Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] Please add your rejection comments below Good evening,I filed a complaint with the Revdex.com, and unfortunately the response from the company was sent to my junk email and I didn't receive it until recentlyThe complaint has since been closedI called to find out what to do about this and was instructed to send an email with our responseThis is in regards to Complaint ID: [redacted] Mr [redacted] did our initial walk through as our consultant to inform us of the renovations that needed to be made in order to make our house livableHeating our basement and garage was necessary to ensure our pipes wouldn’t freeze during the winterWe discussed this with Mr [redacted] prior to having our plumber proceed with this and were told that the funds were available and we could proceedWe also needed a water softener system, another necessity in order to ensure we had safe drinking water, and again something that was not included in Mr [redacted] list of necessary repairsSince we were forced to take out a second mortgage to cover these two necessary repairs we added the installation of a woodstove as a secondary heat source to this loanDespite numerous inquiries to Mr [redacted] about our contingency fund we were never given a definite amount that was availableWe were told we would get approved for the heating and plumbing changes because they were necessary repairsWe recently received copies of our paperwork from the bank that have obviously forged signatures of myself and our contractorsSeveral of the forms had different dates and numbers than the originals that I signed and have in my emailWe did have a friend do our carpentry work through his business that my husband has no affiliation to or ownership ofThere were pictures sent in by Mr [redacted] of work that had not been completed yet, however this was of the septic system in order for him to get his funds up front to start the jobHe told us we needed to pay him up front in order for him to be able to proceed with the workWe complied because he was our consultant and encouraged us to and, unfortunately, we trusted himWe also were on a timeline to have this work completed per the conditions of our loanMr***’ response discusses that our site contractor couldn’t meet our timeframeI am unclear as to what he is referring toMy husband and I had our third child during this process, but this is irrelevant to the timeframe because my husband wasn’t the one completing the work, our contractors wereWe had contractors for our heating and plumbing work, carpentry work, electrical work, and septic, so I do not understand what Mr [redacted] is referring toMr [redacted] informed us of the date he would be starting to work on our septic and gave us the go ahead to move in the following weekendWe gave our notice for our apartment which had new tenants planning on moving in immediately following our moveWe only had 6-weeks from closing our loan before our first mortgage payment was due and we were not financially able to pay both our rent and mortgage paymentMr [redacted] had something come up in his personal life and was unable to do his work as planned and he told us he would get it done shortly afterAt this point we were unable to not proceed with moving out of our apartment because new tenants were moving in and we had nowhere else to live, which Mr [redacted] was well aware ofAfter two months of excuses ranging from a kidney stone to getting pulled over by the DOT because his truck wasn’t up to code (which we later saw in the news was actually related to him backing into a school bus with his truck), we realized Mr [redacted] was leaving us high and dry after we paid him over $11,A small portion of that money did include contracting fees, although after talking to our lender we have since learned that he wrongly overcharged us for thisWe were the ones to initially reach out to our lender because we were unsure of how to proceedOur lender was shocked because Mr [redacted] had informed them that the septic was completeAfter they discovered he was lying they tried to work with Mr [redacted] to get him to complete the jobHe said he would for an additional $2,000, which we refused to do because we had already given him more than his initial quoted price, up front, without his work being doneOne of the few days Mr [redacted] was at our property to work on our septic he took it upon himself to not work on our septic and instead ditch out our trenchesWe did not ask him to do this and would have rather he spent the time focusing on our septic, which was a necessity for us to live in our house, as he pointed outWinter arrived, after the date we were supposed to have finished our repairs on our house per our agreement with our lenderMr***’ response discusses having issues with a permit, however he should have obtained this prior to starting any of the septic work on our propertyHe told us it was all set, however we have since learned that his check bounced and so the permit was never paid forThe town office made multiple attempts to collect payment for this, but never received a response from Mr***We did decline Mr***’ offer for an unreasonable refund of $2,We have had a new and reputable contractor quote us for the job and it will cost much more than the refund Mr [redacted] offered us, given the little amount of time and materials invested and the minimal work that was actually doneOur lender tried to help us negotiate with Mr [redacted] to help us get our septic completed, but in the end decided that we could not work with Mr [redacted] because of the conditions he set, including having the mortgage company sign a legal document stating they would work exclusively with him, which they clearly would not agree to for valid reasonsTherefore, Mr***’ offer of completing the septic free of further charge, cannot be accepted, which he is well aware ofWe reached out to our lender after it was clear that Mr [redacted] would not be holding up his end of our agreementMy husband and I are intelligent and we are nice people, however I do not see the relevance of this statement in terms of this situationWe trusted a man who took our money and agreed to do a job that he failed to even make an honest effort to completeAt this point we are willing to settle for the materials he claims to have, such as our pump tank and piping, with an additional $3, Regards, [redacted]

This situation is very unfortunate. I would be extremely frustrated if I was in the [redacted] shoes, but there are always two sides to every story. When I consulted with the [redacted] their original scope had changed significantly by their doing. The loan was approved and they had significant additional...

scope of work that was not covered in the loan. This included the heating of their entire basement and garage for approximately $2,500.00. The decided they wanted to put in a wood stove...ECT. All these changes went above and beyond the scope of work with a minimal contingency figure into the loan, about $4K. All the documents and paperwork for approving these loans where signed by them and the contractors. We were dealing with a mortgage company out of Texas so everything was electronically submitted. The [redacted] failed to indicate that they had a "friend" that was a carpenter who was approved to do the carpentry work, un known’s to me the Mr. [redacted] was part owner of the company and trying to get me to take pictures of work that was not completed in order to get money up front to pay for materials and other items. The [redacted] took out another loan to pay for the overages they oked outside the original scope of work and additional items they added, the Plumber, the wood stove ect...They also  had their site work contractor at the time that couldn't meet their time frame to get into the house because they were about to have their third child. I tried to help them find another contractor but the contractors where extremely busy. So trying to help them out, I had another division of my company start to do the work. We ran into additonal complications with excavating for the septic field which is typical for this type of work. After walking through the problems with the [redacted] they agreed at the time to pay the additional cost for problems that occurred. They actually signed a written agreement through the loan that they would not habitate the property until the septic system was replaced. It's in violation of Maine state law to habitate a property without a legal septic system. Within weeks after they received this document they moved into the property with blaitin disregard of the State of Main laws. I formed the mortgage company as I should have about the situation and they did nothing, not even contacted the [redacted] about the laws they were breaking. In the mean time the [redacted] need work done on their ditches because substantial water was not daring from their property and flooding their yard. I cleaned out the ditches and reworked them; I did this work for free knowing their situation and did not charge them. Winter arrived and after running into more problems with the town and issues on their part for permitting we could move forward. I told the [redacted] I could give them a refund for the work minus the materials and labor that my company already had paid for and they said NO they wanted a full refund. They decided to contact the mortgage company who contacted me to see if we could work things out. The [redacted] still owed a balance of about 2K on the entire project. We were working with the mortgage company and I indicated to them that in the best interest of everyone I would complete the work at no charge even though they owed me a balance but I would like to have it done on my schedule terms to get in and get out within a week. I also wanted the [redacted] to sign a revised legal document indicating what we all agreed to so there would be no confusion this time around, they have refused. I have tried to resolve this issue amicably with the [redacted] and feel I’ve been more than reasonable with my approach. I would still complete the system free of charge or refund them their money minus the material and labor its cost my company. The [redacted] started out to be very nice people, unfortunately when things got complicated and need to be dealt with in a different way due to laws, they got upset and took it upon them self’s to do what they wanted when they wanted. Again I tried to help the [redacted] out with the situation of their third child on the way and they did what they wanted any way. They are very intelligent people, [redacted] is a Nurse Practitioner, so I know they understood their actions before they executed them. I understand their frustration in this situation, but I refuse to do illegal things with my company just so they can go about living in their home.

I had met the [redacted] at their home and had gone over what I thought the problem was with the water in their basement. I proposed a solution and they where in agreement with it. I took a deposit from the [redacted] and was in the process of getting out a contract and scheduling their work. After attempting...

several time via e-mail to get the contract to the [redacted] with in a month of giving me a deposit for the work I received a call indicating they wanted their deposit back because something just didn't feel right? I explained to the [redacted] that the deposit was non refundable, but decided to return the deposit to them any way. At the juncture of telling them I would return their deposit the [redacted] moved forward and wrote some not so nice things about my self and my business on sites all over the internet. I hadn't even preformed any work for them they decided on their own they didn't want to use me any more. I'm not sure weather they had a financial hardship and needed the money to cover other things or something else. Like I said the only explanation I received was that something didn't feel right to them. I'm not sure what more I can do in this situation besides give the deposit back and move forward. As I said previously I didn't get an opportunity to do any work for them at all.

[If you are rejecting the business's response please enter your rejection comments here.]Almost everything he is saying is a lie and we have proof.  Proof has been sent the the State of Maine Attorney General's Office and PPD.  They have more than enough evidence to charge him with Felony Theft Class C, and that will be done on October 1st.  NEVER was there any mention of the 50% deposit being non-refundable.  We caught him in a huge lie on the morning of July 9 (we have the email and the phone record to prove it).  He never sent a Contract and could not produce one EVER!!  6 weeks after he cashed our deposit check, we still had no contract and he had cancelled 3 starting dates.  Nothing he said turned out to be true.  He told us he'd send back our deposit check which was NEVER non-refundable.  NO ONE would pay a 50%  non-refundable  deposit for ANYTHING!  We will let the ADA, AGs office and the PPD handle this from now on.
