Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
As I read the Owners statement I first will address the store owners statementThis is the most fabricated story I have ever read. Some of the things mention are true many are notMy credit card was charge and I have the receipt $$minus the transfer fee is not $It is $Please review my answers to his points
I can into the store on on Feb 7th not Feb 8th t@4:pm
The statement I attempted to unlawfully purchase a gun is a lieNot knowing Indiana gun law just not mean I tried to unlawfully purchase a gunTrue I did not have a Indiana drivers licenseI live in both Indiana and FloridaMy Concealed Weapon or Fireman License was issued by Florida Department of agriculture & Consumer ServicesBoth states reciperate these permitsI thought this is what I needed to complete the purchaseFor the record I made the payment first and then was ask to complete the background checkThe store employee did tell me that I must have a Indiana photo IDAnd he could not transfer the gunI did ask for a refund and the employee did try to credit my cardIt would not go threwThere other customers in the store and I said wait on them I could waitAnd he didHe did call the owner and the owner said he would be in the store Saturday at 12:He would take care of the credit
On Saturday Feb8th I returned to the gun shop to receive my refundThe owner was very rude and he did try to credit my account onceI discuss other items that could be used and the became very upset and ask that I leave his storeI ask if he could issue a check and he said that he did not have his check bookI did leave under his pushing me out of the store with his hand on his pistolI felt that this person could be nuts
Yes I did call and the fishers dispatch sent a fishers police officer to this addressI explained to the Officer what had happen with the gun store ownerOfficer went inside and return and said that the owners story was about the same as myThe store owner said the would send my refund by mail on Feb 10thThis was told to the police officerI never receive my refundI contacted Officer *** and he contacted the store owner and said he would send the refundThat never happenI take a personnal offense that this owner states that I attempted to unlawfully purchase handgunHe states that he did not have my address to send this refundIf I did complete the background check his statement is not true because it would be on the formALso I gave Officer my address on a piece of paper and he took that in to the store ownerI was never abusive to his employee, period.I have no crimminal background offensesIf I did I would have NOT received my cwp.All I want is my refund of $and no futher dealings with this store ownerIt has been almost a month and no refund. The refund needs to be as soon as possible.
*** *** *** *** *** *** ** ***

On March 26th, 2014, we mailed a check in the amount of $to Mr*** ***This amount represents his payment to us minus a $transfer feeWe originally waived the mandatory 20% restocking fee and have reduced the transfer fee another $since his last letter, even though our website and store signs are very clear about both fees
It concerns us greatly that *** *** feels he did nothing wrongWhether inadvertent or not, he attempted to illegally purchase a handgunThis will conclude the matter on our end and we will not

They went above and beyond the call of duty very friendly and professional

My wife and I took their Basic Pistol Course and could not have been more pleased. The instructor took his time and answered all of our questions. My wife was scared to death at first, but [redacted] quickly put her at ease. In the end she even outshot me! Highly recommended.

This letter is a response to the complaint of Mr. [redacted]....

On February 8th, 2014, [redacted] attempted to unlawfully purchase a handgun at our place of business. Indiana and Federal law require that a person be a RESIDENT in the state where they arc purchasing a handgun. [redacted] made his purchase from our online store. When he came to pick up the handgun, pay the balance due, and complete the ID and background check requirements, he presented a FLORIDA drivers license and a FLORIDA RESIDENT Concealed Weapon License as Identification. (Florida issues a non-resident license far people who are NOT Florida residents. We leach an educational program for this license to roughly 1000 people a year, and 1 myself have this non-resident license.)
[redacted] was informed by the shop employee that handguns could only be sold to law abiding citizens that were residents of the state of Indiana. [redacted] insisted he was an Indiana resident, but had no government issued photo identification to substantiate his claim. The items he presented as ID clearly identified him as a resident or the state of Florida.
[redacted] began to argue with the shop employee and pointed to a small section of the ATF form 4473 (required for handgun purchases) that he felt substantiated his point, but he failed to read ALL of the instructions, including the instructions for item 20a which read:
"Know Your Customer:
Before a licensee may sell or deliver a firearm to a non-licensee, the licensee must establish the identity, place of residence, and age of the buyer. The buyer must provide a valid government-issued photo identification to the seller that contains the buyer's name, residence address, and date of birth. The licensee must record the type, identification number, and expiration date (if any)of the identification in question 20.a. A driver's license or an identification card issued by a State in place of a license is acceptable."
Also, the website [redacted] made this purchase from CLEARLY and in BIG BOLD LETTERS states in multiple locations, (including right next to the submit button for the purchase) that the buyer MUST have government issued photo ID with CURRENT residence on it to complete the transfer. (Exhibit 1 )The web agreement also indicates (Exhibit 2) that we may refuse to transfer the firearm if we feel the transfer is inappropriate, and are under no obligation to sell the firearm to the individual.
We also have a very strict policy about returns and restocking. A sign in plain view clearly describes this policy:
"If your background check comes back DENIED or you are refused service for failure to meet ID requirements, a 20% restocking fee will be assessed and a $25 transfer fee may be assessed if the item has to be returned to the wholesaler."
This policy is designed (and common among dealers) to prevent those who know they do not meet the requirements to purchase a handgun from trying to pull a fast one.
[redacted] became irritated and insisted we transfer the firearm to him, but my employee held firm. Rather than charge him the fees above, the employee tried to take the path of least resistance and refund the debit card [redacted] presented for the purchase. For whatever reason it kept coming back as an "unauthorized transaction". The employee called me and I talked him through the process three times but the refund kept coming back as an unauthorized transaction. [redacted] then demanded cash for the refund. Per the Visa/Mastercard Agreement this is not permitted. [redacted] became abusive to the employee. The shop employee told [redacted] 1 (The owner) would be in the shop the next day and would be willing to try the refund transaction again and otherwise resolve the refund. [redacted] became angry and after putting up with his tirade he had to be asked to leave the shop by the employee. He did so under protest.
The following day [redacted] showed up to the shop. I was working the shop with another employee. [redacted] said that he had contacted his attorney and was advised there was no reason not to transfer the firearm to him. I tried to explain to him our position and the law but he continued to argue. I then tried to process his refund. I tried three times and the machine responded each time with a UNAUTHORIZED TRANSACTION response. I attempted to contact customer support to get assistance but they were closed. (It was Sunday and they used to be open 24/7.)
I then asked [redacted] if he would give me some time to get customer service support, and asked if he could call me the next day by noon, and if I couldn't get the card run per the Visa/MC agreement I would issue him a check. He responded in the affirmative. Then he started again on the transfer issue. I told him I would not discuss it further and the matter was not up for debate. We would not transfer a handgun to him. He then asked WI would do so if he came back with an Indiana ID card. I said yes. He said okay and turned toward the door. It was clear to us he wanted the gun, not the refund.
But as he got to the door [redacted] turned around again and walked up to the counter and began to berate me and my business for "not knowing the law". I told him I could not transfer the handgun to him and I would be in contact the following day. [redacted] became irate and abusive and continued his tirade.  i softly stated:  "Now I'm going to have to ask you to leave. "  [redacted] refused to do so after several requests.  He was then told he was trespassing and would be removed from the shop and the police summoned. He then (afier again refusing to leave) yelled: "I'LL TELL YOU WHAT I'M GOING TO DO!", squared off to me and jammed both of his hands into his coat pockets. (Not the smartest thing to do in a gun shop.) He was then escorted to the door where he stopped short of the exit, turned around again and said "There, I'm out." Rut he wasn't yet out the door. After he finally stepped out, we closed the door, locked it, and called 911. Officer [redacted] of Fishers Police Department responded and took our trespassing complaint. [redacted] was warned by Officer [redacted] that if he returned to the store he would be arrested for trespassing. We agreed to mail him a check and trespass letter via certified mail. Unfortunately, we never not [redacted] address during his tirade. He had to be removed from the store for employee safety. (The first person in our 10 year history)
In spite of several warnings on our store website RIGHT NEXT TO THE SUBMIT PURCHASE BUTTON, (exhibit 1) warning that a valid government photo ID with CURRENT address was required to purchase a handgun, [redacted] attempted an unlawful handgun purchase. Our posted store policy (on our website AND on the wall of the store) clearly state that if an individual is DENIED a purchase for invalid ID or background check results, a 20% restocking fee may be assessed, and a $35 transfer fee would be charged if the item had to be returned to the wholesaler. This policy generally deters a person who knows they don't meet the requirements of a purchase from attempting to do so, potentially throwing money away. [redacted] HAD to know of the ID requirement as it is posted right next to the SUBMIT purchase button, and in our store information on the site. As this is not his first firearm purchase, he should also be aware of the law.
I wanted to forgo all of the fees and just take the path of least resistance and send him a check for the full amount, providing excellent customer service in spite of [redacted] conduct. Unfortunately we had no address for him and a Revdex.com complaint appeared in my mailbox indicating [redacted] did not want to quickly resolve the incident. We will be glad to mail [redacted] a check for $128.56 (His balance paid at the shop minus a $35 transfer fee.) if he agrees to this resolution. If not, we will also assess a 20% restocking fee as per our policy
We await his and your response.
Sincerely
[redacted]
