When M & N Towing was dispatched to the customer by her insurance company, they advised us that if the vehicle had been in an accident that the service wouldn't be covered because the insurance was suspicious of vehicle being in accidentWhen my driver arrived on the scene he observed that the vehicle had jumped the curb to the other side of the roadthere was dirt and debris in the roadway along with the bumper and the wheel being messed up on the carThe driver immediately called to dispatch to confirm that the car wouldn't be covered by their insurancewhile on the phone with the driver, the dispatch never heard any disrespect from driver to customer, she did hear to females in the background arguing or loud conversation one female saying the car was broken down and the other saying it was in accidentbut u could clearly see that it had been in an accidentwhile driver was on the phone with dispatch, dispatch called the insurance company to confirm what was previously advised to us about the vehicle not being covered if in an accidentThe insurance confirmed not covered if had been in accident with body damage, which the front bumper and wheel was messed upI advised my driver that the insurance did confirm it was not covered since it had been in accidentMy driver then advised them that it wasn't covered and which they weren't happy about then getting defensiveMy driver then rolled up window and pulled off instead of debating/arguing about what had happenedOnce again, while dispatch was on the phone with the driver she never heard any disrespect taken When the customer contacted us directly by email, a manager replied back thanking her for reaching out to us of the situation, and the driver would be reprimanded accordingly after all avenues were investigatedHer response was that, that was a "sorry apology without explanation is completely unacceptable"

I am rejecting this response because:I am more than elated that M&N Towing took the liberty to respond to this complaint, and was proactive in supplying documentation to support their position. Therefore, I know hope that they respond to this response with the same level of due diligence and aptitude. Websters dictionaries definition of fraud is as follows: Definition of fraud1a : deceit, trickery; specifically : intentional perversion of truth in order to induce another to part with something of value or to surrender a legal right was accused of credit card fraud b: an act of deceiving or misrepresenting : trick automobile insurance frauds.Therefore I move to present my position in why I allege that both M&N Towing in conjunction with the *** at the National Harbor are both co-conspirators in an effort to defraud and self enrich themselves at the expense of the hard working residents who live hereI implore that M&N respond to the following with documentation as they have shown the ability to do.According the Secretary of State in Maryland M&N towing's trade name registration occurred on or around 3/17/1992. This would mean that this company has had over years or more in this industry. Therefore it would be unreasonable to believe that M&N towing could not have possibly been informed of the new laws that were enacted on October 12th, 2012. These laws went into effect to prevent unfair, unethical companies such as M&N towing from continuing their pattern of Predatory Towing.The law states the following: The new law applies only to the towing or removal of vehicles from “parking lots”, which are defined as privately owned facilities consisting of three or more spaces for motor vehicle parking that are accessible to the general public and are intended to be used by residents and guests.Signage Requirements (Sec21-10A-02)The state law now requires at least one sign for every 7,square feet of parking space in the parking lot. Each sign must:Be at least inches high and inches wideBe placed in conspicuous locationsBe clearly visible to the driver of a motor vehicle entering or being parked in the parking lotState the location and name of the towing company to which the vehicle will be towedState that “State law requires that the vehicle be available to be reclaimed hours per day, days per week”State the maximum amount that the owner may be charged for the towing of the vehicle, andProvide the telephone number of a person who can be contacted to arrange to reclaim the vehicleThe parking lot in which M&N towing has been illegally towing from may be over 100,s/f. That would mean that they need at least signs with these specifications. I have provided a picture of only signs, one which is not in compliance to the law. Please provide your pictures as you have shown the ability to do that shows the appropriate number of sings in accordance to the lawAuthorization (Sec21-10A-04(A)(5))Before towing or removing the vehicle, the parking lot owner (the Association or authorized agent) must authorize the towing company to tow the vehicle. Authorization must include:The name of the person authorizing the tow or removal of the vehicleA statement that the vehicle is being towed or removed at the request of the parking lot owner, andPhotographic evidence of the violation or event that precipitated the towing of the vehiclesMy car was towed on the morning of May 21st, when there is no on to sign for such authorizations. Please provide me the documentation of who made this authorization on the above mentioned date as you have shown the ability to do.Furthermore, I am a resident and leaseholder of an apartment here at the ***. I am also entitled access to parking space which I pay $per month. This is part of my lease. I have hour day a week access to this space. At 9pm the ***s concierge goes home. On several occasions my car has been at the dealer for repairs for an extended period of time. When I am provided a loaner car, this car now serves as my primary vehicle. If there is no one at the concierge after 9pm, I have to either park at another parking garage and pay for parking, although I have already paid for hour day a week parking at the ***. I also have the option to take a chance and park without a temporary pass and allow the unethical M&N towing to tow my vehicle out of a parking garage that is not complaint with the laws of the land. Just think about it, I pay for a parking space that allows me hour days a week access, however if I have a rental car and its after 9pm I cant park in a space that I pay for or else M&N towing will be waiting in the wings to tow me from a garage that they are not following the laws. This is at best is unethical, unfair, self enrichment and in my opinions teeters on the lines of fraud. I have only scratched the surface in my quest to expose these business. I will not stop till this story is made public or the practices are changed for the betterment of this community.In closing, my car was towed on May 21, for an invalid parking passI have provided a picture of the pass that shows that it was valid. I placed my parking pass on the dashboard. When I closed the door the gust of wind caused it to move out of view. This was the cause of the towHowever, M&N towing and *** are towing from a garage that is non compliant to the law. Furthermore they do not have required signage. Finally if no one is their to even give me a parking pass to my own space, they are surely not their to authorize this tow. Which makes this unfair, and deceptive and in my opinion illegal

Attached is a ledger from the rental office of when the...

parking pass was issued, when it expired, and the fact I was issued an "A" pass. Also attached is a letter from my rental office stating that the pass that was issued and where it was displayed in which is my rear window. The said towing company went into my vehicle and took out the pass when it was towed. The guy named Joe told me he towed it because it had a "B" permit in which I was never issued. Once I arrived to the lot I asked for proof of the "B" pass and of course there wasn't one. They then charged me for two days my car was only there foe one day. I'm not sure who is responding to you all I have been trying to contact the owner since it has happened and Joe says Marvin will be in after 3:00. And, when I call after 3:00 a young lady answers and says that Marvin is out of the country on vacation. I have no idea what is going on but it is utterly ridiculous.

Good morning,I've been checking our records for a vehicle owned by the complainant on that date and dates before and haven't located anything by name. If possible I need to get more information such as the type of vehicle and where it was towed from.Thank you

I am rejecting this response because:
The company has no explainatiom for their employee's actions. They are choosing to completely disregard the fact that their driver called me a [redacted] and called my car a "piece of [redacted]". Of course they are going to say that when the driver was on the phone with dispatch all they heard was the customers being loud, to try to paint it as not the driver's fault. However, there is no way for this incident to not be on them. They are the employee, I was the customer. Who wouldn't get defensive after being called a [redacted]? Once I again, he was the employee and I the customer there is no excuse for the language he used against myself and my girlfriend. The company has not offered any explainatiom or any apology.

In order for a parking permit to be valid it has to be visible in which this case it was not.  Attached is a photo copy of the hang tag permit and photo of where it was located in the vehicle. M & N Towing has no way of verifying a permit or vehicle due to the [redacted] privacy of their tenants. Due to the fact the parking permit was not visible and properly displayed no refund is due.
