We did all the other work we were supposed to except one handicapped spot. He chose that on site he wanted to change it to the blue painted handicapped spot. We told him we could come back the next day because we didn’t have the blue paint with us and told him it would be a $35 upgrade. The next day...

we were supposed to come back but the owner was in an accident and broke his leg. I personally called him and let him know we would be unable to finish the job because of this and that even though he was never charged $35 extra we would reimburse him $50 as a good will. He refused the money and said he would take us to court. We haven’t heard from him since. We did all that we could and only didn’t paint the one part of the blue handicapped spot. We cannot do the work because the owner is the only one who does the painting and he cannot paint with a broken leg.

This is in response to a complaint received by Mr. [redacted]. He said we took his deposit and then failed to show up for work and stopped answering him. This is not true.   We did receive a 50% deposit with a signed contract to solidify a date on our calendar for his project. We scheduled...

it for the next week since had to reach out to [redacted] to come mark utilities anyway. The contract indicates an ‘estimated time’ of (4) days, which is the time it would take us to complete the project after starting. I believe Mr. [redacted] thought it meant we would be finished within 4 days of his signing our contract. [redacted] took (3) business days alone (Friday, Monday, and Tuesday) to come mark the pavement, and it is state law that we CANNOT dig before all utilities are marked.   While waiting for [redacted] to give us the okay to start digging, we proceeded with power washing and scrubbing almost the entire front of the property. The rear of the property was now lined with dumpsters and employee parking, which was not the case when we entered a contract with Mr. [redacted]. This was another week delay to have [redacted] out to mark, since the dumpsters were in the way of the concrete pads that needed to be marked. In the meantime, Mr. [redacted] was to make sure cars were out of the way so we could at least paint the handicap stall parking bumpers. Upon our arrival to perform that portion of the work, only a few cars were moved, so we scrubbed and painted the parking bumpers that we could without risking damage to cars that were still blocking the other bumpers. We were instructed by [redacted] when we initially called on a Friday morning that we could NOT start digging in the front until Wednesday morning, and it rained Wednesday and the ground was too cold to dig on Thursday. Friday, I had rented a bobcat for the weekend to get the pavement torn out, and had a concrete truck scheduled for Monday morning. Friday afternoon, Mr. [redacted] demanded his deposit back.   At that time, I had already power washed and scrubbed the entire front of his property, purchased paint and wire wheels for the maintenance of parking bumpers, paid my laborer for his time, rented and paid for a bobcat, in addition to a deposit for the concrete truck and operator. We cancelled the weekend work as he was unsatisfied with the events leading up to that point. We couldn’t just show up and complete the work when he was anticipating the cancelling everything. We DID discuss this with Mr. [redacted] via text and phone conversation after this situation. We attempted to re-schedule the project for the following week, but the weather took a turn for the worse. It became too cold to successfully fulfill the contract with quality work until winter is over. We will not do concrete work in freezing temperatures against our professional opinion and rush through a project, even if the customer pushes us to. We suggested to Mr. [redacted] that we postpone the project until Spring, and a few days later we received yet another demand for his deposit back. Unfortunately we had almost the entire deposit amount invested in the costs mentioned earlier, and at that point we still anticipated to perform the work as agreed upon.

Complaint: [redacted]
I am rejecting this response because:None of this is true, if he had a broken leg why would he and his wife keep promising for 2 months that they would finish the work. I also have proof that there still working and never stopped, as far as a fifty dollar refund goes, I have yet to receive it,I'm not satisfied with there response and this is just another lame reason to not finish the work or refund the money, this is the first time since July 4 that a broken leg was ever brought up, I will not be satisfied till I get a 50 refund or the job is complete.
Sincerely,
[redacted]
