This complaint will only be settled in Court I have filed a small claims case against MrsS [redacted] and we have a hearing on June 9, On September 5, we entered a contract to install a new roof on her house I showed her a sample board and she picked out a color of "Weatherwood" On October 1, we went out to start the job She signed the contract that stated the color of the roof as "Weatherwood", in two different places on the contract I asked if she would like to see the sample board again to make sure that this is the color that she wanted She replied that she didn't need to see the board again and the color she picked out, was the color she wanted We did the entire roof and was completed on October 3, We called her phone and left her a message in regards to open up the garage and we could clean it out, because it was locked and we wanted to show her how we were going to do the bay roof She wasn't happy with the way it was done before We never heard from her I told my workers to call her Saturday morning on October 5thand go up to clean out the garage, do the bay window and walk over the job with her We never got a return phone call I told them to call her on Monday, October 7thand finish the job then, because I was leaving on vacation on Saturday the 5th of October On October 5th, I landed in Arizona and retrieved my messages on my cell phone I had got several calls from MrsS [redacted] about her being unhappy I returned her calls and she started to complain about the garage being dirty and that she had to clean it up She said that we broke a plastic chair and a couple of pots I told her that we could deduct them out of the final bill and that the workers can come out either Sunday or Monday to do the bay window and walk over the job with her Then she told me that she didn't like the color of the roof and that she wanted me to remove the entire roof and replace it with another color I told her that this was the color she picked out and that I wasn't going to redo the entire roof I told her that I was on vacation and will be back on the 14th of October and that I would call her then She demanded that I come back home from vacation and replace her roof on Monday 7th of October I told her that I would call her again on the 14th to set up a time to come out and talk to her about the job When I returned from vacation, I called her in the morning of the 14th and she told me that she didn't want anything to do with me and that she wasn't going to pay for the roof I sent her a certified letter with a bill in it and a letter, stating that I will give her a $1,discount and will come back out and do the bay window She declined the offer She did call the Building and Safety department and had an Inspector come out and look at the job We had pulled a permit before we did the job The Inspector came out and told MrsS [redacted] that he couldn't do anything about the color and that it would be a civil matter She then filed a complaint with the State Contractors License Board They had a Inspector come out and checked out the job and did up a report He said that the roof was installed in a professionally manner and nothing was wrong with the roof He gave a price on finishing the bay window, which MrsS [redacted] wouldn't let us finish He gave a price on sanding two fascia boards and painting them because she stated that we replaced them The two boards were not replaced by us and you can acutally see her old paint on the boards I stated that I don't think that I should have to sand and paint boards that we didn't replace Their was a couple of knot holes in the garage roof sheeting where we installed tin shingles over the knot holes This is an approved method by the City Inspectors of reinforcing the wood where the knot holes are The Inspector said he thought that the roof should be removed and the boards replaced I sent in a letter to the State Contractors License Board that I would be willing to go out and do this work or that I would be willing to discount my bill in the amount that the Inspector put on his report, to allow MrsS [redacted] to pay someone else to do the work This information was given to MrsS [redacted] by the the person, MsP [redacted] , who was assign the case MrsS [redacted] stated to MsP [redacted] that she didn't agree with the Inspectors findings that they had hired and that she refuses to let us complete the job and wasn't going to pay A-Guarantee Roofing Incany money MsP [redacted] relaid this information to me and stated that I would have to take civil action against MrsS [redacted] for payment that was due on the contract On April 28, I went up to Ventura Superior Court and filed a claim for the balance that was owed to A-Guarantee Roofing Inc., for the sum of $3, MrsS [redacted] filed a counter suit for the sum of $7, Bottom line she wants an entire roof for free The original contract was for $7, This is why as I stated on my first line, that this will not be settled and it will be up to the Judge to decide who should get paid what J [redacted] , President of A-Guarantee Roofing Inc
