This customer was upset because of some construction that was going on during her stay at a condo that I manage.  I did not have any control as to the timing of the construction since that is managed by the Home Owner's Association.  But as a gesture of goodwill, I refunded the entire rent...

of $800 for her 2 week stay for her party of 4.  She stayed for free.  I also refunded the $110 from her payment that was supposed to be for cleaning, but decided to take it out of the $200 deposit that I had on file from the previous year.  I also held the remainder of the $90 from the deposit on file to cover transaction and administrative fees.  This was simply a way to get her off of my books completely. I am not holding her deposit for any other reason except to cover regular cleaning and administrative costs.  She did leave the condo in good condition.

Secondly, you state you were not aware of how disappointed we were until after we returned home. I have attached my email to you dated 11/6 and another dated 11/14 because you did not bother to respond to my first email. Our disappointment is abundantly clear.
Thirdly, you state you were not aware of the construction because you no longer live on the premises. However, you manage five properties at this complex, so isn't it your job to be aware of such things? And you state that the previous tenant didn't complain about the construction, but you told us that the prior tenant was the new owner.
Lastly, I have attached the email you sent me dated 11/18 stating that you were keeping my deposit for cleaning & processing fees. I agreed to pay a deposit as collateral until you could determine we had not left any damages in the condo. You stated in your email dated 11/16 which I previously attached that we had left in appropriate condition.
I will not consider any of your conditions unless the full $200 is refunded. This was no vacation & if we had had any options, we would have left on 11/1 immediately after arriving as I told you that very day.

I am rejecting this response because:  The refund of the deposit is a completely separate issue from the refund of the rental unit. This is a security deposit that was held until you could determine that there was no damage done to your rental unit.  You confirmed in your email to me on 11/16 when you thanked me for taking such good care of your condo that I had met the requirements for which the security deposit was being held.As for our staying "for free" I will reiterate your dishonesty in renting this condo to us knowing full well that there was MAJOR construction going on six feet from the our BED as well as on the floor below outside the living room with scaffolding literally attached to the balcony from which workmen hung several hours a day hammering & sawing. Don't try to minimize the amount of construction that was going on because you have seen the videos that we took. You knew full well that this work was in progress and would be continuing for the duration of our planned stay. We spoke with both the owners next door and the workmen who confirmed that this project began two weeks before our arrival and was expected to continue for another month. When I spoke with you on Friday before we arrived on Sunday and you made no mention of any of this.  We left as soon as we were able to and we would have left immediately after our arrival, but that was not an option due to commitments we had made. This was no vacation for us! The absolute minimum you owed us was a full refund!
