Recycled Center on 2/2/That is ½ months after he initially examined the truckHe only did this because he began to panic due to his repeated misdiagnosis of my truckOn 12/16/I brought my truck back to 1. My name is *** M*** I am an Attorney at Law in the State of New Jersey; and I represent ***'s Garage and *** ***.2. Agreed that the Ms***'s vehicle's (Chevy Avalanche) transfer case was purchased from *** Recycled Auto Parts; was still under a year
warranty; and that ***'s Garage was assigned to investigate Ms.***'s complaint of vibrations.3. Ms*** complained to Mr*** that her vehicle vibrated: (a) while it was idling, (b) while she drove it at speeds up to mph; and(c) while ***4. The transfer case is only engaged (only wor***) when the vehicle is in 4-wheel drive mode; and Ms*** did not have the vehicle in 4-wheel drive when the vibrations occurred. None-the-less, Mr*** examined the vehicle's transfer case and determined that Ms***'s 'local mechanic' (i.e*** *** *** *** *** *** *** had put the wrong fluid in it. On 11/28/15, Mr*** drained and refilled the transfer case fluid. The charge for fluid and labor was $56.5. Ms*** continued to complain about 'terrible vibrations'. Mr.*** checked her vehicle again; and determined that her front differential was coming apart. Then, on 12/16/15, with Ms***'s consent, Mr*** removed and replaced the Front Differential; and refilled it with new gear oil. Mr*** also replaced the vehicle's air bag sensor at the passenger side front door free of charge (value:$200). Mr*** then road-tested the vehicle and it was functioning properly. The charge for parts and labor, minus the air bag sensor, was $829.25.6.. Ms*** continued to complain about vibrations without even driving the vehicle; just while it was idling. On 12/20/15, with Ms.***'s consent, Mr*** replaced the Motor Mounts; and replaced the Impact Sensor (at front door). The charge for parts and labor was $535.20. [Mr*** did not charge Ms*** for the impact sensor or for replacing the Trans Mount ($value).]7. Ms*** continued to complain of vibrations; then, with her consent, on 1/12/16, Mr*** replaced and machined the front brake rotors; changed/refilled the oil (quarts); balanced all four (4) tires (all were out of balance); removed the rear drive shaft and checked the U-Joints (all common causes of 'vibrations'); but they were wor*** properly; and the rear drive shaft was re-installed. The charge for these parts & labor was $200.09.8. A few weeks later, after the severe snow storm, Ms*** complained to Mr*** that her Avalanche had not worked in wheel drive; and she had gotten 'stuck in the snow'. On 2/2/16, Mr*** informed Ms*** that he had replaced the Transfer Case. There was no charge or cost to Ms***; because the parts and labor were under warranty. However, Ms*** was very angry and verbally abusive to Mr***. Ms.*** cursed and swore at Mr***. Mr*** then told Ms*** to pick up her car outside the *** *** *** *** *** *on their property; not 'on Rt9') with the key in it. [This is a common practice when patrons ***'t pick up their cars before close of business; but in this case, Mr*** did not want to be the victim of any more of Ms***'s abusive behavior.] .10. When Ms*** came to ***'s Garage to 'talk to Mr***'; she again repeated cursed and swore at him. He repeatedly asked her to leave. Mr*** never touched Ms***; and has witnesses to prove that Ms***'s claim that "he grabbed me and tried to throw me out" is false.Thank you for your attention to this matter.*** M***, EsquireLaw Offices of *** M***, LLC*** *** *** ***

Complaint: [redacted]
I am rejecting this response because:1. I will fallow Mr. [redacted]’s format for my reply. First, just the fact that [redacted] had to have an attorney reply for him shows his guilt. This is not a court of law. Also, four separate times Mr. [redacted]’s response states (with Ms. [redacted]’s consent). I have five invoices from [redacted]’s Garage and my signature of approval is not on any of them. Also, none of the parts that [redacted] removed from my car were ever shown to me to prove they were bad. When I asked to see them they were already discarded. 2. My truck is a 2004 not a 2003. [redacted] has been servicing it for 3 ½ months and he doesn’t even know what year it is. That alone shows his incompetence. I had a transfer case installed my [redacted] on 10/29/15 with a 1 year warranty. Yes, I was forced to bring it to [redacted]’s garage to investigate my complaint. 3. I advised [redacted] that the truck shook so bad at while idling it felt like it was going to fall apart. I also advised him that while driving it was not nearly as bad but it still had a vibration. There was nothing mention about a speed, especially 85pmh. That is a lie. I have a 5 and 9 year old. I do not drive 85mph. Also, there was no complaint of vibration when breaking. Again, this is another of [redacted]’s lies. That didn’t happen until January. It is even on the invoice from 1/12/16. [redacted] has lied so much he can’t keep his story straight,4. When this first started it was July 2015. My truck was making a mild chain noise. I brought it to [redacted] and they topped off the auto track fluid. They advised me it was coning from the transfer case. He gave me quote of $1200 for rebuilt. He advised to wait and to see the extra fluid helped the noise. It did. The noise went away for almost 3 months. It started again in August. When It started again I brought it to [redacted] for 2d opinion. [redacted] also advised me it was the transfer case. We took for test drive ad he said the truck only went into 4WD low. It would not go into 4WD high. [redacted] told me that the truck was still operational and the transfer case was not falling apart. He said was a little noise but the 4WD high will not work. [redacted] gave me quote on [redacted] transfer case of $2300. He topped off the auto track fluid again and noise went away until October. I then went back to [redacted] to have transfer case replaced because the rebuilt was much less than the GM one [redacted] wanted to install. The original transfer case that was put in by [redacted] never worked from day one so the truck still would not go into 4WD high. I again brought the truck to [redacted] Auto In Point Pleasant for a 2nd opinion after [redacted] installed the first transfer case. [redacted] from [redacted] confirmed the truck was still not engaging in 4WD high. [redacted] advised me it could be a bad rebuilt transfer case. He said the truck didn’t go into 4WD high with my old one and is still not going into 4WD high with this one that [redacted] installed. He said I sill had the exact same problem. I then brought the truck back to [redacted]. [redacted] Alsieux, owner and mechanic, of [redacted] said that was correct and he would change it out under the warranty. He called me the next day and advised me that he called [redacted] and that he was told by [redacted] that he was not allowed to do that. [redacted] told me that [redacted] at [redacted] said I had to bring my truck to [redacted]’s Garage so they can determine if the transfer case that was installed is bad. [redacted] Alsieux said that [redacted] would not let him change out the transfer case. So, I was forced to bring it to [redacted] ([redacted] warranty mechanic). I have no invoice for 11/28/16 stating any fluid was changed in my truck nor that anything was [redacted]e. [redacted] gave me no paperwork from that visit because he did nothing but look at the transfer case and determine nothing was wrong with it. He is making things up to cover himself. I advised [redacted] that it had to be a bad transfer case. I told him I had two mechanics telling me it was. I took truck home and it continued to vibrate. I called [redacted] and they again advised me there was nothing they could do because [redacted] wouldn’t allow them to. This had nothing to do with (the wrong oil) that, [redacted], in Point Pleasant put in. [redacted] is lying. [redacted] put in “auto track fluid” which is the correct fluid. I have the invoice from [redacted] for the purchase of the transfer case and 2 quarts “auto track fluid” dated 10/28/15. Also, [redacted] from ** [redacted] who examined the car prior to [redacted], said it was the correct fluid. He also stated it wouldn’t have mattered if the wrong fluid was put in. [redacted] said, that If the truck wasn’t in 4WD no fluid was being used. And since the 4WD high didn’t work since the day it was installed, there was no fluid used. [redacted] also said, even if wrong fluid was used it would not have damaged the transfer case or caused it not to work. With that said, [redacted] Dunn mentioned the “wrong fluid” thing for the first time to [redacted] at [redacted] Recycled Center on 2/2/16. That is 3 ½ months after he initially examined the truck. He only did this because he began to panic due to his repeated misdiagnosis of my truck5. On 12/16/15 I brought my truck back to [redacted]’s Garage due to the constant vibration and due to the fact that [redacted] would not let anyone change the transfer case. I told [redacted] that my truck never had this problem until the rebuilt transfer case was installed. [redacted] then told me it was not the transfer case. He said he found metal shards in the oil and it was coming from the front rear differential going bad. He said the differential falling apart is probably what caused my original transfer case to go bad. On 12/16/15, since I was forced to use [redacted] for my truck repair, he replaced the front differential. The charge was $829.25. He also replaced the air bag sensor that he got for (FREE) from [redacted] didn’t give it to me for free. That can be confirmed with [redacted] from [redacted] said that [redacted] didn’t charge for the piece due to all my inconvenience from this transfer case and having to bring my car out to [redacted] (35 minutes) from my house.6. Yes, I continued to complain about the vibration while in idol and while driving. To Say I complained without driving the truck, as [redacted] states, is ridiculous. Of course I drove the truck. How else would I have gotten home from his garage?? The truck never stopped vibrating since the transfer case was installed by [redacted] on 10/28. I brought the truck back again on 12/20/16. Now [redacted] says it’s the Motor Mounts that are the problem. I told him I just paid $829.25 for the front rear differential because he said that was the problem and the truck was still not fixed. He said the differential was bad too but the Motor Mounts are what is causing the vibration. I did not wasn to use [redacted] any more but I was forced to. [redacted] charged me $535.20 to replace them. When I picked up the truck it was still vibrating yet again. As far as the impact sensor goes, it is on my invoice so he did charge me. 7. This is just another untruth on [redacted]’s part!!! On 1/12/16 [redacted] shaved down my rotors (machined). He did not replace them. You would never do both. You (machine) the old ones to stop the vibration. If they are not able to be (machined) then you replace them. Again, this just shows that [redacted] either lies or he is a poor mechanic. With that said, once again the truck was still vibrating. He did do an oil change which has nothing to do with any of this. He says in this statement that the wheels were not balanced. That is false, I had the wheels balanced and truck aligned by [redacted] on 1/19/15 for regular maintenance on my truck. This only needs to be [redacted]e once every 2 years if at all. It was the one and only time I ever had it [redacted]e in 11 years. I also have a receipt for this as well.8. Yes, on 1/23/16 my truck got stuck in 8 inches of snow. In the 11 years I’ve owned my truck, with snow accumulation over two feet, I have never gotten stuck. The reason my truck got stuck was because the 4WD high would not engage ever since the transfer case was installed on 10/28/15. This was verified by [redacted] at [redacted] Auto. It would not engage because the TRANSFER CASE WAS BAD. This is what I had been telling [redacted] for 3 ½ months… This was the whole reason I was forced, by [redacted], to bring my truck to him to begin with. However, Mr. [redacted] said the transfer case was fine and deemed everything else in my truck to be the problem. He did this either because he is an incompetent mechanic or he wanted to intentionally rob me of $1600 for parts that weren’t needed. I called [redacted] on 2/2/16 to see if my truck was fixed and ready. He informed me that problem was the TRANSFER CASE. It was exactly what I said it was and my mechanic said it was 15 weeks ago. Once he replaced the transfer case all the problems were went away. The vibration was gone and the 4wd high worked perfectly. When Mr. [redacted] informed me of this I told him that I wanted all my money back due to him misdiagnosing the issues with my truck on 4 separate occasions. He said no. we had a brief conversation and there was absolutely no verbal assault on Mr. [redacted]. That is just another lie. [redacted] gave all my old parts to [redacted] Auto Recycling. He told me to get all my old parts back form [redacted] and he would reinstall them and give me my money back. I called [redacted] and spoke to [redacted] who informed me all my parts were gone. (This can be confirmed with [redacted]). I informed [redacted] about what was happening and that this was their fault too. My mechanic [redacted] from [redacted] also called [redacted] at [redacted] to inform him that the truck was misdiagnosed. Rather than call [redacted] back I thought it would be better to talk face to face like adults. When I got there my truck was sitting out by Rt. 9 with the keys in the Ignition and the doors unlocked. (I have photos and it is the police report). Anyone could have stolen my truck. As far as (common practice) that is another of [redacted]’s lies. I dropped my car off to his shop five time. Every time it was a Sunday when he was closed. The industrial park is open on Sunday. Mr. [redacted] advised me to pull it in front of his garage and put the key in the drop box. That is what I did every time. Never did he tell me to leave it outside the industrial park on Rt. 9. Never did I once see a car out there on my 10 separate visits. The only victim here is me. It is certainly not Mr. [redacted]. Also, Mr. [redacted] did put his hands on me and it is stated in the police report. Mr. [redacted] couldn’t possible have witnesses’ because he and I were alone initially. My father and his two workers did not come in for at least 10 minutes. At that point Mr. [redacted] advised is two young workers to remove me and my 76 year old father.Joe [redacted] is a vile man. He is a liar, cheat and a poor mechanic. He wants to blame his incompetence on everyone and everything else.Thank you in advance,[redacted]
