Prices stated on shelf are correctly labeled in plain sight but the register brings up a diffrent price. Business would not honor the stated price and instead defers to a higher price stated by register. Items are in correct location with current labeled prices but staff would not alter or correct their mistake. Businesses should not be allowed to label one price but charge another at point of sale. 2016 Code of Alabama

Section 13A-9-42False advertising.

(a) A person commits the crime of false advertising if, in connection with the promotion of a sale, transfer, consumption or use of property or services, he makes or causes to be made a false or misleading statement in any advertisement addressed to the public or to a substantial number of persons. Multiple items are labeled wrong to include "Disarano". Cashier would not solve issue over price difference and the manager and owner are at fault and liable for false advertising practices. Complaints will be made to consumer protection, Phenix City Business Department, Alabama Beverage License Board and the local news until this matter is resolved with proper procedures and correcting of false price switching. If neccesary I will pursue this in small claims court.

(b) It is a defense to a prosecution under this section if the actor acts neither knowingly nor recklessly in making the false or misleading statement or in causing it to be made. The burden of injecting the issue is on the defendant, but this does not shift the burden of proof.

(c) False advertising is a Class B misdemeanor.

Desired Outcome

Store Credit Policy needs to be put in place if a price is listed on a shelf and clearly marked in the correct spot the store should honor that price as stated. Multiple customers have undoubtedly been affected by incorrectly altering prices at point of sale after advertising a lower price. Business should have license revoked for unlawful business practices, false advertising and allowing employees to upcharge customers. I will accept a $200 store credit as damages to ensure the business will fix the issue.

We apologize this was your experience in one of our ABC Stores. Excellent customer service is something we strive for every day. We would like to thank you for making us aware of the situation. Our policy is that if a shelf tag is not changed to accurately show the price of an item, regardless of what the register shows, the item should be sold at the marked price. That being said, our store employees do not have the capabilities to change the price on the register so the sale would ring up at the different price, but you would only be charged the displayed price. Through further investigation we discovered the store you visited had a newer employee running the cash register, the manager was not present at the time, and the employee did not understand the policy and procedure. However, due to your feedback, we were able to correct the error and ensure all employees are properly trained or reminded on policy and procedure in order to avoid any future incidents.

I appreciate your response however the training for all employees should already be present. The policy should clearly be posted with instructions for cashier and customer so this does not happen again. New employees or customers that are unaware will continue to have the same reccuring issue. A clearly posted laminated sign or policy at register could mitigate future problems. Customers should not have to correct a cashier, employee or manager on a clearly marked price. The policy is not clear to employees when your own system will not allow them to change the price or have the option. Although you have a partial solution it is still counterintuitive for both employees and customers and the best solution is to have a clearly outlined and in writing policy posted for all to see. Anything short of this is just something behind the scenes that may or may not be implemented properly by all parties involved. Thank you for your understanding and I hope that we can come to a respectable agreement that protects customers while providing guidance to employees.
