per contract dated 04/04/17 stated job would take 180 days. work was not completed within scope of contract. monies were not returned.
contract signed on 04/04/17, invoice #XXXXX for complete demo and rehab of property at 2948 Louis st, ftw. initial deposit $3076.00 was given for insurance, site plan, foundation inspection and plan. 04/09 additional funds $17605.74 were given as 25% downpayment of total contract. per contract demo was to be $2500 which included removal of debris and demo of walls, ceilings plus haul away debris. yard work $2500 which included tree trimming and yard clean up. no permits were ever obtained. this was the extent of the work partially completed during the 180 days of the contract. per emails and text msgs from June to Oct, contractor was made aware that he was not performing according to contract. after 180 days contractor was fired from job. code compliance department contacted us regarding property non-compliance issues. as the result of non-compliance issues, property had to be razed due to negligence of contractor's lack of performance according to his contract. while trying to work with contractor and get our refund, he no showed meetings that had been agreed upon at public businesses. he contacted us by email stating he would not show after appointed meeting time. thru multiple emails he agreed he owed us a refund. we responded to his emails and disputed his accounting of funds dispersed. last correspondence was 02/22/18 where we issued final demand of fund returned. he never contacted us again.

Desired Outcome

according to builders contract we are seeking a refund of $12,000.00 which is less than the original demand from contractor, contractor conceded that he should be refunding $7,112. but we disagreed with this accounting of other expenditures. We would settle for $12,000 out of the $20,681.74 of initial deposits paid. Using his contract and statements of work completed. After dissolution of contract additional funds were spent to raze home and return to compliance of a vacant lot. These funds requested do not included the $8,800.00 that we had to expend to return property to compliance per the City of Ft. Worth.

Ms. originally came to me as an individual investor who was seeking help on a project renovation. When we look at the project, we agreed that it would be large in scope. The property was old, fire damaged, and filled with debris. I explained that we would be working from an estimate since there are items that could not be seen until the debris was removed and the initial demolition was completed. We agreed to proceeded with a verbal agreement. Ms. later introduced 2 business partners, *** and ***
Our agreement states that change orders may add additional time to the completion date. We had several change orders that were agreed upon via text (see attached). There was additional demolition after the drywall was removed which revealed 1-inch interior walls that could not be seen. There was foundation repair that needed to be done. There was an order from the city for tree trimming, and removal of an old chimney. There was the discovery of lead paint, which needed to be abated. I believe there were a few more.
The bottom line is that they realized that they had made a bad investment and were looking for a way to mitigate their losses. Suzy sent an email on the morning of the initial completion date terminating our agreement. After consulting with an attorney, I responded, and I explained that this constituted a breach and that I would agree to comply and refund her money minus reasonable and just compensation for my services to which I am entitled. I sent a list of cost and didn't charge for any on my time and consultations. She replied with an arbitrary number that was not substantiated.
None of the three were reasonable and wanted to discuss the matter. *** even threatened me via text message.
I mentioned to them that any false post or reviews would result in a prompt and swift defamation suit for any and all false and defamatory statements.
I declined her meeting request because I had explained that I thought it would not be productive since there was 2-3 of them and 1 of me. I did agree to have an attorney represent me when we spoke last on the phone.
