Initial Business Response /* (1000, 5, 2017/08/02) */
The client received his policy, based on his old address and paid in fullThe policy was then amended to his new address, which is in a different rating territory resulting in an additional premiumInsurers base rates on the location of the
risk and rates are filed and approved by the public utilities board
Initial Consumer Rebuttal /* (3000, 7, 2017/08/02) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The new address was given prior to the renewal as I was buying home insurance at the same time*** Lorway had my correct address before giving me the total cost of the auto insurance, which I paid
I have a signed receipt stating the policy is "Paid in Full." There is nothing on the receipt stating anything about additional future charges
Final Consumer Response /* (4200, 11, 2017/08/05) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I was never informed the price would be changing after the policy was renewed, after taking the option to pay for the year in fullI was not given any documentation from *** Lorway indicating a future charge of $**I was given a signed receipt stating the policy is "Paid in Full."
The address change was not made mid-termHypothetical situations are not relevant
The new address was given and the new travel distance to work calculated before the policy renewal, before I was given the total to pay, before payment was made, before receiving a signed receipt stating the policy is "Paid in Full."
Final Business Response /* (1000, 21, 2017/08/21) */
***,
Further to your questioning of the additional $** premium owing and your two complaints to the Revdex.com, we seek to restate our position to you so that you will finally accept that it is has been assessed to you legitimately within our regulatory environmentWe are providing copy to the Revdex.com as a response to the second complaint and expect this matter to be closed to our satisfactionWe are further providing copy to ***, your insurer, and the Nova Scotia Superintendent of Insurance
In the more than years we have been in business, yours is the first complaint filed against usWe consider it a frivolous complaint as you have not accepted the legality of the chargeWe hold ourselves to the highest ethical standards and maintain that we have served your faithfully
Insurance rates are filed by the insurers with the regulator and are determined by territories within the provinceWhen you "paid in full", the address for your auto policy was on Windmill Road in Dartmouth and thus rated for the Dartmouth territory and assessed a rate accordinglyYour auto policy renewed on May 21, and you made payment in full on May 18, Subsequently, you purchased a new home, which closed on May 24, You were not a resident of that property until the closing date and thus the policy could not be amended to reflect the new address until that timeOn May 24, 2017, we notified ***, your insurer, of the change of addressThey rerated your policy based on the new address resulting in an additional premium because Lower Sackville is in a different (higher) rating territory than DartmouthPut in simple terms, an insurance policy is a contract between the insurer and the insured (you) and if there are changes to the contract (i.e., a change of address), the contract has to be rewritten subject to the changesAs you changed the terms of the contract three days in to the new policy term (the car will now be used from *** instead of ***), the cost to the deliver the contract increased slightly
None of the above is new information to you and we have detailed the correspondence between us belowWe have also attached copies of the correspondence to this letter for your files and to support our response to the Revdex.com
On June 1, - *** *** issued your endorsement based on the change of address
On July 19, - *** *** reached out to you by email requesting that your balance of $** be paid
On July 21, - You replied by email that you had paid in full and were not required to pay the $**
On July 21, - *** *** replied and explained why you owed the additional premium
On August 1, - email from *** *** reminding you of the outstanding balance
On August 2, - You replied that you were busy and you would get back to us later in the week
On August 2, - You filed a complaint with the Revdex.com
On August 2, - *** *** responded to your complaint
On August 3, - You requested to move your insurance to our *** location
On August 3, - *** *** explained that we can't make a move mid-term
On August 3, - You requested that your policies lapse on renewal
Nonpayment of the outstanding balance of $** requires that we cancel your policy for non-payment and insurers typically assess surcharges to any insured that has previously been cancelled for non-paymentPlease consider this carefully as the amount owing is now more than days past due
It is our opinion that you have created unreasonable nuisance and we are pleased that you have chosen to move your business to another insurance provider at the end of your term
You have made reports to the Revdex.com on two separate occasionsAny further report will be considered harassment and we will have no choice but to refer the matter to our solicitors
Yours truly,
*** ***
