I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
I start by saying to the dealer’s statement that he is
spending more of his time to this complaint against his business is which is
not frivolous in the eyes of myself the consumer for this person to make
mention of the amount of time being used on this process shows that he has no
value to the time that I am also spending on this complaint, which just goes to
show how his intentions are to take gain of profit and only what he says and
does mattersAs to the dealer saying I am not providing accurate information
on the transaction in nowhere in the dealers response does it show where my
information is inaccurateI’ve registered and gotten plates from the DMV in
the past when I’ve purchased vehicles from dealers similar to the one at a plus
auto and there was always an option for me to bring my registration and plates
form the DMV when picking up delivery of a vehicle had this dealer given me the
option instead of leading me to believe that he was doing me a favor by picking
up the plates and registration I would have done so myselfThe device hardware
was paid for, I don’t have the hardware nor do I have access to said hardware
so I only ask for what I paid for and if that cannot be provided to me than a
refund is the only fair responseTo the device install to say that it takes
one and a half to three plus hours to install and to say that it only takes
less than one half hour to remove makes absolutely no sense at all and I make
this statement as a person who has done mechanical work to automobile so I
speak from experience and I also don’t think that a person without experience
would believe such a statementThe way the dealer made this statement he was
also speaking in general and not to the specific time it took for his mechanic
to install the device on the vehicle he sold to me again showing how he
operates his business in a way meant to deceive me the consumer and by not
being clear and concise he is also showing no willingness to take responsibility
for his actionsSo again I’m asking for $to be refunded to me $for
the device hardware for the docs process and $for overcharging me for
installing the device

I request that you review your complaint process as I find myself now spending more of my time responding to a frivolous complaint.The customer is not providing accurate information on the transaction in his complaint. This transaction took place over a year ago, beginning with a complete verbal overview of sale and finance process to address all concerns for the customer, the customer agreed to our policies. We then received deposit for the vehicle from customer. Customer was given a receipt for the deposit which included terms of the sale and costs associated with the transaction that we discussed prior to customer paying deposit. We then prepared the car for delivery which took about a week. Prior to pick up the customer signed all the documents associated with the transaction.I took the necessary documents to DMV to get plates and registration, we charge the NYSDMV regulated $75 for that. Customer was aware of this and signed document stating he agreed. NYSDMV regulation states the selling dealer must take the documents to the motor vehicles issuing office and submit them if there is a lien on the vehicle. If customer is paying in full for the vehicle then the customer is allowed to do their own NYSDMV registration transaction therefore the $75 would not apply. The payment reminder device, accessories and costs were all explained to the customer in detail prior to us receiving deposit. Customer agreed to the terms of the sale. As explained to customer we do not issue refunds. Therefore the hardware used to connect the payment device last year is not refundable. There was no concealment of any costs, everything was explained in detail to customer before sale and he signed the documents agreeing to terms of sale and copies were provided to him. Our current labor rate is $70 hr for vehicle repair. Device install is a flat rate labor fee of $100, time to install device is 1.5 - 3+hrs depending on vehicle. Usually device removal is less then 1/2 hour, we do not charge for device removal. There are no additional actions that I can take to resolve customers concern. There is no basis for this complaint. Please remove from my file. Additional helpful payment device information: Car dealers have found on-time payment protection systems to be a good way to ensure that their customers make payments on time. Those dealers who use these devices have found that they usually don't have to go through the trouble of repossessing an automobile. The device has also helped them expand their market to include those with whom they would not otherwise do business. Typically, an on-time payment protection system is a little black box with a keypad to punch in the code. It is connected to the car's electrical harness. The devices provide a warning signal to the customer after the due date of the car payment, by flashing a red light, for instance, or by chirping. Beyond a grace period of a few days after the payment is due, the car does not work. Once the customer makes the payment, the dealer gives her a code to punch in that stops the warning signal or starts the car. With the use of these devices, car dealers have been able to do business with more credit-challenged customers whom they would not have sold to previously. With the use of on-time payment protection systems, they are more assured that the customer will make his payments on time, or at least make the payments. Customers are going to come up with the money when they realize that they can't use their cars otherwise. This makes dealers more confident about extending the credit to these customers. In order for the dealers to be assured that the customer will not miss his payment, these on-time payment protection systems need to be tamper-proof. At the time they enter into the deal, buyers typically sign an agreement with the dealer acknowledging the presence of the on-time payment protection device. They also agree not to tamper with the device and to return it to the dealer after they are done making their payments on the vehicle. The devices have some safeguards to ensure the safety of the customer. It would be dangerous if the device were to be activated while the driver was out late at night in some desolate area, for instance. The device will not cut off a running motor. In an emergency, a temporary code will allow the car to run for an additional day.

Customer didn't purchase any device from us. Customer was aware of all charges associated with vehicle purchase before taking delivery of vehicle. Customer was charged $75 for DMV docs processing which is standard with all NYS Dealers. Customer was charged $100 for our payment reminder device...

install. Customer was charged $25 for our payment reminder device hardware. Customer was NOT charged for our device removal. Customer agreed to terms of contract. Can supply supporting documents upon request. No basis for complaint and should be removed from my file. [redacted]
