Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below [To assist us in bringing this matter to a close, we would like to know your view on the matter.] Regards, [redacted] It's as if [redacted] sold me a used car that didn't runAnd when asked "how could you sell me this car?" he said, "well, you needed a car." Or better yet, it's as if I took my broken car to ***'s garage, he charged me 2,to put some welds on the head gaskets (some but not all of them), he showed me his work, I nodded and paid, I went to drive off, and the car wouldn't budgeAnd when asked how he could sell me on head gaskets for 2,he came up with the following replies: "You needed the welds." "It was rude for you to speak Spanish in front of me." "I thought you said your friend knew cars." "My mechanic didn't say I swindled you, he said someone else wanted to swindle you." "You have buyer's remorse." "What you really need is a new engine." "Well, why don't you sew me?" And that is the situation we are in now [redacted] looked at our bowing wall, he sold us on tuck-pointing, he gouged us, his men did an integrity-less job (remember the pictures of the walls with the decaying old mortar and unfilled line from my second e-mail?), and now he defends the fact that the tuck-pointing didn't do anything to increase the functionality of the wall by pointing his finger at everything and everybody except the problem we brought to him, the solution he gave us, and of course, himself If [redacted] doesn't respond, as he said he wouldn't, that's fineHe swindled us, and deep down he knows it

This is my last response to this unfounded complaint My mason never told Mr*** that I was trying to sell him anything He did refer to a ridiculous solution that some other contractor suggested which was Mr*** asked us about and that was to put up three vertical posts along that wall Both my mason and myself told Mr*** that would not hold back tree roots if that was causing the problem My mason then referred to that contractor as perhaps trying to take his money In fact, Mr*** originally asked me about a lot of different projects I recommend he not do some and others, I gave him detailed instructions on how he could do them to save money I do not need to take on useless jobs just to take peoples money Mr*** asked me to tuck point the wall The wall needed to be tuck pointedWe did the job professionally We did not cause any previous nor future "bowing" of the wall Again, Mr*** asked for tuck pointing, got an estimate, signed a contract, looked at the completed job and sent a check to me to pay for our services No matter what is done in the future to the exterior of that wall, the interior needed to be tuck pointed Mr*** has buyers remorse after he, his wife, and his friend, the "resident architect" made their independent decision to move forward on tuck pointing
Sincerely

It's as if [redacted] sold me a used car that didn't run. And when asked "how could you sell me this car?" he said, "well, you needed a car."
Or better yet, it's as if I took my broken car to [redacted]'s garage, he charged me 2,000 to put some welds on the head gaskets (some but not all of them), he showed me his work, I nodded and paid, I went to drive off, and the car wouldn't budge. And when asked how he could sell me on head gaskets for 2,000 he came up with the following replies:

"You needed the welds."
"It was rude for you to speak Spanish in front of me."
"I thought you said your friend knew cars."
"My mechanic didn't say I swindled you, he said someone else wanted to swindle you."
"You have buyer's remorse."
"What you really need is a new engine."
"Well, why don't you sew me?"

And that is the situation we are in now. [redacted] looked at our bowing wall, he sold us on tuck-pointing, he gouged us, his men did an integrity-less job (remember the pictures of the walls with the decaying old mortar and unfilled line from my second e-mail?), and now he defends the fact that the tuck-pointing didn't do anything to increase the functionality of the wall by pointing his finger at everything and everybody except the problem we brought to him, the solution he gave us, and of course, himself.

If [redacted] doesn't respond, as he said he wouldn't, that's fine. He swindled us, and deep down he knows it.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I was content with the work that [redacted] did at my house (and the 4,900 we had paid him) until his mason implied that [redacted] had swindled us for 2,000 dollars. This was after we had already paid [redacted]. His mason told me the tuck-pointing would not do anything to help uphold the wall. When I asked why [redacted] would recommend tuck-pointing, he responded "there are always people who want to spend your money." This of course implies, that tuck-pointing would not do anything, at all, to help preserve the wall.

We moved into the house in August '13 and [redacted] first came and saw the house in September. We had not seen any big rains at that point and we had not seen any water leaking into the basement. We did see a big bowing basement wall (2 inches as measured by Badger Basement Systems in October). If as [redacted] suggests, we were tuck-pointing to help keep rain out, then why didn't he suggest we take care of the cracks on the outside of the foundation? (see pics.) Afterall, now that it's spring, and we have seen some big rains, plenty of water comes in.

Furthermore, if [redacted] and his crew had honestly intended to properly tuck point the ineffective mortar, why is there still a line unfilled (see pic)? as well as a thin walls of slapshod mortar that the previous owner had put in (see pic)? as well as insulation breaking through (see pic)?

[redacted] had sent a crew back to my house because they failed to do a few things: fill in some of the lines in the basement wall, and put a third sister beam underneath the half of a basement beam they sistered ([redacted] had agreed to sister all sides but his crew did not do it the first time around).

Other problems we have had with [redacted]'s work: they left the original storm window frame on the windows so we were unable to remove the window screens. We did not realize this until this spring and when my wife contacted [redacted] over e-mail he ignored her. One of the window sashes came broken. One of the screens came broken. After the snow melted, we also found they had left garbage from the original window removal on the roof. Such as silicon and small broken pieces of wood (with lead paint). They are still on the roof in case anyone wants a picture (though it will be through a screen).

But this complaint isn't about the innumerable, and irresponsible jobs which [redacted] and his crew performed. The complaint is about the 2,000 we paid to increase the integrity of a basement wall, which later [redacted]'s mason told us was for absolutely no reason at all. None at all. Now [redacted] says it was for the rain? If it was for the rain, why with all of his experience, wouldn't he have recommended we also fill the gaps on the outside of the foundation (see pics)?

There are a great deal of dishonesties which [redacted] wrote in his response, such as who said what, and for how long, but those dishonesties aren't what this complaint is about.

This complaint is about 1. We came to [redacted] with a wall bowing two inches and wanted a solution. 2. He sold us on tuck pointing the "loose mortar" as a solution.  3. He did a bad job and then his mason came back and implied that [redacted] was swindling us and so it didn't matter what kind of a job they did. 4. [redacted] swindled us. 5. More than likely, [redacted] swindles other homeowners.  6. This kind of dishonest behavior should not be tolerated in our great state of Wisconsin, or anywhere else in the world.

Sincerely,

[redacted]

P.S. We only spoke in Spanish for a minute (our friend didn't speak English) and I translated everything for [redacted] so he wouldn't feel left out, but I get a serious sense of xenophobia from [redacted], and I highly recommend taking a Spanish course at the University if hearing Spanish makes him feel uncomfortable.

Regards,
[redacted]

[redacted] contacted me to do some lead abatement work at his home as he and his wife had a new baby arriving in the coming months and they were concerned about lead base paint.  [redacted] also obtained a lead assessment by a separate company.  I went through [redacted]'s house and recommended installing some replacement windows and doing some additional stabilization of some peeling lead paint.  [redacted] indicated he wanted to do the stabilization, so I gave him brief instructions on how to do the work safely and recommended his pregnant wife not be present while he did the work. At that time [redacted] asked me if we did tuck pointing work.  I informed him a member of my crew had beed a mason for over twenty years.  He took me to a room in his basement and said he wanted it tuck pointed and some internal support posts put up, as someone had told him that would prevent the wall from caving in.  I told [redacted] that it did not appear the wall had been moving lately, but that there was a tree growing outside and in front of the wall that has to be one of, if not the largest tree in Madison.  [redacted] was concerned with water seeping in through some visible cracks.  I told him that if he did not tuck point it that it would deteriorate if water was seeping thru.  I also told him that support posts would not hold back the wall if the tree roots outside were causing the problem.  If that was the case, I told him he would eventually have to take out the tree.  During this conversation, [redacted], his wife, and a friend from out of the country were present.  They proceeded to talk in Spanish for about ten minutes without including me in the conversation.  Eventually [redacted] told me "my friend, our resident architect, feels that you should tuck point only.  I told them we would grind out any loose mortar we found at the time and apply new mortar.  [redacted] signed a contract to have me do the work, which we did.  [redacted] then said he sprayed some insulation around the wall at a later date and that some new cracks appeared.  We went back, at no charge and tuck pointed everywhere [redacted] asked us to.  About six months later, [redacted] called me saying that he wanted his money back because tuck pointing did not structurally rebuild and reinforce the wall.  I told [redacted] we were not hired to reinforce the wall and that if the wall was being pushed in by tree roots, he needed to address it from the exterior, digging down and cutting away roots from the tree.  At no time did we tell [redacted] that tuck pointing would prevent the roots from pushing the wall in.  The wall needed to be tuck pointed before we started. I have no idea what [redacted], his wife, and his friend were talking about for ten minutes, but they decided to only have the wall tuck pointed.  I  gave them an estimate, they signed a contract, and we fulfilled the contract.  We went back and did more tuck pointing after [redacted] did insulating at no charge.  We had a crew of three working a total of 16 hours each finishing this project.  I feel we "bent over backwards" trying to please [redacted].  I gave [redacted] numerous ideas and advice on how he could do other projects on the house himself to save money. I stand by our work and am not interested in refunding money to [redacted] because he has decided that he should have spent his money on other solutions. It was his decision to proceed and freely signed a contract, examined our work, and payed us for the job that we were hired to do.
