We did our best to meet Mr*** ‘s expectations in each step of the wayFrom a native app, his requirements was swung to HTML app and again from HTML app he came back to Native app requirementsThe final work order was approved for inter-navigation of screen in the native app which is what we were working last in the Scope of Word developmentWe sent him the Deliverable Expectation Document (DED) on Aug 3, Mr*** did not show any objection at that time in fact, on Aug Mr*** stated “All materials are ready to submit to you for the screen flowHow do you want me to get them to you?”.This clearly implies, Mr*** approved the Scope of Work we prepared for himWe have already provided Mr*** the break-down of the efforts towards this engagement which was very conservatively calculated.We are sorry that we are having this conversation with Mr***ATI stood ready to fulfill Mr*** requests and he is the one who stopped or terminated this projectWe are always happy to hear back from Mr***, and we encourage him to reach out to us via email or phone if he wants us to elaborate on anythingKindly feel free to follow up

day.We appreciate the opportunity to review the concerns and we take Mr. [redacted] candid feedback in a positive light. Mr. [redacted] hired us to develop a custom application development. The below facts show how ATI stood ready to fulfill Mr. [redacted] requests and the Mr. [redacted]  is the one who stopped or terminated the project.According to Mr. [redacted] this will have a “good business model to Skype/Microsoft” but he had very limited budget. Just like any new app idea development of a new customer it required discovery session, in-person meetings, phone meetings,  brainstorming and preparing the documentation (Scope of Work) before starting the programming efforts.  We spent several hours for these efforts here are  some of the efforts breakdown -Discovery Session ( Marketing Director and Web Developer)R&D (Led by Software Engineer)Preparing Deliverable Expectation Document and Scope of Work (Led by Solution Architect )Brainstorming and Technical Phone Meeting with Ms. Lakshmi S[redacted] ([redacted] associate)After the discovery session and phone meeting we presented him an estimate on July 1st 2015. When he decided the move forward with us, we did pro-rate him for the discovery session fee as promised and adjusted that  amount in the invoice (dated July 9 2015). After that, Mr, [redacted] went back and forth on his requirements and his budget was still limited. As his scope creeped, so did the cost. The scope of work was changed to meet his budget.  We sent him the Deliverable Expectation Document  on Aug 3, 2015. Mr. [redacted] did not show any objection at that time in fact, on Aug 6  2015 Mr. [redacted] stated “All materials are ready to submit to you for the screen flow. How do you want me to get them to you?”. Mr. [redacted] kept us engaged with these efforts and we kept researching and educating him on the implementation details along the way.  After spending several man-hours on this project and getting all the required information, implementation details and technical insights (know-how);  suddenly Mr. [redacted] changed his mind. He didn’t want to work with us and wanted the refund for the services that was already provided to him. In our invoice (dated 07/09/2015) the Terms and Conditions clearly states - "Since we deliver services, we will not be able to refund for any terminated contracts. If the contract is terminated for any reason, the Client shall be billed for the work executed by us and not paid by the Client."Here are a few facts from the email communication between Mr. [redacted] and our company, ATI -Despite the above agreement in place, when Mr. [redacted] came back and requested for the refund in the month of September 2015, we went back and reviewed all the efforts we put on his project and calculated the cost very conservatively. We offered him he refund of unused fund or an option to still continue working with him on his project.On Oct 7 2015 Mr. [redacted] said he will review our offer soon when he gets a chance.On Oct 27, 2015 Mr. [redacted] said he was in real shock of seeing the efforts breakdown.We had plan and desire to complete Mr. [redacted]  project that we had undertaken. Mr. Tanlen terminated the project not us. Therefore, despite our no refund policy we can only refund him what we had offered him in the month of September 2015 via email.

I am rejecting this response because:Kumar's response was not accurate in several ways. I got Lakshmi involved to see if she could work better with Kumar and actually get things going back on the right track. I didn't proceed with the mock-up, which of course would not be a functioning version of the app, because: 1. Lakshmi, a very knowledgeable professional developer, said that I was being over-charged 2. That wasn't what I wanted anyway. I paid the money because I was told, even in writing, that I'd receive a very basic functioning app with specific features for the money I paid plus another installment. But Kumar retracted that offer after we had agreed on the functions and price. - Incidentally, the basic features I always wanted did not change. Getting them to include just those functions was the difficulty, as in why their first offer wouldn't work - too many features and way over the budget that I always stated I could afford. 3. I had already created all the graphics myself. There's plenty of free software available to create your own mock-up easily for free, so that's what I did. The mock-up Kumar was offering was very limited. He would only use a limited number of diagrams in it, I think it was 10 or 11, which wouldn't have been worth much, if anything, to me anyway. BTW, I really liked the two people that I had the initial meeting with. Just saying. And I hadn't disliked Kumar either. To sum it up, I needed a very basic functioning app with specific features for a specific amount of money. His company agreed on that in writing, I paid, then they said they couldn't do it for that price. I kept trusting them for some reason. It certainly didn't work out. When I decided to submit this complaint, I knew chances weren't great that I'd get a fair amount of money back from these guys, but at least I could warn others that I did not get what I paid for or even a partial refund, at a time when I really did not have much money at all. Considering I went to them in large part because of their Revdex.com rating, I thought it was important to not just let it go without warning other people and tell the Revdex.com. The company, ATI or Abasys Tech, might do fine for others and/or corporations, but they were not ethical with me, offering to refund $20 to me out of over $1,100 that I paid. I mean come on, that's pretty bad. I do not believe this treatment deserves an A+ rating from the Revdex.com. Sincerely, [redacted]
