Review: On 03/04/2014 I Purchased 2006 [redacted] with 138908 miles. Total Sales price-$7,038.52 with 5,000.00 down and 2,038.52 Financed made total of 1,500 in payments. I was be charged 1,050.00 in late fees. Then on 08/18/2014 was either given the option of either 1- turn in the vehicle or 2 sign another Financed agreement for $4,584.07. Making the total cash price on the vehicle $9,584.07. I borrowed $300.00 from my dad to make a payment on 8/17/14. Then next payment would be due on 09/05/14 of $300.00 it that point on 09/04/14 I decided to returned the vehicle back to the dealer. After doing some researching on KBB the blue book value in GOOD Condition is only 5,200 and I don't feel that this vehicle ISN'T worth $9,584.00. I only had the vehicle for 6 months and this time the maintance/oil charge was done to the vehicle along with repeatly x3 replacing the back left tail light/ windshield wiper/wiper blades and other pairs were starting to go bad that needed to be replace in order to be able to countinue to drive the vehicle making the vehicle unsafe for myself as well as the safety for my 19 month son to be in the vehicle which is the main reason that I needed to return the vehicle. I truly believe that this vehicle was a defective purchase along with unethical/presentation misrepresent of the vehicle . Along with all of this I am single income: working 1 fulltime job and 1 parttime job on weekends to be able to care for my son on my own and need a dependable and reliable vehicle for this reason.Desired Settlement: To be refunded the down payment of $5,000.00 that was placed on the vehicle.

Hopefully the information included in the package will suffice to remedy this situation.

September 20, 2014Dear [redacted]:We regret this situation has occurred, however, we would like to present an explanation of our position in this matter. We are a used car dealership. We have been open since July 1, 2010, ABC Auto Sales, Inc. offers cash sales of vehicles or a “Buy Here/Pay Here” option is available. We Have in-house financing and charge a percentage rate of interest and assess late fees when applicable.Because our vehicles are usually well within the Kelley Blue Book suggested retail price or better, we have a very good turn over rate in our inventory. This was also the case with the vehicle [redacted] purchased. A copy of the KBB listing and odometer statement from the sale of [redacted]’s vehicle is included.[redacted] decided on the 2006 [redacted] but only had $5,000.00 to put down on a vehicle. We agreed to sell the vehicle at the cash price with the promise to complete the sale within 60 days. I stressed to her that the obligation to make up the difference in such a short window of time could be a financial hardship. [redacted] stated that with her regular hours and overtime she was receiving from her employer that would not be a problem. She was confident it would not be as she and her son lived with her parents and her sister was her babysitter. As shown on the Retail Installment Sales Contract the date and amount of the payment schedule was not only set up and agreed on but also signed by [redacted] stated that she had paid $1,500.00 in payments. This is true! However as shown from the transaction history print out these payments were not made within the originally agreed on sixty (60) day window and when the vehicle was refinanced [redacted] was given credit for such payments. The late charges shown total $150.57 not $1,050.00 as stated by [redacted].As with any sale the customer is aware that the sales tax, title and tag fees heed to bë paid with thirty (30) days. I had spoken to [redacted] about the urgency of taking care of this and she said her sister would be stopping by to pay the taxes as she was working. On a followup call [redacted] had stated that she didn’t have the overtime she had originally planned on and was unable to make the payment before her temporary tags ran out. Although not our usual practice I allowed [redacted] to add her tax fees totaling $335.51 to her account and she once again gave another promise to pay. I continually called and requested that [redacted] bring her account current. On one occasion she came in crying because her sister had stolen her money. On another occasion her son needed medical attention. There was a span when there was little or no response at all. After exhausting all efforts and still no good faith sign that she would be able to get caught up that we would either need the vehicle returned or payment in full! She again came by with yet another situation about borrowing the money from her father and said she was struggling with her finances. I offered to finance the vehicle for the difference in the three/four months she was behind but at the ‘Buy Here, Pay Here” rate where she could keep the vehicle and make her payments of $150.00 per pay period and we would in turn be compensated for the sale. She seemed relieved that we would continue to work with her and agreed to and signed a new contract. When the first payment was late she turned the vehicle in already knowing we had been more than patient and gone above and beyond what was expected or required.We have never offered warranties on any of our vehicles. A policy for which the customers are not only well aware but they also sign three documents which state the vehicle is sold in an “as is" condition at the time of the purchase. [redacted] stated that she had the vehicle for six (6) months and had only had to do some minor routine upkeep to the vehicle that I would hoped she would have done to any vehicle she owned in order to prolong the life of the vehicle and save the cost of accumulating potential future repairs.Attached is the Buyers Order, the Buyers Guide, the transaction histories from the original Sale and the refinanced sale, both retail installment contracts, the road test sheet where it is a practice for all customers to take a road test of the vehicles before purchasing, and finally a copy of the signed Company Policy that reiterates several areas that [redacted] failed to follow.I’m sorry [redacted] feels the vehicle was defective although still in excellent condition. In the future might I suggest she have someone more knowledgeable assist her with such purchases. As many others are also single parents and struggling financially, she is fortunate to have the help and assistance of family!ABC Auto Sales, Inc. in no way feels [redacted]’s claim to be substantiated or warranted or lawful.Sincerely,Wayne M.
