Good afternoon, This is in response to the rejection of our response to the complaint from *** ***.*** has refused to accept any responsibility for walking on the tiles before the adhesive had dried and continues to allude to us 'taking advantage' of her and not speaking to her directly about this by saying we just walked off the jobThis is so far from the truth and we have not been able to come to a resolution with her in the past months.Her daughter left a message on our phone which I still have on January 5, at 12:PM threatening to sue us if we did not take care of pulling up the kitchen floor and paying so her mother could get another one.At this point in time, we do not know of anything that will satisfy Ms*** that is agreeable to us and that will resolve this issue. forwarding you that complaint and our response to itWhile the complaints are very similar there are slightly different issues raised in this one.Once *** and her daughter returned and found that the tiles that were being used in the bathroom were for the kitchen, and by her own admission only four rows were on, it would have been very simple for Scott to remove them at that time, but they told him not toThey assured him they liked themThey knew the first day he started setting tiles in the bathroom that he had used the kitchen tilesThis is addressed in our AG response and she told him she liked it and to leave it
To be clear, Scott's son Jesse did not finish putting in the tile, he only brought tile into his dad and then he was grouting once the tile surround was completed*** took over that part of the project (grouting) and it is addressed in the AG response so I will not repeat it here.When *** mentions that her daughter *** had to take the boxes back to *** *** the next day and exchange them, this is where the dye lots got mixed upIn her AG complaint she says in one place that she did not know about dye lots and we did not eitherOnce they exchanged them and got tiles from a different pallet and even another store to get the amount needed, they then had a couple of different dye differencesThis is also addressed in detail in the AG paperworkIt is beyond our comprehension as to why she waited until the last tiles had been put down and we were cleaning up the tools and items from the kitchen to point this out to us and then want them all pulled and a new floor laidHowever, she mav have changed her mind on the color and pattern, as the new ones she purchased and wanted us to install are completely different from the ones there now.The day *** came home from exercise class to find us packing up 'everything' (cleaning up) from the kitchen and also around where we were cutting tiles, is simply due to the fact that we thought we were doneWe needed to let it dry and come back in a day or two and grout itIt was at that point she expressed that it ALL needed to be pulled and redoneWhen we began to realize the depth of her anger, manipulation, and resistance to paying us any payments, we did not do any more work there, such as putting a clear seal on the tiled backsplash that is huge which she requested(See AG response.) 2 We left out big tile saw there since we were now not sure how we were going to resolve this issueOur saw is/was still there and we just got a registered letter a few weeks back to get it out or she was giving it away for scrapeIt was very confusing as she said in the same letter we were not allowed on the propertyAt this point we have written off the tile saw as the confrontation to get it was simply not worth it to either one of us
*** says in her complaint background that the problem occurred on 03/27/and that she talked to us about this on 4/22/and 5/1/Scott worked there on that date in April but I checked our phone records and also our work book and there was no phone calls made and neither of us were there on May The kitchen floor was not completed until May 8th as she also had many other projects she had us do thereBoth Scott and I have been to her house several times trying to find a resolution since May, and I have talked to her many times on the phoneI went through some of my phone records a few days ago and easily found calls in May, June and July, August and SeptemberAll but two of the calls I made to herThe night she received our response to the AG complaint she left a very nasty message on our voice mail which I have savedIf the voice mail recording is needed I will get you a copy and also copies of our phone records showing the many times I spoke to herI can also go through my day planner and figure out the many times we have been there if that is needed
The table and chairs in her living room are very small and her sons or grandson could easily have put them back in the kitchen for herShe declined our offers to put them in the kitchen for herThey are so light I could move them without help, so this should not be a problem for one of her sons or grandson who help out and visit on a regular basis.As for us fixing the problem, we feel it is unreasonable of her to ask that of usHad they stayed off of the tiles and not walked on them initially, none of them would have needed to be pulled up and replacedAnd initially, if she had not purchased the wrong dye lots, there would have been no variations to begin withUnfortunately, she created a problem and wants us to pay for all of itThat is after we reduced her bill on all of the other work greatly, as we felt she was trying to get out of paying us anythingAll of this is outlined in the attached AG complaintThis lady got a lot of free labor on her kitchen and bathroom, since there was much more work done than just a kitchen floor, small bathroom floor and the tiled surroundThe many projects done there are in the AG reportIt has already cost us thousands of dollars in wasted material and labor she was not billed for, in a huge reduction on completed work we had done to attempt to get her to pay us something, or in time spend dealing with this
While we initially wanted to help her, she has been so argumentative and nasty to both of us, we have no desire to go there againWe feel she can easily have the floor groutedIf so the complete install was free except for grouting, or she can choose to have it pulled and re doneSince we have not charged her any money on any part of the floor, and since she created the problem to begin with, it should be reasonable for her to pay to have it pulled and re done if that is her choiceShe has told me several times she never intended to pay us a dime for any work we did on the kitchen floor, so we are not going to go back and do more free labor for herShe looked me in the eye and told me had agreeing for us to pull the floor and then pay to do the installation, but then had changed her mind and was going to wait until we were done and not pay us one dime

Complaint: [redacted]I am rejecting this response because: AA2 Repair and Maintenance is not telling the truth.  Marie [redacted] -K[redacted] is not telling the truth.  I don't get onto the internet to often, Just opened this on 12/27/2015/  :ast I heard from you, she had'nt responded after you had contacted her 3 times, so I  thought I would'nt hear from you anymore.  This is my response toMarie [redacted] K[redacted] AA2  Repair and Maintenance LLC.
     I did file a complaint against them to L&I and the Attorney General.  She is again like in her reply to AG turning things around to suit them.  
     Our complaint #[redacted]  so you can contact AG They have pictures and other things to you that I mailed to them as I do not know how to do attachments over the internet.
     In her repley to you about the AG closing thats just because they don't do anything against them They just file the complaint.  I I waited awhile before filing the complaint because I kept hoping we could get this settled.  
 
     This is not true about us realizing right away tiles were wrong- colors were similar.Sott asked [redacted] what tile to use in the bathroom - she told him the one with the least amount , which was the 4 boxes that he figured out he would need for the bathroom and 9 boxes for the kitchen.   We didn't  know until Scott started to do the kitchen floor that he had used the wrong tiles and than at that point he would have had to tear out the whote tub surround. When she says that 4 rows  of tileon that was at one end of tub surround.  We left and  told Scott about the mosic in a diamond pattern and that we wanted shelves on both ends of the tub surround. When  we returned he had went to the store and bought a set of shelves (white  spackled in gold) .  Which would not match the tille.  He had also forget to put mosiac in (he said he forgot).   At that point he only had to remove 1 row. My daughter [redacted] again showed him where the mosiac tile needed to be put in a diamond pattern. My daughter [redacted] then  showed him how to make shelves from the existing tile. [redacted] told him all he needed to make custom made shelves was to cut one tile in half diagonally   put both sides together with pattern on the outiside, than glue and clamp together.  Then wait till gue  dry, then you can put shelves up. Scott  and I did not look convinced of this.  Scott made 4 shelves this way. The next day [redacted] showed him how thay rested on the top tile  that was already dry. Scott and I were amazed at how this looked. so that was why he tore 1 row of tile on one end out.  Scott did not start on the kitchen floor until about a week later.  Tub surround was all finished and grouted except for 3 or 4 pieces which he had Jessie cut and put in.  Scott also worked for Property Management doing jobs.  So he would work some days and be gone some days. Go out and bid on jobs.  I knew he would be doing this.   I left my house to do things with my dauer [redacted] (who was visiting fom Minnesota) or I went to exercise class 4 times a week.  I was good friends with Scott and Marie.  I am so sorry it had to come to this.  I am still not mad at them, I'm upset that they taken advantange of me.
 
     The grouting process on tub surround- I had bought grout in powered form one for the bathroom 10lb bag and  a 25 lb for the kitchen. Scott did not use this he went and bought a already pan of grout not in the color we bought.  Scott and his son Jesse(both weighing in at about 300lbs each were standing in my tub one at each end-Scott kept saying to Jesse "hurry up this is drying out.  Scott  left Jesse  to finish wiping the excess grout off the tiles.  When [redacted] went into the bathroom to check on Jesse made the remark to her that he didn'tknow what he was doing.  So thats the only reason she standing in the tub trying to fix some areas that didn't get enough or no grout in them- such as under the sheilves which Scott could not behind over enough of squat to see under shelves or maybe he just didn't want to.
 
     Scott left the bathroom to start on the kitchen floor.  He installed the hardy backer  to the kitchen floor.  Then he went to get the kitchen tile to be installed.  Scott then came back into the house and told [redacted] and I that there was only 4 boxes, this was when we knew that he had mixed up the up theboxes of tile and had installed the wrong tile in the bathroom  so that is why the bullnose bought for the bathroom does not match the tile.  So [redacted] took the rest of the original tile meant for the kitchen back  and exchange it for more of the  oringinal tile for the bathroom .  She went to the same store I had bought them from and I have the receits that show the date and store.By that time tile could have been off a different pallet  then the one we first bought.This is why by the time this was figured out the tile was aready set.  Scott  also never allowed for extra tile for putting in diamond pattern  He told us how many boxes to buy and that's what we bought.  I still have the card on which [redacted] wrote down the amount of materials that he would need for each room.   Scott and Jesse pick up the order  on willcall and stacked it on the deck. If I was a contractor and had 2 different colors of tile and 2 different colors of grout, I would have written it down.Scott at no time during the job that lasted from March to May 2015 ever said anything about dye lots  I at 80 years of age never had  bougth tile so I did not know about dye lots. As general contractors that said they had done hunders of tile jobs some in million dollar homes not know about dye lots.    They did not find out about dye lots until Scott pulled up the last 22 tile. and went to 2 or 3 different [redacted] with 1 tile and went through boxes to match the one tile, which was one or the darker tile's so when he installed them you can really see  the difference.  Marie said why did I wait until last tiles were laid before I said anything.
 Lets go back a little bit.  First tile I asked him to pull 1 tile because I was hitting my foot on it.  When I got back [redacted] he had pulled 16 to 18 tiles up and cut out the backer board under the tile.  Because he (Scott ) had used the wrong adhesive on tile and he could not get it off.  So this is another place where dye lots got off.  He put tile down and there was some color variation.  He (Scott)  said he used a block to put tile in, that is not true.  My daughter [redacted]  told him  he should used a level.  Never once did I see him use a level.  He Scott finished laying the 16 to 18 tiles then he grouted it.  The next day Scott and Jesse moved the refrigerator back to its spot and unpluged my store and moved it across the tile scraping  it, but it never harmed the tile.  The put the microwave back in .  Never once did they have  my appliances out side.   [redacted]'s husband arrived on the 6 th of April and  Scott had not installed the tile on this half . Scott and Jesse  continued layinging the other side of kitchen floor on April 9th.  Scott than grouted the tile on the 10th of April I know this because my daughter and husband left that morning. Next day I again found tile raised and 1 he did not get enough adhesive underd or at least that is what he told me.  At that time he told me that he didnn't want to tile right now.  Then he installed the wall bass cove.  He did not know how to go around outside  corners.  Did not get enough adhesive  on in some places so wall base cove did not stick to wall.  So instead he (Scott)  put in (2) 10foot countertops that had to be cut downand (1) 4ft countertop that had to be cut down to a 3ft piece. Then he started to install countertop and realized he needed to cut a hole in old counter in orde rto clamp and glue both corner pieces together.  So then he had to tear off wall base cove mavye 6 to 8' and he threw it away.  I had bought a 120' roll of wall base coverbecause I did not want it to be put in in 4' sections and it was a custom order for color. so it would blend with the tile better.  So then after this he went to do the bathroom floor had to take up some of the tile twice.  (Then I had to get another contractor to come out and pull the toilet, because every once in awhile when I walked into the bathroom) A couple of weeks after they walked off the job.  The contractor when pulling toilet found out that Scott after installing backer board and tile over existing floor had not put anything to hole to compensate so urine was going under backer board.  New contractor had to put in extension flange and new wax ring.  When Scott pulled the toilet 3 times he had used the same  seal.
 
     Scott jumbed around from one job to another.  The first reason they gave  me for one of the tile raised upwas that my floor was uneven and I said oh ok.  Then my son  told me mom if he put the backer board downe even than the floor would be even.  So because of 1 tile raised and another that did'nt  get enough adhesive. He pulled 16 to 18 tile.  The secound time I asked him to pull 2 tiles , I had come [redacted]  he had pulled up 22 tiles and was gone.  I asked Jesse where he had went and he said to match a tile.  So when he laid the 22 tiles back down I was not home.  I did ask Scott why he tore up 22 tile and he said it was squeaking.  I did not hear or feel and sqeaking.  After he laid the 22 tiles down and the color varation was really noticable.  I told him it was unacceptable.  I ask Scott would you like this tile in your house and he said no.  That's when Marie and I not Scott [redacted] and talked to [redacted] at [redacted] on [redacted] and [redacted] Blvd. , he is either the manager or assistant manager.  We were telling him how the coor variation was so far apart.  That is when he told us about dyd lots and took Marie over to show her dye lots on boxes .  We then came back to my house and she told and showed Scott where , but by that time all the boxes I had bought were empty and gone.  So we had different  for the extra boxes we had went back got.  Then the 16 to 18 tile he had replaced the first time. j Then the last ones (22) right in the middle of room wrong dye lots.  Marie tries to pretent she was at my house all the time .  She would pop in once in awhile and tease saying she was just checking upon Scott and me, because we kidded around all the time.  I would say he was my boyfriend and when I went to Marie's house for church he would park my car and when I got out of the car he would kiss me on my cheek and when iI left he would do the same thing.  We were friends.   I'm still not mad at them just upset that they would say Scott felt uncomortable about me.
 
     I did call their jhouse after the reply she did to AG saying my inuendos made Scott uncomfortable.  We have joked around but nothing nasty for years and I have witness that were at her house weekly for church  that  knew that we were just joking.  Marie would say sometimes to me that she would send him down to me.  The reason I called after that was to tell her what Scott said to me.  We were walking down some isle at [redacted] picking up the 2 10ft countertop and I made the remark about how was I going to pay for this and Scott said to me we could always take it out in trade.  There was a women probably about Scotts age walking past us and she was cracked up laughing.  I said oh were not goingto tell Marieas she would have a fit.  I would have taken what he had said to me to my gave without saying anything.  Then in her reply to AG was I wanted Scott.  I told her if anyone could get him for sexual harresment for what he said to me. So let her show you a copy oif what I said thats fine.
     Here I am going on 81 I have osteoporsis so bad I have shunk 6"My left ribs are shrinking behind my left hip bones.  I havehad both hips replaced and revised 2 times.  Ihave a big hump on my back  from osteoporis. Several fractures in my vertabrues , a cracked rib (right side) Scott is probably in his 50's weighs probably over 300lbs around 6 foot tall-  I am 4'10" weigh between 130& 135 and she's worried about me.  I never knew that she was so insecure  because she is older than Scott.
     [redacted] (manager) of [redacted] offered to give me a $100 dollar credit for the problem.  H didn't have to as it was Scotts fault for not knowing about dye lots as he (Scott) and Marie as General Contractors should have know about dye lots.  I used that $100.00 credit for more backer board (still sitting on my back deck).
 
     I never asked them to install new floor as Scott did not want to.  Then I found out that they weren't charging me for tearing out the floor but charging me for the installation , by that time I started asking around about different things and found out what they were doing was illegal and when I told Marie that her reply was well were not a big box store.
 
     About the bid tile saw, It's an old thing they said weighs about 500lbs.  It has set in my backyard from May.  So on November 9 2015 I sent  registered letter requesting it to be moved out of my yard.  I did say to Scott and Marie that they could not some in my yard as she had said Scott was uncomtortable around me.  They could get someone else all they would have to do was to call and set up a time.
 
  Most of the time Marie would come over to the house to talk over business not over the phone.  Lots of time we talked on phone we were maybe going to  chat about pllants or just visiting over the phone . She would call and complain to me something someone in Scotts family how he got cheated out of his  stuff when he died.  The daughter and step daughter of Scott's exwife or her neighbors .  We were friends.  I believe this is all coming from Marie not Scott.
 
     When Scott put in last 22 tiles and he saw how bad they looked.  That's when Marie told me that Scott was color blind.  I told Scott and Marie both that maybe we could go to [redacted] and buy about 5 boxes and lay out the pattern out and try and blend the floor in, then I thought about it overnight and told Scott no it needs to be all tore up and redone and Scott said thats what heold Maried.  I had asked him how he would like this in their house and he said no.  But Marie in one of her replys id just grout it and basically live with it.
 
     When I paid her $2500 she looked at me kind of funny and I said well I've heard if you pay everything in full they couldalk off the job and leave job unfinished.  She said [redacted] Do you think we would do that to you.  Everything was in at that time but still had 4 different tiles in. She was going to charge me for 183 hours at first until I called her on the mistakes that Scott had made.  So she reduced the bill.  You can't tell me  it should take 4 days to put in mosiac under kichen cabinets that were exactly 12x12 sheets.  Then after I compained to AG, they just filled in hrs for the job 1 1/2 hrs to installed outlet in kitchen that I have never founf.Did some electrical work fixed my mercury light over my deck and did plumbing in bathroom and under kitchen sink .  Installed new sink and new faucet.  Now I found out he wasn't licensed of bonded for this work.
 
     Marie gave me contract saying they would tear out floor haul away debrie and pay me for "like" material.  I didn't like the word like.  So I wrote one that said excatly the same only instead of like material they would pay me for what I bought.  I gave her one copy and a week or so later she came down and said she couldn't find that one and wanted another copy so I gave one to her.  I never asked her for the money to pay for my new tile, just the tile adhesive, screws, wall base cove ,pull up all of kitchen floor and haul away material to the dump, and $100.00 for toilet repairs.Materials totaled 515. and some odd cents.  They just did not want to do it because would have cost for time to pull tile and pay for material wast. 
 
     She says in her reply they have been to my house several times and calling on the phone to resolve this that is not true.  If she's got phone records prove it  We've had a few calls and when you say hello no one anwers.  I do not have caller ID I also would like to see these onees for after May.  It night have been Sept whefn I made the call about what Scott said to me.  they are the ones who have been dragging this one.  I would also like to see this day pllanner to see how many times they have been to my house.  I haven't seen them since they walked off the job after getting paid in full.  About the kitchen table and charis in front room we left them there because I thought they were going to redo floor no since in putting them back in kitchen if floor has to de redone.  It got put back latter part of Nov or first of Dec. Floor tile has still not been pull and replaced .  
 
     I never said several times about not paying for the floor.  I said one time about not paying them for tearing up floor and redoing, because they were going to charge me for tearing it up and redoing and told her what I hadound out about what they were doing was illegal and she said what were you going to do not pay us and I remarked in a joking tone next fall or not at all.  I have never had anyone working for me that I did not pay them for the job they had e.  I just said this because I thought what they were doing to me was wrong.  Never ever said I would not pay a dime.
 
     She says I am a nasty and argumenative if htat means I am standing up for myself and not taking everything that they tell to be right ,  then yeah I guess I am.  About my new tile, they are not going to put it inanyway so I don't know why she keeps worrying about it.  Yes I did decide to get a different  tile because by now Im tired of looking at the 4 different variations of color in my kitchen.  Like in my kitchen for about 2 or 3 rows diagionally  then another color variation for about 5 or 6 rows not the whole kitchen.  Then maybe another 2 rows then  have another color variation... so yes I am sick of this color so I bought a slate pattern I am not charging for the new tile- just the old tile that they wasted.
 
     If they had honored the contract we would not be where we are today.  She was my minister and friend.  She also made the commet that because  I made Scott uncomftable he did not want to be in my house- but they do not want to have to pay someone else to pull up the floor.  Well I donn't  think they can have it both ways-I never thought that they would do this to me-they justdon't wantto do  because they know it will cost them to pull uhe floor and pay for materials  that was there fault in the first place for mixing up the original tile .

Complaint: [redacted]I am rejecting this response because: We are not going to get anywhere with this complaint. I would just like for them to pay me for the material on the floor  which I believe was $515. approximately, plus the $100. for the toilet. My daughter did not threaten. She said we woild like to get this resolved before we took this to Superior Court. She neverr talked to anyone just left a message. They have turned around every thing either one of us has said. I know what Scott said to me at Home Depot & he knows he said it. they have not tried to get a hold of me to resolve this, thats another part where she is not telling the truth. They walked off the job in March & if I heard from them twice after that I would be lucky. If I could just get the money I would take my complaint off the Revdex.com records. I know they will not send anyone down to tear up floor, I will have to eat that expense. All of these letters going back & forth are not solving this matter. It only adds to the stress in my life which at 81 I don't need. So if they are not going to resolve this, I don't want any more letters. I have received  some phone calls & no one would answer, so if that is what she has on her phone records, Let me know as I wrote some of the dates down.Sincerely,[redacted]
