In response to the complaint filed by *** *** *** ***, ID *** my client responds as follows:
1) The lot was graded properly in accordance with the zoning requirements of the Town of ***. The town’s zoning officer signed off when the
Certificate of Occupancy was issued. In fact the *** hired their own building inspector to examine the property and he did not have any problems with the way the lot was graded
2) The engineered plans provided for a curtain drain for the septic system which was installed properly
3) There was no requirement for a curtain drain in front of the house according to the engineered plans and the Town Zoning Officer
4) In the event *** *** *** *** are requesting a curtain drain in the front of the house, my client would be happy to install one at the cost of $3,not anywhere near their estimate of $15,to $20, *** *** still maintains no drain is needed

I am rejecting this response because: Just the other day from the town of [redacted] building official came out to my house looked at our property and said that we had a ligidament complaint he said he was never notified about this matter but their is definitely a grading problem . [redacted] said he was going to notify [redacted] about this matter I am waiting to hear  from him I am giving him the benefit of doubt and assume he is a man of his word.his number is [redacted].if this matter is not resolved I have no choice but to take [redacted] To Surperior court I tried to settle this matter without this but [redacted] feels he is not wrong and I feel he is.I have sent [redacted] a certified letter and he refused to even read the letter . I have the letter that came back .he would not even meet us half way .I ALS sent a letter to the first selectman and he then sent [redacted] out I feel [redacted] failed us and the town failed us by signing off on this propert knowing it was not properly graded as for my inspector he only inspected the inside of the house and said it was ok except we had a problem with the roof and that was a problem with [redacted] getting him to fix that too he actually stopped building our house because of this it took my lawyer after months to get the house going and that set the house back especially with my mortgage so we had to get it going that is why he was suppose to build up the front of the yard and did not.we did not know this until lit started raining .he also did not put crushed stone under the millings he just put dirt and now we can bearly get into our garage we have already had a front end element but I have asked him to fix it but his response was he is too buzzy and it's not his problem it was the excavators falt for putting the wrong stuff down .but we let that go because we are more concerned about the water that sits in our yard we have mosquitoes  we had to buy stuff to keep the mosquitoes away.I we appreciate that you took the time to listen but I know now this will not be resolved until I go higher I am really sorry that it has come to this.
