It is not uncommon for people to have very inflated ideas about the value of the things they ask us to sell This is one of those cases [redacted] brought many boxes of garage sale quality items that she said she got in a storage auctionThere was no list or inventory of the items she dropped offThere were so many boxes they filled up one side of my garage She asked us to sell the items for her in our online auctionIt was impossible for my wife, Denise, who accepted the boxes to open every box when [redacted] was here, but she did open enough to see that the most of the items had little or no value Rather than open every box and inspect all of the items at that time, Denise told [redacted] that there many things of no valueDenise told [redacted] that selling so many of the same thing (owls) was not a good idea since the quantity would keep the bids very lowConsequently, Denise offered to go through the boxes and put the better things on line and then store the low value items until our live spring weekly auction season and then try to sell them at that timeThis was in fact a generous offer since Denise offered to transport and store the items at no cost to [redacted] It was also considerate since we charge a 35% with a $minimum per lot during our online auctions but only 25% with no minimum during our live consignment auctions [redacted] was pleased with Denise’s offer and replied that Denise could do anything she wanted with the items since [redacted] just wanted to get rid of them Denise and I then went through [redacted] ’s boxes and sorted the itemsWe threw away some items that that were chipped, broken or otherwise had detrimental value(Would hurt the value of other things in the lot.) I am rejecting this response because:
I have proof via text messages from both tony and denise to back up my complaint. Cleary stateing I never gave them permission to transport/store my items in their container. Im assuming that is why tony did not charge me to retrieve my items. Also when my husband and I went to pick up the items/totes they had stored, tony had requested I bring my own boxes to put my items in. So I did, I transfered about 5 totes into boxes I had brought. Then tony stated we could just bring the remaining totes back at a  later date. About 4 days later my husband had returned the totes. (Which was 13 totes, since I emptied 5 into boxes when I was there)

It is not uncommon for people to have very inflated ideas about the value of the things they ask us to sell.  This is one of those cases. [redacted] brought many boxes of garage sale quality items that she said she got in a storage auction. There was no list or inventory of the items she dropped...

off. There were so many boxes they filled up one side of my garage.  She asked us to sell the items for her in our online auction. It was impossible for my wife, Denise, who accepted the boxes to open every box when [redacted] was here, but she did open enough to see that the most of the items had little or no value.  Rather than open every box and inspect all of the items at that time, Denise told [redacted] that there many things of no value. Denise told [redacted] that selling so many of the same thing (owls) was not a good idea since the quantity would keep the bids very low. Consequently, Denise offered to go through the boxes and put the better things on line and then store the low value items until our live spring weekly auction season and then try to sell them at that time. This was in fact a generous offer since Denise offered to transport and store the items at no cost to [redacted].  It was also considerate since we charge a 35% with a $3.00 minimum per lot during our online auctions but only 25% with no minimum during our live consignment auctions. [redacted] was pleased with Denise’s offer and replied that Denise could do anything she wanted with the items since [redacted] just wanted to get rid of them.   Denise and I then went through [redacted]’s boxes and sorted the items. We threw away some items that that were chipped, broken or otherwise had detrimental value. (Would hurt the value of other things in the lot.)  We also put a couple boxes of valueless things on the curb for free. After several days, we wound up throwing most of that away too since no one wanted most of the items even for free. We also found some things to put online. We put the rest in about 18 of our totes and I then took them to our storage container to store for [redacted]. Then after we sold some of her items at our online auction [redacted] contacted us and asked for all of her stored items back. I then went to my container and picked them up for her. (I thought that I should charge for this extra service since she changed her mind and made extra work for me, but decided not to charge her for this.) I think I got all of her totes, but I am not sure because many other totes before and after that time were also placed in the storage container.  I then met [redacted] and her husband at my home and helped him load the totes into his vehicle. I also loaned him my totes which I am not even sure he returned. In law there is the burden of proof.  That means that the person making the claim has to come forward with the evidence to prove the claim without speculation. [redacted] has not done that. How could anyone know what happened to her trains?  I have no way of knowing if she ever gave us the missing trains in the first place. She wrote that she was told that the trains were taken to the storage container. What was said was that her items were taken to the container. Not only do I not know whether she ever left the missing trains with us in the first place, I also have no idea whether they were in one of the 18 totes that she and her husband picked up from me after I got them out of my container. They had lids on them with [redacted]’s seller number and no one opened them up when she and her husband picked them up from me. For all I know, she never gave them to us in the first place or she got them back in the 18 totes. I also told [redacted] that it’s possible that they may still be buried in my container which at this time has about 400 totes in it. I certainly have offered to keep an eye out for any totes that have her items in them and return them to her this spring and summer as I sell the items in the container. If I lost [redacted]’s trains, I would pay for them, but there is no way of knowing what happened to her trains.
