Per the contract, payment of the completed work to date was received in September, At that time, work progressed to next stage, which was staircaseStaircase was completed in October, 2015, with the exception of one missing spindle
All spindles were removed by me and refinished by customerSpindles never left the homeIf customer locates missing spindle, I will installTub was installed in good working orderUpon removal of protective covering and cleaning, no cracks were visibleAll plumbing issues have been addressed and rectifiedI am unaware of any unaddressed plumbing issues at the residenceBathroom vent issues are minor and can be addressed as a warranty issue, not a code issuePainting of dining room ceiling was not in contract, but it was painted twice for free at my own expense of labor and paintAs of early December 2015, all known drywall issues were repairedAll tiled surfaces were cleaned and sealed after installation with adequate sealer provided by me, at my expenseSealing of tile was not in contractCity inspector pointed out items with regard to electrical, which were all repaired immediatelyCity inspector has signed off on this homePer the customer's requests, I installed and provided several items at my own expense (outlets, storm doors, entry doors) and upon request for reimbursement from customer, was advised those items were not listed in the contractThe customer currently has an outstanding balance of $2,100, which is the cost of the staircase, of which none has been paidDue to the fear of non-payment of future work and materials, along with outstanding balance, the hearth has not been installed, nor billed to customer

Per the contractor's request, payment was made prior to completion of workSince the contractor requested a payment advancement stating financial difficulty a new agreement was signed identifying several known outstanding items that required completion including but not limited to the staircaseThe staircase is still incompletePer the city inspector the staircase is to be reinstalled in the same fashion as it was removedThis requires all the spindles to be anchored into the stair treads with a dowel pin or threaded insertThe top spindles have only been toe nailed inWhen I previously questioned Ken about the missing spindle he stated that another representative from Lumber Liquidators removed the spindles and they may have misplaced the spindleHe is now stating that he removed them himselfHe has also stated the spindles never left the site, however, after advising him that his installation method was deemed inadequate by the city inspector Ken took the remaining spindles that he had not reinstalled home to bore the spindles and install the required dowel pinsHe states that the tub was installed with no defects, however, when questioned previously he stated that he did not inspect the tub or remove the protective covering prior to installation and could not state if the damage occur prior or during installHe also agreed to remedy the issue by installing the replacement tub I orderedPlumbing issue persist and Ken has been notified several times of the ongoing issuesLast time he was onsite he admitted to not knowing what the source of our problem was after removing the venting cover in the atticWe continued to have slow draining in the kitchen, a leak in the downstairs bathroom, bubbling in our toilets, and occasionally the sewer will back up in the linesAll of these issues have be communicated several times to KenThe bathroom vent in the downstairs bathroom has been vented to the soffitPer code it is to be direct vented through the roofThe minor venting issues Ken referenced is the insulation that continues to fall through the ceiling/fan and onto the floorKen states these are warranty issues, however, I have reported them to him prior to September and none have been addressedI have repeatedly requested to have a copy of his warranty and have still not received a copyHe states this issues as warranty work as says he will get fixing them when he has time, however, he never attempts to schedule the workWhen he was last onsite he stated he hasn't been doing any work, indicating he has had the timeNot to mention that our contract states he is to perform any and all repairs expeditiouslyThe dining room ceiling repair/paint is covered under the contract because he damaged the ceiling while installing a light fixtureThe contact states that he will repair any damage made while performing the remodelAlthough he has put paint on the ceiling, his attempt has not yet restored the ceiling to its original conditionThere are several areas where the drywall was damaged during the demo and others where the drywall was poorly installedAll areas have been made know to Ken in punch lists and during walk through and remain unaddressedThe contracts states that Ken will provide all materials required to complete the job unless specifically stated in writing to be provided by the homeownerAll tiling surfaces were to be properly sealedKen stated he sealed the marble and other tiled surfaces, however, after noticing staining and difficultly cleaning I inquired what sealer he usedTo my dismay, he sent me a picture of the product used and it was only a tile cleanerI have received no invoice for $2,Per our contact the remaining work was to be completed prior to payment and the contractor will be charged a daily fee of $for any work not completed prior to October 23, Since Ken still has not completed the work and he is aware he has forfeited the remaining funds he has decided to no longer honor the contract and has stopped all work and contactWith that said, our contract also states that he agrees to pay for another contractor of my choosing to come complete the work if he defaults on our agreementSince he originally stated he needed to be paid in advance because he didn't have the funds to pay his employees and they refused to return to work until he did, I have not yet attempted to collect payment from himI was trying to give Ken the opportunity to fulfill the contract on his own

Unacceptable response from the company. We paid [redacted], the owner of Lincoln Remodeling, in full, to complete the job we agreed to. We found issues after payment was made and he assured us that he would return to correct the problems. It has been over 4 weeks now and [redacted] has not shown up. He needs to put his other customers on hold like he has done to us. Our project was and still is important to us and we expected more professionalism from this man. We had a time frame in which we wanted our stairway to be completed, but due to [redacted]'s cocky attitude that time frame won't be met. He left us hanging after he took our payment and started projects elsewhere. Shameful.
