After researching the account our findings are below.To begin *** is not an employee of The Merchant Store, he operates an independently. In this instance this is concerning an application he submitted to us.We have a signed agreement from the merchant outlining the $account on file
file and all processing related feesThis agreement was for processing services to be provided by a third party who provided mobile card processing services. In this case we do not control the agreement or the fees. That said, the agreement the merchant signed states that the merchant was required to maintain PCI Compliance and provide the processor annual reports proving compliance. The processor also provided the merchant with the services needed to obtain and maintain compliance reporting. Since the account was opened in June the processor has not received any such reports of compliance. The agreement also states the merchant has days from billing to dispute any charges on their account. This account has been open since the middle of without any question of the fees being debited monthly from their bank account. In March we received a request for a refund from the merchant and we explained to the merchant that since the agreement was with a third party processor there was little to nothing we could get them to do directly. We did go ahead and send a request for the processor to refund the merchant. Unfortunately it doesn't look like that request was fulfilled.We are willing to do a refund directly to the merchant ourselves of 108.98, bypassing the processor. This goes beyond the agreed disputable time frame provided by the agreement. Thanks***
