Dear [redacted] ,Following is the response to Complaint ID [redacted] filed by [redacted] regarding the driving lessons provided to his mother in law, henceforth referred to as “student.” According to [redacted] ’s complaint to the Revdex.com, the student went to the DMV three times to take the road test and failed all three times [redacted] states the “$in additional training and obtaining the certificate was not necessary.” However, per Virginia DMV regulations, if an individual fails the road test three times, then they “must take the behind-the-wheel component of driver education.” Please refer to the following links for further information: [redacted] [redacted] also states in his complaint that, on November 14th, MrAli accompanied the student in one of the AA Driving Academy’s cars to the road test, and to “assist in working with the DMV staff as part of her third evaluation.” If Ali accompanied the student to the DMV on November 14th, and the student failed the road test “this third time,” then it is apparent the road test was not, in fact, cancelled by the instructor, and this road test did, in fact, take place on November 14th.Also, according to [redacted] ’s complaint, the third time did not count as failure, since, according to [redacted] , the DMV staff informed the student the lesson had been “merely canceled by the instructor.” It is unclear who [redacted] is referring to when he speaks about the “instructor.” The student’s instructor was MrAli who has no authority to cancel road tests that occur under the supervision of a DMV evaluator and are regulated by the DMV, not AA Driving Academy.Additionally, AA Driving Academy’s Operations Manager and [redacted] corresponded via email on December 16thIn this correspondence, [redacted] was asked (question#4) “Who told MrAli that [redacted] failed the road test times and would thus need to take a remedial course?”, to which [redacted] ’s response was “The DMV Evaluator.” [redacted] ’s email responses and his complaint to the Revdex.com are contradictoryWhen [redacted] was asked (question #5) if someone from the DMV told the student she had failed the road test a third time, he responded “Yes, I was right there when he was talking to the evaluator.” If [redacted] was present and heard the entire conversation MrAli had with the DMV evaluator regarding the student’s failure, then [redacted] cannot state that “the third test did not count because it was canceled by the instructor.” On atleast two different emails and the complaint submitted to the Revdex.com, [redacted] stated himself that [redacted] failed the road test three (3) times, fully acknowledging this factWhen appearing to the DMV for the fourth (4th ) road test, the DMV attendant did not require the re- examination certification, even though the DMV regulations clearly state this being needed after failing the road test three (3) timesIn addition, the DMV examiner who failed [redacted] the third (3rd) time stated this to her, and the instructor MrAli (being well aware of rules as a DMV licensed instructor) verified this [redacted] then requested this service via our online registration systemThis service was provided in full with no shortage of time or complaints [redacted] is trying to take advantage of the fact that there was a glitch/error/oversight in either the DMV system or by the customer service representative when appearing for the fourth (4th) road testEven though service was requested and provided, after DMV regulations clearly state the requirement of a re-examination Significantly, the Student did NOT fail the driving course three times.  Either through incompetence in failing to properly understand the situation through their agent / instructor on site during the third test attempt, the business inappropriately charged for additional lessons and a certificate which were not necessary.  The DMV management assumed were unnecessary since the Student had not failed the course three times.

Review: Background: The complaint concerns my son's "behind the wheel" driving lessons. He is 17 years old and is naturally very timid in driving a car. He is also shy by nature.

The issue: We contacted AA Driving Academy to provide the required training for my son. I specifically told them that he would need a few private lessons before stating the required 7 hours driving and 7 hours observation sessions. The driver, a gentleman called "[redacted]" or something like that (he did not have a business card and his accent was not easily understood to me) came to our house on July 3 at around 11 am and I asked my son to go with him for the lesson, which I though would be private as agreed. My son introduced himself and once **. [redacted] noticed the shyness of my son:

**. [redacted], "are you scared"?

My son said " a little".

**. [redacted]: " if you are sacred to drive in this country, you shoudl 'commit suicide'! You should try to drive in my country [redacted] to see what t means"

I didn't say anything although I was concerned by **. [redacted]'s behavior and approach. They left on the driving lesson and about 45 minutes later I received a text message from my son, freaking out. he said that **. [redacted] is calling him names in front of other students (apparently this was not a private lesson as I had thought and agreed with the company). Specifically he kept calling him a " [redacted] and yelling at him in front of others.

When they came home, **. [redacted] told me " You should kick your son's [redacted] and make him run two hours a day. He is a [redacted] and needs to get strong!". I asked **. [redacted] to leave and immediately called the company to report this and tell them we don't wish to continue with them.

Since July 3, my son has locked himslef up in his room and is deeply depressed. He is emotionally disturbed and harrassed by the bully of **. [redacted]. We will have to seek treatment for my so, and I honestly don't know how to go about it at this stage.Desired Settlement: We would like a refund for the fees we paid for the one session my son attended. We would also need to have formal, written apology. I am also exploring the option of a law suit for harrassment, but I don't know if this would be the way forward on this.

Response:

In response to the claimed complaint, we have conducted our own research and communicated with all parties involved. After completing our due diligence, we have determined the complaint to be full of many grammatical mistakes, inaccurate statements and falsely exaggerated alleged terms.

There clearly was a discrepancy in communication & perceived understanding on many fronts, between the instructor (**. [redacted]) and the student ([redacted]). In verbal and written & signed statements, the instructor acknowledged making jokes with [redacted] and the two (2) other female students in the car during this one lesson/session. This is common practice for **. [redacted] and all of our instructors, in order to help establish re-pore with the teenagers, loosen them up and allow them to relax or not be nervous & uneasy, which according to **. [redacted], was very evident with the student, [redacted]. Due to this, **. [redacted] made an extra effort to verbally joke around with [redacted] and the two other students, so that collectively they would feel relaxed.
