OUR COMPANY RECEIVED A CALL FROM *** *** THAT HE HAD A LEAK ON WATERLINE THAT WE REPLACEDSCHEDULE A SERVICE TECH TO ASSESS THE ISSUE, UPON ACCESSING THE SITUATIONCUSTOMER RUDELY STATED THE CITY OF AKRON PUBLIC UTILITIES STATED THIS WAS OUR FAULTTECHNICIAN STATED THERE IS NO WAY THE CITY COULD MAKE THAT ASSUMPTION WITH OUT EXCAVATING WATERLINECUSTOMER RESPOND BY SAYING IT FROZE AND BROKESERVICE TECH REFERRED BACK TO WHEN GRADING WAS DONE, HE WAS ADVISED TO BRING IN TOPSOIL FOR DEPTH ISSUESCUSTOMER WANTED TO KNOW WHY WE COULDN'T BE LOWERED MORE IN GROUND, THE CITY INSPECTOR (WATER DEPT) STATED THAT IT SITS ON ROCK AND IT HAS TO BE LINED UP WITH CITY LINESERVICE TECH THEN STATED THAT THERE WILL BE A CHARGE SINCE WARRANTY IS EXPIRED ON MARCH 14, WE GAVE DATE FOR REPAIR ON 08/25/EXCAVATION CREW ARRIVED ON 08/25/REPAIR WATER LEAK, UPON EXCAVATING LEAK WAS FOUND WHERE ABC DRAIN TIED ONTO CITY SHUTOFF(CURBBOX)ONCE REPAIR WAS COMPLETED, OUR SERVICE TECH PROCEEDED TO ADDRESS *** *** FOR PAYMENT OF $*** *** REFUSE TO PAY BECAUSE HE FELT THAT WE WERE AT FAULT AND SHOULD BE WARRANTYOUR SERVICE TECH EXPLAINED ONCE AGAIN, WARRANTY EXPIRED, TOPSOIL WAS NEVER BROUGHT IN AT HOMEOWNER EXPENSE OF DEPTH ISSUESTHEREFOR WE PROCEEDED TO COLLECT PAYMENT*** *** THEN BECAME VERY IRATE AND STATED, HE WANTED A YEAR WARRANTY ON WORK THAT WAS COMPLETED 08/25/SERVICE TECH RESPONSE WAS CAN'T ISSUE A WARRANTY BECAUSE THE SHUTOFF IS STILL ABOVE FREEZING LEVELONCE AGAIN *** *** WAS ADVISED TO BRING IN TOPSOIL AT HIS EXPENSE*** *** STATED HE WOULD GIVE INVOICE TO HIS SISTER, BECAUSE SHE HANDLES THE FINANCIAL EXPENSESUPON RECEIVING THIS LETTER FROM Revdex.com AS THE BUSINESS OWNER, DECIDED TO CALL CITY OF AKRON PUBLIC UTILITIES TO SPEAK TO EMPLOYEE DARYL TO GO OVER FINDINGS AT LOCATION AT PORTAGE PATH AKRON, OHIO 44303, DARYL STATED ON AUGUST 3RD HE ARRIVED AT LOCATION AND TOOK A SAMPLE TO GET WATER TESTEDAUGUST SAMPLE CAME BACK THE WATER WAS CITY WATERDARYL ARRIVED ON AUGUST 6, TOOK METER APART, PUT A GAGE ON METER, PRESSURE DROP PSI, DARYL STATED HE TOLD MR*** THERE WAS A LEAK FROM CONTROL BOX TO METERDARYL STATED THAT HE DID NOT TELL CUSTOMER THAT THE WATERLINE PIPE FROM HOUSE WAS NOT INSTALLED PROPERLYTHE ONLY WAY TO DETERMINE IF HOUSE LINE WAS INSTALLED INCORRECTLY IS TO EXCAVATEIN RESPONSE TO CONSUMERS DESIRE RESOLUTION:
WE HAVE NOT RECEIVED PAYMENT AS OF 09/18/OF $500.00, THERE ARE NO FUNDS TO RETURN TO CUSTOMERWE WILL NOT ISSUE A WARRANTY BECAUSE THE SHUTOFF IS STILL ABOVE FREEZING LEVEL, ONCE AGAIN TOP SOIL NEEDS TO BE BROUGHT IN AT HOME OWNERS EXPENSE FOR DEPTH ISSUESIF ANY FURTHER QUESTIONS PLEASE FEEL FREE TO CONTACT REBECCA AT 330-773-

In reply to ABC Drain & Plumbing:
TOPSOIL NEEDED TO BE ADDED BY CUSTOMER
After ABC Drain's March 14, water line installation, Mr*** had six yards of topsoil added and graded over three days in June at a cost of $(see invoice)In spite of this, the water line still leaked at the point where ABC tied into the city curbbox, as the company confirmed in their statement
CITY OF AKRON PUBLIC UTILITIES
As far as what Daryl said to Mr***, and later to ABC, this is simply a case of our word against theirs
We know that when Daryl first came out to inspect the leak, he told Mr*** that just like the city service lines - some of which are 50-years old or more - the home water lines are also supposed to last a long time, certainly more than a year and a halfWhen we spoke this week to the Water Distribution Division supervisor, Doug, he also agreed that while there are often problems with old water lines, it was certainly unusual for a water line to leak after only a little more than a year
While no one wants to come out and say it, it stands to reason that after 60-plus years of brutal winters, with no problems, when something new is introduced to the system and it leaks, chances are that something was not done properly with its installation

Mr***'s sister, ***, made an online payment to ABC Drain & Plumbing by Chase Bank on September 4, with delivery guaranteed by September Chase shows check status as Sent, but Not CashedOn September 23rd Chase's Secure Message Center was contacted and they confirmed that a Good Faith Letter would be sent to ABC Drain in 5-business daysOn September 24th Chase Bank's Claims Department was contacted and their representative, Abbey, confirmed that the payment was sent and that a Good Faith Letter would be mailedIf for whatever reason the check has not been received, ABC Drain needs to contact Mr*** and a stop payment will be made with Chase Bank(Refer to attachements)
RESOLUTION
We believe that, warranty or no warranty, the company should be willing to back up their work - on the original installation and on the later repair
In the interest of resolving this issue, we would like to meet the company halfwayWe want a one-year warranty on the August repair - in case there are further problems with their work - and a fifty percent reimbursement in the amount of $
