I am saddened that Ms [redacted] has vilified me because a simple check mark was missing from but one of the Court's many required documentsIt is usual for the Clerk's office to call me when such a simple mistake appearsIn this matter I was not so notifiedHad I been I would have authorized the caller to fill in the appropriate boxI feel simply horrified anytime I make an error and the court sends documents back to me for further correctionIt is, unfortunately, usual and customary for many divorce lawyers and mediators to have ongoing dialogue with the Court Clerk's office due to real or imagined errors on the submitted paperworkI am not usually personally attacked by clients for being unprofessional based upon a missed checkmarkMs [redacted] 's tone was harsh and unnecessaryHer DEMAND for a refund was a bit over the top based upon he "alleged" harm to her The Judgment of Divorce has been issued by the CourtThe effective date was December 14, Ms [redacted] and her Ex-husband, [redacted] are now free to move on with their livesI apologize for any inconvenience this might have caused Ms [redacted] I can am sorry we did not live up to her standards

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below IS THIS A JOKE [redacted] ? AFTER YOU HUMILIATED AND IGNORED MY WIFE AND MONTHS OF INACTION, YOU DECIDED TO SEND THIS LETTER TO MR [redacted] ***? DID YOU EXPECT US TO SIT AND WAIT FOR YOU? NO, [redacted] ! WE ALREADY HIRED ANOTHER LAWYER TO FINISH THE JOB FOR YOUWE ARE TIRED OF YOU BLAMING MY WIFE FOR YOUR INCOMPETENCEJUST THINK ABOUT THIS [redacted] , WHY WOULD MY WIFE HOLD INFORMATION THAT IS VITAL TO OUR CLAIM? EVEN A FIVE YEAR OLD CAN SEE THAT ALL YOUR EXCUSES ARE JUST LIES TO COVER YOUR INEPTITUDE AND INCOMPETENCEWE WANT ALL THE MONEY WE PAID YOU ($3000.00) REFUNDED TO US IMMEDIATELY OR WE WILL TAKE YOU TO COURTTHE Revdex.com CAN NOT FORCE YOU TO DO THIS, BUT THE COURTS CAN, AND IT WILL COST YOU A LOT MORE THAN THATYOUR CHOICE [redacted] !!! Regards, [redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
That does not resolve the issue of pretending to do the divorce than telling me to drop a restraiining order when you knew I would never do that as a part of the divorceThat is why you gave me the attorneysto handle the restarining order in courtI have a message saying you were proceeding with the divorce upon meetingRefund my money for consultationYou never mentioned you wanted me drop it as a part of the divorce.I would not have come to the consultYou knew that.
Regards,
*** ***

I was called by Ms*** a total of FORTY EIGHT times about her caseI told her form the very first contact that I am a MEDIATOR not a litigatorI try to help people work out their divorce issues in a negotiated way rather than with
litigationI every phone call with either her or her husband prior to our TWO AND A HALF HOUR consultation I encouraged them to hire out side lawyersI gave Mrs*** at least six lawyers to callShe found objections with each of them for one reason or anotherMrs*** continued to call even when I was out of state and even after I asked her not to do soI was used as a "messenger" between husband and wife as the temporary restraining order prevented direct contact between the parties
In the in-office meeting between the parties Mr*** agreed to use mediation as a way to end this very troubled marriageHe acknowledged his drinking and promised to stay away from the marital residenceHowever, he asked for the restraining order to be lifted at the couple owns a business together and communication between them is sometimes requiredI suggested that perhaps they could proceed without the restraining orderHowever, I, as a mediator only present optionsI am not a judge nor do I represent either side to the dispute
As to the fee, please understand "Time is a lawyer's stock in trade." (Abraham Lincoln)It's the only commodity we have to sellHad I billed Mrs*** for all of the time spent in answering her questions, meeting with her and her husband and fending off her slings and arrows being cast by her husband the amount would have been in the thousandsHopefully she has found someone sympathetic to her unique needsI am sorry I was not successful in my efforts
But, there shall be no refund forthcoming from this office

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Please see attached information.

As a prospective client I made sure that *** *** worked with keeping the restarining orders through the divorce from the very beginning stating I was referred from the *** *** CenterI was not clear as to how this would since legallyworkI was told by one lawyer that it is not legal and *** *** said it was.
Finally the meeting was arranged to see if er could come to am agreement The meeting did not discuss anything about the divorceIt was like a therapy session I ws aske dif I wanted the divorce and why cdidn't I give my husband the computerBefore and after I was told to provide paperwork for the divorce but not that I would be asked to get rid of the restraining order as a condition of
the divorceYou knew before that I was never going to remove the restarining order everTherefore it was dishonest, wasted time, and money pretending that you were going to do the divorce until
you charged my cardI will send emails where you told me provide to move
forward with the divorce separate from the restraining order than verbally
called me saying the ONLY condition is to get rid of itAFTER all that time
you must have known he would never do the divorce without the restraining order
being lifted but chose to hide this fact since you knew I do not speak to *** or have any written contact
You set me up less than 24hrs ahead stating it took you forever to get my
husband to agree to the meeting in order to get the divorce. I have the emails !!!
Also ...I did not know you were out of state when I called waiting to har back from youYou did not call me times either.
The Woman’s Resource Center (Domestic Violence agency http://www.wrcsd.org) is
very aware of what you did in my case and is not happy with the fact that you
ask clients to remove their safety in order to do business stating a clause in
the divorce paperwork is good enough to keep my family safeAlso after our consultation you released me
at the same time as *** when we were through as if it didn’t matter! You looked at me and when I followed you
and said to go to the elevator as *** stood there asking if I would like to
leave first! You are not a SAFE ZONE by any meansYes you did provide lawyer referrals to help me keep the restraining order doe my upcoming court dateThis showed you were supporting me or so I thought we were very clearThree of your referrals no longer existed , others too busy or charged a $
consultation fee. Most of the
attorneys I found on my own said you made *** violate the restraining order by
having the two of us meetPlease see below emails( also attached and attached letters)

Oki was not clear about the word
unusual (felt like we are difficult)since I thought you had experience
with these types of cases and acted like it was NOT unusal for you.
SIGNIFICANTLY higher was never
mentioned before.
It seems now I am being told this
right before we are seeing you at the last minute

I am slightly iffy...scaredjust got
texts yesterday from a relativecopiedpasted :
"Just be wise about how you deal
with *** because he's doing the work that makes your family money so you can
have the bills paid and you need that right
now so do the kidsJust be wise"
Sounds like a threatI don't talk
this way*** threatened me I am going to be so poor and he was going to
run off to another country so he would not have to pay child/spousal
support.
His personality is up and downone
minute let's do this peacefully next minute threatens telling me I don't
deserve anythingHe will close business and open a new one
I think I am a fool for trying
mediation.

You are the only one who can
decide what is best for you and your daughter
As a Mediator my job is to
provide a SAFE environment in which to come to a fair, reasonable and
equitable settlementThe contract you each will sign is fully enforceable by
the court and *** will suffer consequences if he fails to live up to the
terms
Closing the current business
and creating a whole new one if FRAUD and he will not be able to do so
As you've learned, the fees
with lawyers are significantly higher than you will incur via
mediationAre you prepared to spend untold tens of thousands of dollars
fighting in court or do you think the two of you can sit at my table and
negotiate?
Please tell me what you want
me to do at Noon.,

I am not saying you are
"difficult." Those types of cases pay SIGNIFICANTLY higher

I was called by Ms*** a total of FORTY EIGHT times about her caseI told her form the very first contact that I am a MEDIATOR not a litigatorI try to help people work out their divorce issues in a negotiated way rather than with litigationI every phone call with either her or her husband
prior to our TWO AND A HALF HOUR consultation I encouraged them to hire out side lawyersI gave Mrs*** at least six lawyers to callShe found objections with each of them for one reason or anotherMrs*** continued to call even when I was out of state and even after I asked her not to do soI was used as a "messenger" between husband and wife as the temporary restraining order prevented direct contact between the partiesIn the in-office meeting between the parties Mr*** agreed to use mediation as a way to end this very troubled marriageHe acknowledged his drinking and promised to stay away from the marital residenceHowever, he asked for the restraining order to be lifted at the couple owns a business together and communication between them is sometimes requiredI suggested that perhaps they could proceed without the restraining orderHowever, I, as a mediator only present optionsI am not a judge nor do I represent either side to the disputeAs to the fee, please understand "Time is a lawyer's stock in trade." (Abraham Lincoln)It's the only commodity we have to sellHad I billed Mrs*** for all of the time spent in answering her questions, meeting with her and her husband and fending off her slings and arrows being cast by her husband the amount would have been in the thousandsHopefully she has found someone sympathetic to her unique needsI am sorry I was not successful in my effortsBut, there shall be no refund forthcoming from this office

For your reference, details of the offer I reviewed appear below.I filed a complaint against you Mr.*** because my wife, ***, is so frustrated with the way you treated her.
In your letter, you said we hired you because my wife is seeking money from her ex-husband some years after the divorceYou put years in capital letters making it look like my wife was fleecing her ex-husbandBefore we hired you, I spoke to you and you ENCOURAGE us to do this because my wife is entitled to itThe military retirement wasn't in the original divorce decree, so you said we'll have to file it in courtWe told you he wasn't going to like it, and you told us it doesn't matter what he thinks, you're going to take care of it to put your words mildlyYou also said that he refused to sign the papers in your office and that we may have to send someone to get his signatureWe agreed, but you didn't do it in the spirit of negotiations and you knew that it was going to be difficult - you knew that going in, and by the way, we paid extra for that too. When it was my wife's turn to sign, she wasn't too busy or disinterested to come to your officeShe told you she would, but you told her not to and that you will just mail it to herIn mid march, my wife called you asking for an updateThat's when you yelled at her and told her you already mailed her (2) copies of the documentsMy wife asked you to mail it to our sons address because she babysitsShe got it this timeShe had to go to court to have this documents certifiedAll this time, my wife was just so frustrated with the way you were treating her but just kept quietI don't know why she didn't tell me how rude you were, but she didn'tFinally, DFAS rejected the claim because we didn't have the number of points that my wife was entitled toWe got it for you! My wife sent you an email letting you know what it isAll it need was to be reflected in the court order itself and be cetified by the courtNo reply from you Mr***No Mr***, you were never courteous at allHow can you say that when you yelled at my wifeYou also told her you don't answer the phone, only by emailIs that why you hang up the phone when she calls? You're right Mr***, you and I don't have a contract, but when someone treats my wife the way you didthey answer to me Who's the liar now...Mr***?

The following letter was just RE-SENT to Ms. [redacted]'s Ex-husband. He has been uncooperative since day one.Mr. [redacted],Your ex-wife is still having a difficult time getting her fair share of your Military Retirement Pay. She recently received the following notice:Just received a response from DFAS about my application.  It reads that my application cannot be approved for the following reason(s):The court order provides for a division of retired/retainer pay by means of a formula wherein the numerator (reserve points earned during the marriage in whole numbers) is not specified.  You must obtain a certified copy of a clarifying order awarding a formula wherein the only missing element is the denominator (Total points earned by a reservist).--Please provide me with the number of points you received as a reservist so the QDRO can be redone and submitted to the proper authorities.Thank you.(Your failure to do so will only mean a court appearance before a Judge who will ORDER you to supply the missing information) [redacted]A FAIR WAY MEDIATION CENTER[redacted] [redacted] (fax)www.afairway.com

First of all I have no contractual relationship with the complainant. I worked for his wife.
Second the man is a liar.

the original judgment. I had the unpleasant task of contacting Mr. [redacted] and telling him that his ex-wife was now seeking money from him some TWENTY SEVEN YEARS after their divorce. As you might imagine he was less than pleased and used language only a sailor is comfortable in using. After long and protracted discussions and emails he finally agreed to sign the attached document. But in the spirit of negotiations he failed and refused to come to my office. Instead my Notary was forced to go to his home. As I understand it the experience was dreadful. Mrs. [redacted] too was too busy or disinterested to come to my office and once again my Notary was asked to make a house call. The documents were submitted to the Clerk of the Superior Court immediately after the documents was fully signed and Notarized. The court in North County is notoriously slow in processing paperwork. Upon the receipt of the Judge stamped document is was forwarded by USPS to the address shown on the top of the document. Mrs. [redacted] called to say it had not arrived. I assured her (several times) that it had been sent. As an accommodation I had my office staff return to Vista to secure a second copy of the document. This one mailed to a second address provided by the client. I followed us and was told it had arrived.
Weeks later Mrs. [redacted] told me the document had been rejected by the agency which handles Military Retirement Pay (DFAS) for some small reason which required her ex-husband's cooperation. Unfortunately he has REFUSED to return my calls or letters. I'm stuck between a rock and a hard place. I'm doing what I can to get the problem solved. Short of driving the [redacted] there is little I can do at this point.
I resent Mr. [redacted]'s complaint. I have been as courteous as possible. I prepared the contract and went over and above to get the document signed. If he has a problem have him call me and not spread lies about the situation to you or anyone else.

Please provide me with the number of points you received as a reservist so the QDRO can be redone and submitted to the proper authorities.
Thank you.
(Your failure to do so will only mean a court appearance before a Judge who will ORDER you to supply the missing information)
