Good afternoon, Again only as good will we will mail the complaining party a check for $ We have on tape where she was asked to inspect everything prior to signing This is our policy and we never ask anyone to sign prior This is policy for tow companies as they won't bring your vehicle to the front without you signing.We don't operate that way and never have We are an entirely different business.The $is a set fee by [redacted] if you have one bag or We also waive all storage fees for the bags that we are allowed to charge.We have the footage of us asking the complaining party to sign if she would like to schedule an appointment to view it[redacted]

Good afternoon [redacted] , I have attached the inventory sheet stating that the property fee is $per bag not a flat rate of $ We reduced the charge from $to $ We also waived the daily storage of the items Ms [redacted] sent us authorization to release her belongings to [redacted] He told us as well as Ms [redacted] that the camera was in open view (specifically that you couldn't miss it) on the passenger front seat of their car The car was unlocked, sitting on the street on [redacted] in [redacted] for over a day We let them know that the camera wasn't in the car when we picked it up If it was sitting on a busy street for pedestrians, people shopping and heavy traffic overall unlocked for over a day it was more than likely stolen from the car We recommended that they file a police report To date we have yet to receive a copy of that report or case number Mr [redacted] drove her without a drivers license (his CA ID is attached) Ms [redacted] 's lender didn't know where she was located as we only picked up the vehicle from a camera scan This puts their credibility in question as well as them not filing a police report.If you need any additional information please let me know.Thank you and have a nice weekend! Lets back it up a little in regards to this businesses ethics and the way they treat peopleI will only speak on our personal experiences with them and not bring up the fact of other shady stuff they have done to people like stealing a lady's dead son's ashes and not being able to find themAfter the car was gone we did call the police but that was to report a stolen carThey informed us about what happened to it and gave us the contact info for ABAThat night I googled ABA to see what kind of company we were dealing with and previous experiences that other people have had with themAfter seeing some of the reports we were only hoping for the bestI was glad I did the researchWhen I called the next day to see if we could get our belongings they said no problem we would have to wait until their next business day they were open and just to make sure we bring Idthe keys and the $fee to get our stuff Immediately a red flag went up because I remembered from the reports the night before how they charged only $and not $ We didn't say anything about it though cause we wanted to make sure we were able to recover our belongingsWhen I arrived (***) the first thing ***( I think that was his name) did was ask me for ID and the $I still did not saying about knowing that it was only $because I thought that if I brought it up it might start an argument and he would say he would not allow us to get our stuff and come up with some justified reason to tell the bank as to why he didnt allow us toSo, he went and brought the car around and (that camera was really the only thing we wanted out of the car because we use it for our business) and right away I could see it was no longer in the carI checked and double checked but I knew it was goneI was so bummed and at a loss for wordsI asked *** about it to see if maybe they took it inside to keep it in a safe place and he told me that it is that stuff that can overheat by being left in the car in extreme heat they would put inside in a safe place and told me he would checkHe said no one had brought anything inside and that he didn't know what had happened to itI knew that by getting upset wouldn't help anything and would probably make things worseThan he brought out papers for me to sign and at that time I brought up the fact that he had us pay $when in fact the charge was only $It was funny because on the paper he had me sign it shows the $fee being crossed out and in pen written $ I believe they sent you a copy of that paper that he had me signI signed it only because I was still in shock of what was happeningAfter he handed me the second paper to sign I told him I did not agree with what was going on and refused to sign the second paperIt seemed like it didn't matter to him if I signed it or not and he was quick to turn and leave back inside So, from start to finish this company did us dirtyFrom the !fee to the taking of the camera We had no idea we could file a police report because what were the police going to do? Go out and talk to them about and try and find something that was clearly gone? They don't even respond to calls where they know the suspect is clearly not in the area and gone after the fact After ending this response I will go up and file a report and submit it to you later today. It seems like some progress has been made since they finally decided to respond to you We would like the cost of our camera compensated for($300)We would like the cost of the business that we lost compensated for as wellWe had events that were scheduled to be live streamed with that camera that we had to cancel on($350) I seriously doubt that ABA will step up and do the right thing If anything I would be surprised if they do the bare minimal to make things right I will head to the police dept now and submit a copy to you todayWe really just wish this was over with but we can't just walk awayThank you for your help Revdex.com It is too bad people have companies like ABA do this to them.

This is just something I cannot acceptThey way the company handles returning your item ( car in this case) is they have you sign the form before you even get to look at your carIf I was in right mind that day and not so stressed, I wouldn't have signed the paperwork before handMy issue is there was $in quarters in my cup holder and the fact that I have proof that there was and it was taken from a tow/ repossession yard employee is sadI am not worried to much about it but it is a principalI didn't report anything until I was home for the evening as I noticed it later in the dayThe mistaken repossession of the car was a mistake on *** ***s side nothing that the company didI also note that the car would have some stuff moved around due to transport but the fact that my backseat was moved to a flat position farther tells me someone went through my belongingsThis is suppose to be protected by the company while in the companies possession( hence they payment of a $personal property fee charged.) I am merely upset that a company can make up excuses for its employeesI will say the gentleman who greeted us upon arrival was friendlyMy concern is with the guys in the yardMy report is merely to let others know of the issues with ABA Recovery.

from a public parking facility as depicted by the attached photograph Even if it wasn't a facility that is open to the public we had permission from the site manager *** *** who was in control of the property at the time of the repossession.Theresa at Southern California Auto Auction has Ms***'s license plates and has been working with Ms*** to return them to her.Texas is a plate state This means the plate stays with the vehicle and we don't have the right to remove the plate.Please let me know if you need any further information. 3/26/- In addition to our response we would like to add to our response the fact that Ms*** would pay the same fee of $on day one or day 60.Even if she updated her address with Wells Fargo Dealer Services the fee would have been the same Therefore her asking for a refund isn't warranted.Ms***'s credibility at this point including her concealing the bank's collateral is a violation of the penal code in in question.We didn't address her asking for a refund as we couldn't see Ms***'s request until we responded to our complaint. If you could please add this to our complaint response, I would greatly appreciate it. In addition, when uttering these lies, [redacted] is obviously not taking into consideration that her client and I renain on very good terms! Particularly because I am well known to them as having demonstrated mu honesty on several occasions.If my belongings are not returned or replaced I will contact the client and let them know the underhanded way this company behaves and go on the client forums and let all the staff members and drivers know about how underhanded ABA Recovery is, as well.

1) The vehicle wasn't mistakenly repossessed per [redacted].2) Nothing in the vehicle was even inventoried as the vehicle was redeemed by Ms. [redacted] the same day it was repossessed.3) There was never $10.00 in Ms. [redacted]'s cup holder.  Had she raised this issue at the time when...

she signed for all of her personal property and her vehicle, we would have gladly paid him, simply out of good will.We don't steal any items out of any vehicle.  If Ms. [redacted] was missing her money she shouldn't have signed the attached form.  Furthermore a police report should have been filed.  It also doesn't make any sense that she is accusing us of stealing her change but not taking her laptop she said she got back?4) Our office was never made aware of any problem of any items being ransacked or stolen when Ms. [redacted] was here.   She didn't call, E-mail or text after she left.  She filed a complaint with you approximately 12 hours later on the night of New Years Eve/New Years Day.5) All employees are drug and background tested.  In fact every repossessor and the one who released Ms. [redacted]'s vehicle has a lives scan done that has to be approved by the FBI and DOJ before they can receive a repossession license.6) We are a repossession company not a department store.  We do let our customers inside and our office is an industrial office.  But we are the only repossession company (that we are aware of in the United States) that allows customers into their office.  Throughout the industry it's against their policy to allow the customers into their work space and or office.  Repossession and towing companies do not allow customers into their work space. They use a window or shed/walk in area only that doesn't allow the customer to go past that point.   We feel this is a much more friendly atmosphere as opposed to leaving customers outside.  Please let us know if we can be of further assistance.  [redacted]

Even though the story about the time the car was left unlocked on [redacted] doesn't change the fact that the car was left unlocked for a period of time with the camera left on the front seat while the car was unlocked.  The police would have taken a report and still will.  This has nothing to do with the repossession.  If the camera was stolen out of the car the [redacted] Police Department will take a stolen report.  Then a claim can be filed with the carrier that provides the car insurance.  If the police investigate and find we stole the camera they will prosecute us or whatever party stole it.  We are fully willing to cooperate with the authorities as we do every day in our job.The police report needs to be filed to resolve this issue it seems to get to the truth of the matter.As far as other consumers we are not permitted under every contract we are required to sign with every lender we do business with to protect their privacy.  Third party information cannot be disclosed to any party.Again the sheet that was provided at the time of the release states $60.00 per bag = $120.00 not $100.00.  We reduced the amount by $20.00 and waived the daily storage in addition to the $20.00 being waived.  The fee was, is and will never be $60.00 in this case.Therefore there isn't any more credit that can be given.If we didn't repossess vehicles, lenders wouldn't lend.  People get angry every day who are concealing collateral once we catch up with them.  This is a prime example.  Again it's a felony to conceal collateral under penal code 154 (b).  It's also not lawful to drive without a drivers license.  Both have occurred in this instance.  This should be weighed heavily in the credibility of person making this complaint as well as her authorized party picking up her belongings.If the police report were filed we would all know that this is truly an item that was stolen and we could let the authorities do their job and the truth will be told.None of the allegations made have shown that we have operated unlawfully nor have we been convicted of any wrong doing.[redacted]

Hello Revdex.com.After receiving your message that the company responded (finally) and upon reading the message I was left totally confused. In the response it says to review the attached documents and there was nothing. So I decided to call aba towing and ask for the person that responded to get clarity as to why they would provide documents that they didn't attempt to show us. The response was from someone named [redacted]. Well I spoke with [redacted] today and this person said they have yet to hear anything about this and had no idea who I was or what I was talking about. This is exactly how this business operates. They lie and decieve people. I would guess they get away with it so much that they thought they could lie to the Revdex.com and get away with it. I spoke with the person that signed the response and they had no clue what I was talking about.   Super shady business practices. that this company is about.To be completely honest this doesnt surprise me since this is the same company that stole a suitcase from a car they repoed and it had her son's ashes that had passed away. She was heart broken and they kept telling her as soon as she paid the $ they would give it back and after all was said and done they paid her $400 instead and sign something forcing her to stay quiet. I read this complaint the day before going to retrieve our items back and not only did they steal but they tried to charge $40 more than they charge other people. I brought the proof of what their normal charge was to other people and asked why he was charging me more than others. He said because he could. Even on the paper he wanted me to sign it said $60 and had been scratched out with a pen and $100 hand written was put next to it. First thing they did when I got there was ask me for the $100. I knew better than to argue or I wouldn't have been able to get our belongings back. I wouldn't have even stressed it of all of our items were still in the car. So I refused to sign the paper and they said "oh well, doesn't make a difference to us".  I'm nor sure at this point what we can do to recover the cost of the items. I guess just warn as many people as possible so hopefully it doesn't happen to them.

We have yet to receive a police report that was filed for the camera we have been accused of taking.  If our company did anything unethical or even thought the camera was stolen by us or someone else we would render payment just as good will.  The vehicle was unlocked on [redacted] (the busiest street in [redacted]) for over 24 hours with the camera being left in plain view on the passenger front seat.  If this was really the case why wasn't a police report filed to prove the validity of the theft?  We asked the person making the complaint as well as her authorized representative to file the report immediately.I will not get into any facts about another party as it's just being used and all facts weren't presented nor accurately and have no bearing on this complaint.  Again the credibility is in question of the person making this complaint as she was defrauding her lender.  Her authorized representative drove to our facility without a drivers license.  If this were a good faith complaint or a theft really occurred we would make a good will payment just as we have many times over the years whether we were at fault or not.  Clearly that isn't the case with this complaint.[redacted]
