employees there are loading vehicles and don't know what they are doing causing damage to vehicles and possibly injury or death to the customers. I left Illinois for vacation and stopped along the way to Abernathys because I had heard great things about them. Because I heard such great things I trusted this company completely. I asked 2 salesmen before I even started shopping if the trailer I brought and my Ford Focus would work to haul one of their side by sides. and when they both went out to look at the trailer quite carefully and they both said it would work. I felt confident that they knew what they were talking about. I waited 35 minutes for them to load the machine. they loaded it by fork lift and My 16 year old son told them they should load it with the heavy part closest to the car the car. they assured us it would be fine. they guy loaded it and quickly took off again. It was loaded and was off to the side of the trailer and my car about a foot off from being centered on this trailer. I had to wait another 30 minutes for them to come back and fix it. they still messed it up and it was not centered. which they said it would be fine. even promised it would be fine. we drove down the road and the trailer started swaying real bad at 40 mph after I hit a bump and I almost lost the whole thing. It was just me and my 19, 16,sons and 1 year old daughter. I have never had experience hauling a trailer. I repeatedly told the, that before I bought the side by side. they were nice as could be while I was buying the vehicle. no personality but they were answering every question I had, and seemed like they were taking care of me. I called them back to tell them that the trailer was swaying real bad and I was 6 hours from home and 8 hours from my husband who was already on his way to [redacted] WITH THE CAMPER. they knew all of this at abernathys. When I called at the time my only solution I could think of was to bring it back and cancel the sale. right away the guy said no you bought it, you signed the papers we are not taking it back. My Salesman said well I knew it wasn't going to work. but he was the second one to tell me it would. the manager I talked to when I called to tell them of the problems I was having told me his salesmen were not qualified to tell me if something would fit on a trailer. no other solution. nothing.... I started crying because I didn't know what to do and after no other option except maybe they could haul it home for me for a hefty price which they decided they couldn't do because it was too far. I had had enough and told them I was going to plaster their name around because they left a mother and her 3 kids stranded with a side by side they knew wouldn't fit on the trailer. but just to make a sale they lied and now are heartless. the ,manager told me to go ahead and do that and he would sue me for slander. I told him to do what he wasnted to do and hung up on him. I had 3 employees working at a uhaul that heard the whole conversation and they gave me their names and phone numbers and said they would testify If I needed them to if anything happened because after losing 2 days of my vacation up to that point the uhaul people not Abernathys found why my trailer was swaying so bad. Abernathys loaded the side by side with the heavy part away from the car. my car is a front wheel drive and not to mention the trailer was not loaded evenly. within minutes when I got someone who knew what they were doing and I had to drive it like that for another 50 miles and almost 2 tanks of gas it was fixed and we were going down the road. 21 mpg instead of the 2mpg I was getting after they loaded the camper. It burned the bottom of the trailer that I borrowed and wore the tires on the trailer and bent one of the axles. I managed to get it to Bristol. I called and talked to the big boss and he did apologize and said that his manager is only human and that he listened to the whole conversation. on the way home from Bristol we had a blow out and the axle broke on the trailer. we ended up by husband had to drive back from [redacted] with a trailer he rented from uhaul Desired SettlementI feel this whole thing was caused and could have been prevented or at least fixed by abernathys so that none of this would have happened to me. they are not qualified to load vehicles or to tell people things will work then they should not being doing it at all. or train people to do the job right instead of sending people out with something that can potentially kill people. I would have respected their opinion if they thought it wouldn't work. Uhaul wont let you leave with even one of their trailers without making sure its safe for your vehicle. a resolution would be to change the policy there to keep customers and others on the road safe. train your people to load things right. the head boss there even said they are not qualified to load vehicles. they don't specialize in loading trailers, just specialize in side by sides, motorcycles, and 4 wheelers. yet they load and unload these pieces of equipment daily. abernathys by rights should pay for at the least the extra hotel stay 72.00 and 26 gallons of gas (2 tanks)accually a little more than that but not by much I wasted until I got the camper issue fixed. and I wish they would pay to replace the axle on the trailer, and both tires that were worn down. One that had the blow out because the tires were rubbing on the trailer for 50 miles. and the gas for my husbands truck because he had to drive another 5 hours to get a uhaul and come back to pick the side by side and the broken borrowed trailer and they should the uhaul rental fee. Many people said since that that the trailer would have been fine if it had been loaded right in the first place. the tires were brand new when I took the trailer from Illinois. they wore down in the same spot they were hitting the trailer, and the axle was most likely damaged because of the trauma on the side by side being loaded wrong. I was minutes away from Abernathys when I called them for help. I had to travel miles more after they denied me help. Please understand when she asked if her trailer would be sufficient to haul the UTV, we could only assume since it was large enough to hold the UTV, that it was capable of hauling it. Unlike [redacted] we are in the business of selling ATVs, UTVs and motorcycles, not renting trailers, thus that is where our experience lies. There has to be some responsibility to the customer to make sure they bring the appropriate means to haul their purchase home. This is the first time this has ever been an issue at our dealership since opening the doors in 1955. We offer to come and get the vehicle and take it somewhere within a reasonable distance for the customer, but delivering it to her house 6-8 hours away was not feasible. The only option we were given by the customer was to take the vehicle back and void the sale. Unfortunately, in the world of computers, her financing contracts, and warranty registration of that vehicle were done instantaneously once submitted online and could not be undone. There is no return policy here at Abernathy's on vehicles, nor is there any law in Tennessee stating that you may return a motor vehicle if dissatisfied no matter how much time has passed. As far as loading it on the trailer, again, since we are not in the business of trailers such as U-Haul we can only do our best to load vehicles if the customer requires us to do. We help load vehicles as a convenience, it is not a requirement for us to do so. This is why we have all customers sign a Loading/Unloading waiver that states we will help you load or unload the vehicle if you need help, but will not be liable for damages resulting in us doing so. Mrs. [redacted] signed such a waiver and a copy can be produced if needed. As far as the conversation with the manager, he tried to help Mrs. [redacted] with ideas for getting her vehicle back home, but she only wanted to return it which was impossible. This infuriated her and did bring her to tears, which again, we are sorry it happened. I am truly sorry that this happened as we strive to make every experience a pleasant one, but we cannot be held responsible for the equipment customers bring to haul their machines back no more than we could the amount of gas money they bring to buy fuel home for the return trip. If you buy an ATV from us and tell us your going to push it home, we cannot stop you as this is a free country, even if doing it seems odd to us.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)First of all I never once asked them to load the vehicle for me... that's where they are dead wrong..... My Son was going to load it and he was stopped by the salesman... he was told no that they would load it with the forklift. I do not remember signing a paper like that and in my state any paper I sign I am to be given a copy of it. I don't know what the law is in Tennessee, but either way I did not receive a copy of that, nor is there anything written anywhere about a no return policy after 15 minutes, or 90 days... nothing.... you see yourself where they state they are not qualified to load the equipment they are selling. and that they don't care after you buy the product its your problem. I do not believe they have never had any problems before. theres a reason they make people sign a waiver if in fact they do... something has happened for them to have changed the policy. he even told me they changed the policy because of issues they had. that was the head guy there. I will not except this resolution. and the only responsibility I take is for making the mistake and going to Abernathys to buy the side by side. I am standing up for myself and not letting them strong arm me anymore. the only resolution you guys offered was to charge me hundreds of dollars to haul it somewhere for me but not 6 hours away. the only solution I knew was to return it.. no one offered to help any other way. But outside of Abernathys... every step of the way people in the great state of Tennessee people bent over backwards to try and help us when it should have been you guys. I spent nearly $10,000 at your store and this is what I get. so for the world to see.... I DO NOT EXCEPT YOUR RESPONSE!!! If I excepted this response I would not have filed the complaint here...

I purchased a motorcycle from this dealer,it was not what I was told it was,by the salesman.There where certain modifications on this bike,performed at this dealership,that where not done ,like the sales person had described. This is now costing me several thousand dollars to fix it, like it was supposed to be,when I purchased it.Product_Or_Service: Harley Davidson motorcycleDesired SettlementThis company needs to step up and pay the bill at another dealership.Business Response We cannot find evidence other than Mr. [redacted]'s word that he purchased a motorcycle that was made to be something other than it was. The owner of our company himself spoke to Mr. [redacted] about the motorcycle before Mr. [redacted] left with it about all the modifications that were done. The modifications Mr. [redacted] claims he were told the bike had are not anything we have done to any new motorcycles that were put up for sell that year and the salesmen he spoke to other than the owner is no longer with our company. We did speak to him and he said he never told Mr. [redacted] that. We offered to sell Mr. [redacted] the parts he wanted at a substantial discount and he agreed, but then called back and felt he should have them for free. We cannot give out a few thousand dollars worth of parts with something showing we mislead him. The print out of parts that were added to his bike was given to him at the time of purchase and it did not show the modifications he said we told him it has. We have been unable to resolve this to Mr. [redacted]'s satisfaction as we cannot agree to give him parts based on just his word. We are sorry the sale went south perhaps if he would have notified us prior to having the bike for nearly a year without hearing of any issues, something could have been done earlier.

Sale was done before having a clear title Sale was done before having a clear title in their possession. as I was told they were having problems getting the title from the lienholder in another State, temporary tags were expiring so I called to see what the problem was advised they had problems with the small town bank in Missouri. Made several calls trying to resolve the problem as we were not satisfied with purchase, in turn we took the motorcycle back and received $4500.00. We purchased it for $5,894.00 and do not understand why we were given back so little when we still didn't have a title, even to try and sell it outright for a decent value. I believe the saleman was just interested in his commission and we were not explained about the title issue coming from Missouri until after I called several times. I just want to be fair and receive a decent value. Desired SettlementI feel like that I should be reimbursed a fair book value of the motorcycle as like when I purchased it.Business Response The motorcycle was purchased with the understanding that we handle the title process for TN residents. During the title process, the Grandmother stated the customer was scared of the motorcycle so wanted to discuss selling it back. The Grandmother and customer called wanting to know what we would offer to buy back the motorcycle. An offer was agreed on, the motorcycle returned and the check was cashed by Grandmother and customer. At no time did the customer or Grandmother express dissatisfaction with the purchase price or deal agreement.

July 2012, I purchased a 2012 [redacted] motor cycle. Since I have owned it, it has been in the repair shop 5 times for electrical related issues. #1 - August 2012: bike dies while turning left (had right away) in the middle of a 6 lane intersection, would not start, no power. Loss of power, lights, dead in the water. Dealership picks it up, checked it out, and said the BCM was not plugged in, blaming it on their mechanic. They fixed and returned the bike 3 days after they picked it up. #2 - August 2013: bike dies while turning left in the middle of a 4 lane intersection, would not start, no power. Loss of power, lights, dead in the water. Dealership picks it up, checked it out, and said the BCM was bad, fixed and returned the bike 2 days after they picked it up. #3 - August 2013: couple days after they returned it, the bike dies while turning left (had right away) in the middle of a 4 lane intersection, would not start, no power, same as before. Dealership picks it up, checked it out, and said the BCM was bad. While they had the bike, another BCM went bad. I get a call that they are looking at replacing the wire harness. Instead, the regional service bigwig, says no, orders a different BCM and they put it in. They fixed and returned the bike 2 weeks later after they picked it up. I ask them to buy the bike back and I would purchase a new one. Their counter offer, we will give the trade in value for it?? My comment I didn't buy it at trade value. They refuse to work with me on replacing the bike. Sent a certified letter to corporate headquarters to the owner of[redacted]. NO CALLS, NO REPLY, NOTTA! - Still today. Call the corporate ##. Get a customer service rep, passes ** off to a Case Manager, talked, got no where with him. The regional maintenance supervisor, calls and gives me a 2 year extended warranty for free, with a $50 deductable. #4 - June 2014: All the power to the speed odometer quit working. #5 - July 25th: New speed odometer quits working.Product_Or_Service:[redacted] Motor CycleDesired SettlementRefund all my money to include taxes and work fees for 1000 mile service and new pipes. I want my engine guard.This is a continuing issue, and I don't feel safe on the bike! This does not cause motorcycle to stall, turn signals will still work, the indicator on dash was not functioning. We have checked it again and a wire was broken from speedometer to turn signal indicators have replaced wire harness. The first problem with BCM was that we received a faulty one and then they were on backorder, I did contact factory and got one sent to us. On turn signal issue there was two problems, one with speedo and one with a wire, we did miss the wire the first time but is now fixed. I realize the customer has had a couple issues with this but I feel that we have done every thing we could by repairing in a timely manner and also making 220 mile round trips with each issue to pick up and deliver.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The first three times I had issues with the motorcycle, it died while riding it, and yes the lights, turn signals, ignition system, speedometer would quit working. When the bike died, I had to haul it back to the house. Basically everything electronic would shut off. I was told it was due to the BCM. The 4th and 5th issue the speedometer quit working. The lights still worked and it would start.The 4th issue, they replaced the speedometer, and returned it back to me on 9 Jul 14. The new speedometer quit working again on 25 Jul, they picked it up on 29 Jul and returned it back to me on 11 Aug 14. I have not received the paperwork for the repairs this last time, being mailed to me. I do not have an issue with the service department, they have gone out of their way to take care of picking the motorcycle up and repairing it, they have went above and beyond. My issue is the product, motorcycle has been in the shop since I purchased, due to electronic issues 5 times. Attached are the past 4 service tickets. Final Business Response I have spoke with the general manager and we can not buy back the customers motorcycle. If he wants to trade it in on another we will give him fair market value on trade. He the customer will have to go through[redacted] for a buy back
