Back on 2/17/2014, I contacted Sears Maintenance [redacted] regarding repair of my television set. During that conversation the sales rep informed me of a free $100 promotion for home improvement services. I was interested in the promotion and the next day a sales project consultant came to my house to discuss the program. That appointment was acceptable, but not the reason I contacted them. Unfortunately there was no action taken on my television repair request until a week later. The consultant discussed the program with me and before I knew it the total was over $16,000. I did sign the contract but did not receive a paper copy that day. Instead the consultant gave me a disc containing the contract despite the fact that I told him I did not own a computer. The paper contract was mailed to me but I did not receive it until 4 days later (2/22/14). This was by the way after my 3 (business day) grace period for cancellation. During this entire process I was under doctor's care and taking prescription medicine. On Friday 2/21 I was not feeling well & did not cancel the agreement as planned. My doctor contacted me the next day and advised I may need surgery. That same day I contacted Sears indicating I needed to cancel the proposed service and was told I had to pay 30% of the total amount ($5,000). Granted I was 1 day late in cancelling due to medical reasons, but there was no work done and this amount seems unfair and excessive. I have tried to negotiate with Sears but they insist I pay this amount despite not having incurred any losses in that short timeframe (1 day).
