Sun" one penny.  They owe me at minimum $900 for the liner that they sold on my behalf since I had to pay for two liners.  What about my warranty paperwork for the pool equipment? Still not received anything.  What about my son's playset that was damaged during a move I never was informed of or consented to.  What about my underground dog fence that no longer works in the front yard and has to be reburied?  What about the money I paid someone to move the drain out of the middle of my backyard, not on anyone else's property.  What about the hours and hours spent shoveling gravel left in my front yard, the grass seed, fertilizer that was promised to be fixed?  What about the concrete sealant that is still not finished (my back patio is currently pale gray, dark gray and brown)?  What about the cracking, chipping, uneven concrete that pools water instead of sending water away (not up to code).  What about labeling the pipes so I would know what is what?  Pool school should not be 5 mins, do this, do that and that's all I got.  The only thing I know to do is backwash once a week and keep the pump on 8 hrs a day.  I did file the complaint with the Warren County Licensing Board, I waited as long as possible for this company to resolve these matters between us and they refuse to do what is right.  I also did not file any complaints before getting my pool cover on and my pool being closed for fear that if I did file a complaint before these things were finished, I would lose that much more money as this company would not keep their word.  The Warren County Licensing Board sent me the paperwork to file this complaint months ago and the inspector said he would testify in court due to what he saw when I requested he look at my terrible concrete job.  So absolutely, they are involved by my doing, I sent the paperwork in April 15th with pictures documenting the whole process of building my pool, destroying my yard, my neighbors yard, my underground fence, gravel in the front yard, everything.  This matter is not settled until the right thing is done.

The contractor insured the septic lines would not be an issue, and that his "dig " guy would move them in one day with no problem, he does this all the time. I questioned the contractor again and even called him out to the site to show him where I had dug up a field line myself before the dig was scheduled because I was going to have to cut one of my mature trees for the installation. Once again he assured me it was not a problem not to loose any sleep he does this all the time , so he instructed me to cut the tree about 8 foot above the ground so his digger could remove it .So I cut my tree as instructed and signed a contract to have pool house built. The day he was to dig the pool he came and plucked the stump out of the ground and said you were correct the field line is in this location and he would not be able to place the pool where we had agreed. At this point his story changed and he could no longer move the septic lines and said we could move pool to other side of lot or cancle contract. We choose to cancle contract. So after two months of trying to retrive our $2000.00 deposit back he sends me $235.00 and says the rest was fees for him removing the stump and confirming the field line I had previsoly showed him? We were decievied by his dishonesty and I work to hard for my money to have it taken in this manner.
