Dear Sir/Madam,
I am writing in response to the above subject matter the case that was filed by a client who was unsatisfied with our mobilization effort
Our company AAA Group of
Companies actually received a fencing job confirmation from *** *** of *** *** *** Upon the confirmation of the quote, we scheduled the client's job to meet our weekly schedule and the client was advised based on that schedulehowever, due to natural causes, the rain prevented us from completing the job we doing and we the client was contacted and advised that we were unable to start her job as previously scheduled due to rain and her job will be rescheduled and she agreed and asked for the next arrangementWe then provided her the next schedule which was to start June 10, and to be completed June 12, We arrived at the site exactly 12:30PM with three workersThe arrangement for that day was to dismantle the old fence in preparation for digging and postings the next dayAs soon as we got there without wasting time, we took down the old fence boards and place them at the middle of the yardI then asked my third guy to start hauling the materials to the LandfillThe one guy she talked about was working alone never did touched the fence but just to haul materials to LandfillWe have evidence for the receipts that we received from the Land Fill that day*** However, our arrangement prior to mobilizing was that before we start work, she was to deposit $3,mobilization and after the job completion she can then pay the balanceWe started the work and she came to me and said that she did not want to pay the mobilization money*** I was confused because she had agreed on the terms of the contractWe decided to continue on the job since we already started workingMyself and another worker left the site after removing all the fence board and left the third guy to continue with the dumping as that was about the only job left to be doneWhen I returned I took over from the guy and ask him to start pulling out the posts from the ground while a make the last trip to landfill as they closed at 6PMHowever, the guy did not understand that all the boards has been removed and mistakenly took some fence boards down from the adjacent propertyDuring to the shape of the lot it is very difficult to understand the true boundary anywayWhen that happened, she called me to complaint about it and I said to her that I would fix it***
On my way back from Landfill, the customer sent me a text that she and her husband did not want to continue with the job anymoreWhen I returned from Landfill, I was trying to explain things to her and she refused to listen to meAs a contractor, I did all we need to do, clean up the mess and mobilize my equipment off the site at about 6:I then said to her we are going to send her an invoice for mobilization and the work that was completed in her yard including disengaging the items that was ordered and personnel that were scheduled to work thereShe claimed she was going to pay for hours and that she was willing to pay $per hour because we only had one guy working thereAfter reviewing the whole scenario we decided to even out just to avoid issues with her an invoice her for hours she claimed she was willing to pay at our hourly rate of $***
While I am willing to settle this amicably but she need to understand that you cannot ask a company to come work for you and try to ridicule them at the same time

First of all, men did show up at 1230,of them left by and I did not see them again until one of them came back about pmThat man drove the truck of garbage to the land fillThat was the second load I believeThere was one man working all day by himselfHe took part of the fence down before he then took a load to the landfillHe then came back and took down more fence
We did not want to pay the depositI had that discussion with my main contactBEFORE work had begunWhile I was trying to talk to him he started removing screws from the gate hingesThat was the "immediate work" he speaks of
There is no contractNothing was signed, nothing agreed apon in writing***
I was never agitated by him asking if I had the neighbours permissionI told him I had talked to all of themI was agitated by finding out that bylaw officials had come out and had complaints on the first day of work within the first couple hours
*** I am willing to pay $which is the amount agreed on for fence tear down and removalWhich wasn't even completed, but I'll pay that anyway
