We have reviewed our records for the concerns in *** *** 6/23/letter. A specific answer to each item is below. Also included is a photo showing the front of this homeThis photo, taken from the street, shows the overall condition of the home and its appearance without abstractly zooming in on any one spot. Our responses to the concerns raised in the letter are: The customer states that the lawn is unacceptable. Attached is a photo of the exterior of the home showing the lawn in context. While there are some areas that will be topdressed and adjusted, overall the lawn is healthy and growing. This work cannot be done before or after a storm which has been occurring on a regular basis.The customer states that the gas fireplace does not work. The fireplace and the blower work properly. The customer is unhappy that the rheostat to control the blower is inside the fireplace. Due to the location of this control you cannot adjust the blower speed while using the fireplace. We have agreed to find a solution to this concern. We are working with the fireplace installer to determine the best way to make this change.The customer states there are many broken shingles. There are a few damaged shingles on the porch roof. The roofer will replace the damaged shingles. There are no leaks in the roof.The customer states the end of driveway has two cobblestones on either side that stick up and are dangerous going in and out of driveway. The customer does not like the way the Belgium block curb slopes down to meet the driveway. Again, while not a defect, we have agreed to change this for them.The customer states the stone work on the front of the house is not finished. The stone installer has been to the house and taken photos and measurements to have stone made to fill some small voids that the customer does not like. Once the stone is manufactured it will be installed.The customer states that the stone work is improperly installed causing one shutter to stick out. One shutter block in the stone is not set properly. When the stone installed returns for #above he will fix this also.The customer states the master bathroom shower door rattles and bangs. The door is held closed with a magnetic latch. A certain force is required to open the door. The door is not defective. This is the same door that is installed in our model home.The customer states siding is falling off the back of the house. There is a piece of aluminum trim around a window that became loose during a storm. It was removed to it would not blow in the breeze and is being replaced. This is a cosmetic piece.The customer states that there is a 4’x6’ area of sheetrock that is unacceptable. The sheetrock concerns have been addressed. This complaint meets the standard of the Residential Warranty Corporation guidelines which were included in the documents provided at time of contract. We continue to make progress in addressing all of the concerns that *** *** and *** *** have. Many of these items take time. The exterior picture of the home taken from the street show that the home is being enjoyed and lived in. While some of these issues do need to be addressed they do not affect the ability to live in the home or the habitability of the home. We request that at this time *** *** review the Residential Warranty Company standards for his unresolved concerns. A copy of the building standards were included in the documents provided to the customer at the time they signed there contract. We take great pride in each home that we build. We also take customer feedback seriously and look for ways to enhance our customer experience. We sincerely apologize that we have been unable to address all of the concerns in the timeline that the customer would like but many facets of a new home involve many people and need to be researched or ordered before being addressed

We delivered the home at *** *** *** on 4/17/15under a temporary CO as described in the contract. After the closing the exterior itemscontinued to be worked on. On 5/16/wereceived the customer’s day punch list. On Friday 5/29/we received a certified letter
regarding the daypunch list. We responded to the letteron Monday 6/1/15. Phone calls back andforth prior to and after the letters resulted in a meeting on Wednesday 6/10/15to review the punch list. The owner ofthe home would like the work done after they are finished with work for thesummer. A follow up meeting is scheduledfor 6/15/15. Unfortunately it is notalways possible to have all work completed as quickly as everyone wouldlike. The items listed on the punch listare generally cosmetic in nature and do not affect the livability of thehome. Building a home brings togethermany different people and trades. Eachpurchaser has different expectations. While we try to meet everyone’s expectations we also deliver each homewith an independent warranty to allow a customer to have documentationregarding what meets industry standards as well as provide the customer withsomeone to call if necessary. We canprovide a copy of the list if you would like. We treat all of our customers with the same respect and dignity. It is our intention to continue to work withthis purchaser to address all of their concerns in as timely a manner aspossible

I am rejecting this response because:  OF THE FOLLOWING .The front of house picture looks good due to the hard work we have done fertilizing, planting and massive amounts of water using our sprinklers.  OF COURSE THEIR ARE NO CLOSE UP PICTURES OF ALL OUR COMPLAINTS THAT ARE NOT BEING DONE IN A TIMELY MANNER.I AM SENDING PICS OF SIDE AND BACK YARD WHICH IS A MAJOR SWAMP AND POOR DRAINAGE,  WE CAN NOT DO ANYTHING WITH DUE TO THEIR SLOW PROCEDURE IN RESPONDING TO OUR COMPLAINTS. THEY HAVE ALL THE PEOPLE HERE WORKING SO THERE IS NO REASON WHY THEY ARE NOT COMPLETING THE WORK. THEY CAN NOT GET CONTRACTORS BACK BECAUSE THEY SIGNED OFF ON THE JOB THAT EACH SUB DID !!!WE PAID FOR A GAS INSERT WITH A FAN KIT -FBK-200. IT IS NOT INSIDE THE FIREPLACE ,THEREFORE IT CAN NOT WORK. WE PAID FOR THAT FAN KIT AND AN ELECTRICIAN TO PUT IN TWO SPECIAL SWITCHERS ON THE SIDE OF THE FIREPLACE. THE KIT IS NOT THERE. WE HAVE PROOF WE PAID FOR IT .  I HAVE PICS THAT I WILL BE FORWARDING WITH ALL MY REJECTIONSTHERE ARE MANY BROKEN SHINGLES. THERE ARE OVER 100 NAILS ON THE ROOF IN VARIOUS AREAS. IN THE BACK OF HOUSE OVER THE BILCO DOORS THERE IS A SHINGLE NAILED IN AND STICKING OUT ABOUT 5 INCHES AND IT IS RUSTY.THEY CAME ABOUT 2 WEEKS AGO FINELY TO TAKE PICTURES OF THE UNFINISHED STONE WORK ON FRONT PORCH AND ALSO ALL THE MORTOR THAT HAS RUINED THE PORCH. THE SUB CONTRACTOR SAID HE WOULD SHOW IT TO HIS BOSS AND FINISH THE FRONT PORCH. THEY HAVE BEEN ALSO WORKING IN THE AREA BUT HAVE STILL NOT RETURNED. ALSO THEY NEED TO TAKE CARE OF THE AREA AROUND THE SHUTTER THAT IS DAMAGED. THIS WAS NOTED ON APRIL 11TH WALK THRU.THE SIDING WAS REMOVED OVER 2 MONTHS AGO BECAUSE IT WAS INSTALLED IMPROPERLY AND BANGING AGAINST THE BACK OF HOUSE. . THEY TOO ARE WORKING ON THEIR HOMES IN THIS AREA AND HAVE NOT FIXED IT. LAST  NIGHT ANOTHER ONE IS HANGING HALF OFF.THEY CAME IN AND SPACKLED OVER 300 HUNDRED AREAS. THEIR SUBS ARE NOT DOING PROPER WORK OTHERWISE THAT WOULD NOT HAVE HAPPENED. THERE IS AN AREA THAT THEY MADE WORSE BY TRYING TO FIX IT. AGAIN WHERE DO THEY FIND THESE SUBS AND THEY SHOULD NOT BE SIGNING OFF SO QUICKLY ON A VERY EXPENSIVE HOME. WE WILL BEHAPPY TO SHOW OUR HOME TO ANYNEW BUYERS THAT ARE INTERESTED IN SEEING THEIR SO CALLED "QUALITY " BUILT HOME.IF SEGAL AND MOREL TAKE GREAT PRIDE IN THEIR WORK THEY BETTER START KEEPING A BETTER WATCH OVER THEIR BUILDING OF THERE HOMES. THEY HAVE HAD ALMOST THREE MONTHS TO FIX THE COMPLAINTS AND SHOULD HAVE HAD THIS RESOLVED BY NOW.I WILL BE SENDING PICS IN ANOTHER EMAIL
