06-16-Dear *** ***:We are in receipt of ** *** rebuttal to our response filing regarding the above-mentioned complaintOur response to theirs in your correspondence is as followsABCC Drilling LLC had the documentation on file to apply and secure the drilling permits necessary to complete the drilling project, and was to be filed with the Ohio Department of Health upon arrivalThis was addressed with ** *** in written correspondenceEverything was in order to have the necessary documents processedIt was indicated by ** *** this was not acceptable, and they wished to terminate the contractAt that time, ABCC Drilling LLC offered to provide a sub-contractor to perform the work and began to enter into negotiations with local drilling companies in the State of OhioABCC Drilling LLC was informed at that time, the companies which were contacted, had been in negotiations with the filing party to begin work on the projectWhen the negotiations concluded, and the sub-contractors did not wish to do the work, ABCC Drilling then offered to complete the work, which was refused.Sincerely,

We are rejecting the response letter from ABCC dated 6-11-
and want to explain their failure to perform the work we contracted them for
and why we are seeking a 100% refund of our $5,depositABCC entered into a contract with us knowing they didn’t
have jurisdiction to drill wells in the State of Ohio. According to *** *** of the Ohio
Department of Health “We have no record of ABCC or *** *** being
registered as a Private Water Systems Contractor with the Ohio Department of
Health”. This became evident at the time
we terminate our contract with them and found the falsification of their permit
number on the *** County Health Departments permit form. ABCC misled us on their ability to do the
work legally. Looking back this was
evident in their attempts to sublet the work to other drilling contractors in
the area before we terminated their contractThere were no additional permits as they claim. There were no permit fees paid by ABCC. We ended up securing and paying for the
*** County Health Deptpermits they were supposed to have in their contract
to prevent delays on them starting. We
did receive an invoice from ABCC for travel costs to Ohio for permit purposes
that should have been part of their contract, but they never paid for any
permitsThe materials needed for these wells were part of the lump
sum contract with ABCC drilling. We did
not authorize or specify any change in contract price for additional materials
above what their contract said it included.
There was never an invoice, claim or evidence of stored materials given
to us by ABCC. There were no base
contract or additional materials purchased as they claimIn concluding a 100% refund of our $5,deposit is
expected based on ABCC not being able to complete the work legally, not
securing and paying for the permits they said they had included on their
proposal, and the fact that no materials or additional materials were secured
by them or give to us. There have been
no goods or services provided by ABCC Drilling Incto us that would give them the
right to keep and utilize for their benefit our $5,deposit. I have attached copy of the cancled check to veriy that ABCC has received our deposit

Review: We entered into a contract with ABCC Drilling of PA to drill wells in our Ohio housing development but could not get them to complete the work. After repeated promises from them to get started on several occasions for over a month, they ended up defaulting on their contract with us.Their website indicates they service eastern Ohio, however after we entered into a contract with them we found out that they hold no registration with the State of Ohio Health Dept. This registration number was required to be listed on the local health dept. permit, however they put their PA license number instead.Finally, at contract signing ABCC Drilling secured a $5,000 down payment from us to get started. To date they have not returned our deposit or have produced any proof or credible reason for retaining our deposit. They also verbally claim to have purchased some pump equipment with the $5,000 deposit, which they have not given to us.In closing, it is our opinion that ABCC Drilling, LLC should not be recommended for any work because of their unreliability and the fact that they retained our down payment of $5,000 without providing any work or purchased materials to us.Desired Settlement: We would like our $5,000.00 downpayment back or the equalivant value in pump equipment they claim to have purchased.
