Dear ** ***, I hear your angstAs a non smoker myself I
can understand your reaction to living in an environment where others smokeI know when I go to a hotel, I specifically request and check that the room is for a non smoker However, in the rental business it is a little differentUnless a building is advertised as a "No Smoking Allowed" or a GREEN building, there can be smokers in the buildingUnless there is a specific request made to find a smoke free building, it will not be smoke free Again, my apologies for your inconvenience. Dear [redacted],   I am responding to complaint #[redacted] from [redacted] regarding a 3 bedroom apartment at [redacted]. The letter mentions that [redacted] filed an earlier complaint though I did not receive it.   I was very sad to hear that [redacted] had a bad experience with one of my agents, [redacted]. I can understand the upset one feels when a landlord ups the rent that was originally quoted and refuses to budge on the new price they are requesting.   The apartment in question was originally put on the market for $1950. After the application for [redacted] and her friends was submitted, he requested no less than $2000 because other brokers in the area were telling him he could get $2300+ and he was not interested in $1950 anymore. When a landlord gets stubborn like that there is nothing we can do except wait and see how the market goes.   As I understand from my conversations with [redacted], she was willing to lower the fee from $2000 to $1600 and possibly more once she got paid to compensate.  ?[redacted] is associated with ? [redacted] and does not work for [redacted].  She works on occasion with [redacted] when she cannot show an apartment. I cannot really comment that you say he said "the [redacted] and they want money" or that [redacted] called her an [redacted] is most friendly and a very fine and respectful person in general. I have never, not once received such a complaint about her.    The apartment did remain on the market longer than the landlord would have liked. It was ultimately rented by another agent from my office in late March 2015 for $1975. The application was an excellent one with credit over 720, income over $200,000 and savings of over $100,000.   I checked out the link posted in the complaint. It seems to be posted by owner but obviously is no longer available and no further contact is included.    Application fees are generally not refundable when an applicant backs out. Though I understand [redacted]'s decision not to refund the application fees as she was offering $400 off the fee, I understand [redacted]' argument as well and will refund her application fees.    At [redacted] we work very hard to satisfy our customers. This is an industry where prices can change on the whim of a landlord without notice. There are many brokers in the market promising unattainable rents hoping to "snatch" a deal from another broker causing harm to the industry.   Let me know how to proceed with the refund.     -- And have a great day!   [redacted]

As I expressed verbally to [redacted] and her associate [redacted], who again, was unheard of when I called the Brooklyn [redacted] location,it wasn't about it being 50$ extra, It was the plotting and scheming as well as the false statements that [redacted] was giving, how they work with the budget he can probably get the fee down to $1600 like he did for the guy upstairs, How he would help us with the fee when he get his cut, depending on how much he gets because they split it with so many people. 'I have the text messages to show for as well. How he and [redacted] try to tell us $50 extra isn't a big deal and when I said $50 less isn't either, [redacted] kept saying they are [redacted] and they want money. How [redacted] called my job and when I told her I was filing complaint called me an it, told me that people try to do this all the time so shes not scared and hung up the phone on me. That's not professional at ALL. They both were not Honest or professional. Especially because when I called they didn't even know who [redacted] was..Does he even work there?!?!?The entire time they are telling us that this apartment wasn't going to last and 7 weeks later, its on the market posted by [redacted] at $1950 with No brokers fee. Which she posted and because the apt was rented she took down the post. We couldn't believe it, the apartment they "fought" so hard to get down to $2000, the very same Apartment, they wanted to charge no less than $1800 in a brokers fee is back on the market at the original price we were told, $1950 and with No Brokers Fee. Here's the listing with another firm [redacted] which [redacted] also claimed that no other firm would have this listing.So, yes I want my complaint to stick. I don't know what type of business they are running, and maybe not enough people complain, I was not happy at all with my experience with the [redacted] and [redacted] or [redacted] for how they "conduct business". All of my reviews have removed from, [redacted] and [redacted] as well as my review of [redacted] on [redacted]. I know the credit check is non refundable as most real estate agencies state and Even if we can't get the 150$ back for the 3 credit checks, which they ran prior to receiving all of my paper work, thanks for pointed that out, I think everyone should be aware and beware of their bait and switch method. sSo, no I'm not satisfied with the response I received and I want continue with my complaint.

On Feb [redacted] 2015, [redacted] and her roommates met up with [redacted], an agent from Fave Realty that we occasionally co-broke with on rentals and saw a three...

bedroom in the [redacted] area of Brooklyn that was initially listed for $1950.00. [redacted] expressed interest so we started the application process the following day. The co-agent [redacted] and myself met up with [redacted] to get a good faith deposit and credit check fees for all three roommates. At that time I explained to [redacted] and gave her a 2 receipts for the transaction. The first one clearly stated the following: Deposits are non-refundable. However, in the event that the landlord does not approve you, the entire deposit will be refunded. By signing below you understand and agree to the above terms and conditions:) The second one was the application fee receipt that stated: Please note that is a non-refundable payment regardless of any circumstances. This waive and key information is in BOLD print, not small and hidden. I also verbally let [redacted] know this information and she agreed by signing. Upon me returning back to the office, I right away ran [redacted]'s credit (which is the first factor in the qualification process). Later, that evening when I received emails from both [redacted] and [redacted] her roommates with their applications and ran their credit. My goal was to get them approved first thing in the morning because the management closed early on Fridays. After reviewing all documents submitted I called the property manager to run through the application with him. He expressed to be that he wasn't crazy about the application but would take my advice and approve them but that he recently spoke to another Broker that he works with and they promised him he could get $2,300 for that rental rather than $1,950. I explained to him that this switch can cause them to back out. Long, story short I was able to get him to agree to $2,000. Which is a $50 increase of the initial price. I am aware that [redacted] and her roommates would not be happy with this change so along with letting them know about the increase I also let them know that I am willing to reduce the broker fee by $200. She initially agreed then called back to change her mind and wanted it reduced more which is were we couldn't see eye to eye. I returned their deposit immediately. Throughout the whole process I kept her up-to-date on everything and was completely honest but that didn't seem to be enough. I am truly sorry she felt that I was nothing but reasonable, professional and honest

Review: The agencey(ABBA Realty Assoc. Inc) failed to provide vital information about the building located at [redacted] which I currently reside in my lease began on Jan [redacted] 2014,I went to the agency which agreed to help me find an aparment, the realtor failed to disclose that the building owners allows their tenants to smoke inside of their apartments,smoking is not allowed in the front of the building I am a non-smoker,and I am constantly exposed to cigartte and marijauana fumes, this is a deterement to myself, my health and my children's well being. ABBA realty needs to be honest with all clients and should provide not only reliable but trustworthy services to ALL.Desired Settlement: I am requesting that the agency refund me my credit check fee of $25.00

Review: On the evening of Feb [redacted] 2015, I was contacted by a gentleman by the name of [redacted], how claimed to be from [redacted], I've been searching for an apt for myself and 2 friends and he contacted me, saying he had a beautiful, huge 3 bedroom for $1950 in crown heights, he thought we would love. We, met up and saw the apt and it was beautiful. He told us we should get on it quickly because once they list it it will not last long. So we acted fast. I met up with him and [redacted] on Feb [redacted], 2015, who had paperwork stating, the rent was $1950 per month, the deposit was $1950 and the brokers fee will be $1950, which was negotiable, he told us the day we met that his company works with people, they were able to get the gentleman upstairs brokers fee down to $1600. I gave them a $1950 Security Deposit for which they said they will take $150 out, $50 per person, to do the credit check. We sent in our paper work /application by Friday Morning, by 12 noon, on that same day, [redacted] called me and said that everything look good and but NOW, supposedly the landlord wanted $2300-$2400 for the apt because another broker told him it is worth that much. I told him it as outta our budget he said he will try to get the landlord down as he knew our budget was $2000. I told him I wasn't sure about this because he presented us with 1 price, checked our credit and now all of a sudden the price was different and he also claimed that he took complete advantage because We were 1st time renters. Though he said the landlord would take 2000, I explained to him many times how confused and not okay with the fact that this changed. He presented us with a price and changed it and this isnt how business works especially not after you ran a credit.. You cant go to a car dealership and tell say this car is 15,000, put a deposit and when you come back they say oh now this car 25,000. A security deposit is a sum of money held in trust either as an initial part-payment in a purchasing process (often used to prevent the seller selling an item to someone else during an agreed period of time while the buyer verifies the suitability of the item, or arranges finance), that deposit is to secure the place in the apt listed. we went back and forth about it because I could understand why the rent couldnt stay at the price I deposited. he ten said that that 50$ more isnt a big deal, and that they are [redacted] and they like money. after a weekend of back and fourth with him and [redacted] trying to down play the situation and prey on us being a 1st time renter, we went to get just our deposit back on Feb [redacted]. They intentionally ran our credit , pocketing $150, knowing the landlord wanted more rent for the place, They left us with a hard credit check on our reports, $50 short each person, and headache/heartache for being taking advantage of. Then I spoke with a rep from the [redacted] office on March [redacted] and she asked which broker I was working with and I told her I was Working with [redacted], she didnt know who he was! The Rep gave [redacted] my number. [redacted] called me and I told her I was filing complaints and I believe we deserves our money back, I told her I wanted to rectify the situation with out going further by sending them a summons. she said shes not scared, that people have done this before and if I want to waste my time Io ahead, she then called me an it and hung up the phone. the worst customer serviceDesired Settlement: I want a HARD complaint on the company and [redacted] as well as find out who [redacted] is to the company, And I want to be refund $150 for the 3 credit checks they did.
