I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me

Thank you for your tenancy and we are sorry you feel our policy is unfair. We clearly state on the first page of the lease you signed how Move in rents are prorated based on the date of the move in. We also clearly state in Paragraph 6, how move out rents are not
prorated. Enjoy your new home ! Tyson Properties Lease PRO-RATED MORENT: If the initial term of this Rental Agreement commences other than on the first day of a calendar month, Tenant’s rent shall be a pro-rata portion of a full month’s rental, calculated on a daily (30day month) basis from the commencement date until the first day of the following calendar month, and shall bepayable in advanceFirst month’s pro-rated rent calculations are as follows:Daily Rent Amount # of days to occupy this month Pro-rated RentPRO-RATED MOVE-OUT RENT: There is no pro-rated rent on move outRent will be paid until the end of the month regardless of when the tenant moves out(e.gyou can give a 15th of the month as the move out date, but tenant is still responsible for the rent until the end of the move out month)

Mr*** rental application fee and security deposit was not kept by Tyson Properties Inc. He was never told by any of our personnel that his funds would be kept from him. His application was withdrawn on November 30th and his funds which where previously
submitted via an on-line site was refunded to him on December 1st at 8:15am. We are not sure how long it took the on-line third party site, Pay lease to refund the funds to Mr***'s account. All of his funds where returned. Tyson Properties did not keep a single pennyThe property owner who had told us to advertise the home as (pets allowed upon owner approval), decided to change his mind and decided not to allow pets. The properties Tyson Properties Inc manages are own by individual property owners, not Tyson Properties. An owner can at anytime in the advertising process change their mind and decide they don't want pets. This is exactly what happened. The owner changed their minds about allowing pets after they had new carpet installed, but fail to notify the management company of their new decision. Our firm did not know that they would not allow pets until we contacted them about the applicants request for a pet. Since the owner had advertised (pets allowed upon owner approval), the owner had every right to not approve the pets if they choose to do so

Initial Business Response /* (1000, 10, 2015/10/21) */
In response to this case: *** brought his *** side by side with problems and it was diagnosed that there was engine damage from an improperly installed air filter as well as the improper oil filterWe did an estimate for a
complete repair - but *** didn't want all the work doneAfter initially saying we would only do the full complete repair, we agreed to only do the parts of the repair he wanted to do.......against our advice.....to help him out as he was stuck without alternate transportationWe knew he was travelling on this machine and worked after hours to complete as quickly as possibleSome specific engine parts had to be ordered and it took a few weeks to get those and complete the repairHe continually pushed us the hurry the repair and we stayed a little late to complete the repair so *** could make the ferryAlthough the distance he had to travel (180kms) and the time he had made it next to impossible to make the ferry in time - unless he drove very fast not allowing the machine to break in and test the new repairWe advised *** that this was a new engine and to take it easy for the first ride to break in the engine and other new parts - plus to make sure all was operating properly as he didn't give us a chance to fully test the repairPlease also note that since *** would not complete the repair fully to our recommendations and was taking his chances with damaged parts still being used I told him I could not warranty the repair, and that it would be as is - where isHe signed the work order acknowledging
*** did not contact me for about - weeks after we completed the repair and we could only assume all was wellHe should have contacted us immediately the next business day to inform me of the problem - not almost a month down the roadHe called and explained what had happened and I told him to bring it back and we would look at it right awayAt this point he was in ** and had already brought his machine to a different shopHe demanded a refund and I said I could not do a refund but if he sent the repair order from the other dealership I would look at itOnce I received the work order and the explanation I offered a credit of $*** to help him with the new bill (number represents the dealership's cost to complete the repair in house had he brought it back)This bill contained other repairs that are unrelated to what we did at our dealership - parts of his clutch that were worn and he decided to replace
Please also note that there was no existing manufacturer's warranty on this machine, he did not purchase the unit from us, and although it is unfortunate that he incurred hotel and food bills, this is in no way the fault of M&F MotorportsHe had the opportunity when the initial failure happened to ship his machine home and take the ferry thenThis would have saved him the lodging
Had he contacted us right away and brought the machine back I would have made right any wrong we had done
Initial Consumer Rebuttal /* (3000, 12, 2015/10/23) */
(The consumer indicated he/she DID NOT accept the response from the business.)
HaHaHa, so easy to pass the problem on to the consumerAfter they had the bike for weeks and being told constantly we're waiting for parts, yes I was getting a little impatient but still the problem that happened with the bike was***, as they forget to tighten the clutch bolt properly when they put it back together and this caused the clutch to fall apart and cause all the damageThe dealer in ** said there is no way they could have fixed it for $*** and they are pulling one over on meThe primary clutch alone was $*** and *** in ** did the repair at a discounted rate for labour and parts ***
Final Business Response /* (4000, 18, 2015/11/24) */
Ok, thanksI've given this a lot of thought as we haven't had a situation like this beforeWe would have like to have repaired it here at the shop to know what was missedRegardless we would like to cover ***'s repair bill, as well as the $*** cash he paid for the flat bedPlease contact him to let him know and provide an address where we can send a cheque
Final Consumer Response /* (2000, 20, 2015/11/24) */
(The consumer indicated he/she ACCEPTED the response from the business.)
Thank You!

You told us that you forgot to transfer funds from your savings to your checking account to cover your rental payment which resulted in a bounced check. While you did your rent before the due date, the NSF did not result in a late payment and no late fee was assessed We do sincerely
appreciate that you pay your rent on time each month and we do understand that you are upset due to the NSF (Non-sufficient funds) charge levied by our firm for your bounced check. As you know most institutions have a NSF fee due to the extra processing and administrative handling required to process a NSF check This NSF policy is listed in the lease you signed when you agreed to abide by our lease terms. Anyone who submits a check that bounces is charged a Non-Sufficient Funds fee. We cannot make exceptions to this policy for one person and not another. Federal Fair Housing Guidelines spells out that a Professional property management firm must be fair to every tenant and treat every tenant the same. If we waived this fee for you, then we must waive the fee for every other person that has a returned check, and as a business we cannot do this
