Thank you for your email. The client was asked every year if they had every document that we entered the previous yearThe client had a track record of forgetting documents from year to yearThe client then told us that we had all the documents in our possession for the tax year
The client said, as written in the complaint, that we neglected to enter the amounts from a But yet we competed the returns for the year before and after including the same We have a disclaimer in the tax return that we provide every client to thoroughly go through their documents and the copy of the tax return, that we provide, immediately after they receive it to look for errors or omissions.We do this for every client every yearWe always ask if something is missingIt is very rare that we leave anything out especially if we have the documentGiven the client track record we denied his claim. and there are no issuesThere are some clients that get information to us after deadlines and we notify them of such and they are in agreementWe have and always will do our best to make sure all filings are done timelyWe have never had a client receive a late payment penalty or non filing penalty because of our negligence not filing documents timelyIt has always been because the client did not give us the necessary information at the correct timeMr*** says they were in a time crunch and requested the filings done asapCorporate tax returns are not due till March 15th of the following tax yearWe do the filings for our clients on a first come first serve basis and try to get them back to the client at a set dateDuring tax time, time is limited, but we have always done filings timely to our clients satisfaction and to the fed and state governments timelines. For the better part of the year 2015, our office responded to and contacted the parents of the Mr***We were not sure the circumstance of the whereabouts of Mr*** and had told the parents that we were uncomfortable with working with their sons finances without his direct consentWe did get a hold of Mr*** later that year and he said it was okWhen we were notified by him it was ok we then were comfortable to proceedDuring this time we contacted the parents and told them we needed to see a completed profit and loss statement so we could have on record his exact income for the yearWhen we received that p/l statement we proceededWhen the taxes were completed we then had the parents come and pick up the filingsOnce we were cleared by the parents, we then efiled the returns which is or custom to do so. Then we received phone calls from the parents saying there was some concernsAt this point we had felt that with dealing with the parents that there was major confusion on their part we indicated to them that they should receive more council from their son as to his wishesNothing was done till Mr *** finally called and said there was a major amount of income missingGiven the track record of Mr*** and his parents with regard to misinformation, untimely information and accusation then and now we are very confident we have made the correct choice. There are individuals that do things for their own benefit with regards to taxesWe at Astrive to help our clients save the most money to the full extent of the law but have not and never will go over and above that law only to find favor with a clientIf the client seems at all going this direction we immediately call them on it and notify them that we will not be representing them in any wayWe get compensated for the work we do, and only get paid after it is doneIf there is a change that is needed after we charge the client accordingly. Review: I am writing to you regarding the tax preparation completed for myself and my former company. The accountant's name who prepared my taxes is [redacted]. His company is A-1 Accounting & Income Tax LLC. located at [redacted]. His phone number is ###-###-####.

[redacted] has been doing my taxes for the past 5 years or so.

In January 2015, my company folded.

In June, I called [redacted] and asked him to do my taxes, both personal and business, as usual. After speaking with him, he requested some information and asked that I send him this information. During the conversation, I also expressed some concerns, which he asked to be put in writing and sent along with the information he requested. I specifically emphasized that time was of the essence. He did not indicate that this would be a problem.

I immediately over-nighted the information. However, they did not receive it for approximately 8-9 days, due to forwarding addresses that they had on file with the post office. Despite the fact that this was not tax time (middle of summer) and I was in a time bind, [redacted] took almost a month to do the taxes. During that time, I repeatedly called, urging their completion. The secretary took my messages but no calls were returned by [redacted]. There was never any communication from [redacted] indicating a problem with the information that was sent to him.

After I picked the taxes up, I discovered that the total yearly income for both the personal and business taxes were incorrect. I was unable to reconcile most of the figures stated in the tax returns with the figures shown on the P&L and Balance Sheet. The biggest contention being that the gross revenue was misreported by approximately $252,700.

I, along with my parents, called several times to discuss the matter, but whether we spoke to Dana (his secretary) or left voice mails, none of the calls were returned. This continued for approximately one month..

When my parents and I finally reached [redacted] (Aug. 26th), he told me that the P&L that was sent was wrong and looked like it had been cut and pasted. However, I did not adjust this; I went to Quick Books and printed exactly what [redacted] told me to. Regardless, if [redacted] felt it was incorrect in any way, he could easily have called me. That never happened. [redacted] then told me that he would no longer represent me. End of conversation.

[redacted] was paid $1899.00 in good faith. I am asking is that he correct the taxes.

[redacted] proved to be very unprofessional in several ways:

1) My calls were never returned.

2) There was never any indication or communication that the information sent was not

correct.

3) The taxes took way too long to receive.

4) His manner when speaking to me and my parents (on Aug. 26) was abrupt, dismissive, and rude.

5) After our conversation on Aug. 26th, he sent an email to us showing the P&L and

Balance Sheet sent to him. According to this email, [redacted] received (from me) the first

page of the Balance Sheet and the second page of the P&L (both run off on

6/30/15). Yet, the missing pages were found in the tax folders that [redacted] prepared

and were handed to us by Dana, indicating that he did in fact receive them. They

clearly show that they were created on 6/30/15 as well, with time stamps for

each report (which cannot be altered) that match. So [redacted] had received all the

pages. Even if he was sent an incomplete set, [redacted] should and would have known

that the reports were incomplete. Furthermore, the Balance Sheet and P & L

indicated page numbers on the bottom, showing there were two pages for each

report. Lastly, his email stated that he would not answer anymore questions but

would refer us to another accountant (yes, after taking my money).

Due to the discrepancy in the reported gross revenue, I could potentially be charged with tax evasion, and this could trigger a tax audit by the IRS. If an audit is triggered, I would have to count on [redacted] to help me out, yet he has clearly indicated that he will not represent me any further. In our last phone call, he refused to address the needed correction because he stated he did not want his company's name associated with this 2014 tax filing (both personal and business), knowing that the problems we brought to his attention would require an amended filing.

This situation needs to be cleared up, as soon as possible.Desired Settlement: 1) Amend the taxes completely and accurately

2) Agree to represent me (and my business) should there be an IRS audit for this and prior work completed by him without additional costs to me.
