My complaint is as follows. I was moving boxes from my garage to the out building in my back yard. When I had finished, my van became mired in the mud. I called my Roadside Assistance with Verizon Wireless and about an hour and a half, a tow truck came. He proceeded to put heavy chains and hooks underneath my van. One hook was put underneath my van midway the driver's side. His equipment began to slowly pull my van around. Then he put the hook and chains underneath the back side of my van, under the trunk. Slowly, the van was pulled out of the mud onto my driveway. I asked for a receipt, he didn't give me one. He said everything was done through computers (?). As I drove my van to the car wash to wash the mud off, I heard this very loud noise coming from underneath the left side of my van. I called Humboldt Chrysler Dodge Jeep, in Humboldt, TN, (12 miles away), and asked to bring my vehicle in to be checked. After checking out the vehicle, the dealership showed me where the left leaf spring had been pulled out of shape. This is when I called the towing company. The owner wasn't in at first, but when I called back, I spoke with him. A representative from the dealership spoke with him also. This is when he lied and said the guy took pictures. ("Pictures for what"!!!???). First lie. Then he told me that I'd better call my insurance company, because he was not responsible for the damages. I took the van into the dealership the following day (2/4/2014). I was told that the cost for repairs will be $247.32.Desired SettlementI am in the process of paying for the repair damages ($247.32), as my vehicle is needed for work, and my daughter uses the vehicle to commute to and from college. I contacted my insurance company. After investigating my claim estimate, they advised that it would cost more using my deductible than the actual cost of repairs. The claim was closed. [redacted] is the owner of the towing company. He stated to me that although he has insurance coverage, he wasn't going to pay for the damages. Business Response In response to the complaint filed against me and my company, Able's Towing, First, Ms. [redacted] got her vehicle stuck in the mud. I was contracted by her insurance to winch-out her vehicle, which I did. There may have been damage to the vehicle during this process, but it was not because my driver hooked up the cables incorrectly. The damage came from due process. As far as her not getting a receipt for the service, she did not pay for the service, she was not out any out-of pocket expense, the receipt is for the insurance company who paid for the service. And last during my conversation with Ms. [redacted], I explained to her that if she was convienced that my driver was to blame for the damage to her vehicle there were proper procedures. She could file a claim with my insurance, but that is not what she wanted, she just wanted me to reimburse her for the repair bill. Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I DO NOT accept the response from Able's Towing Company because the only accurate part of it is the fact that my vehicle was mired in the mud, and a driver from the company came to my home and pulled my vehicle out. The towing company was contacted by [redacted] Wireless Roadside Assistance (NOT MY PERSONAL AUTO INSURANCE COMPANY). "HE (the owner) ADDED THAT THERE MIGHT HAVE BEEN DAMAGE TO THE VEHICLE, BUT NOT BECAUSE HIS DRIVER HOOKED UP THE CABLES INCORRECTLY "Well, my question is, " where did the damages originate from"? "I didn't damage my own vehicle". He (the owner) added that the damages came from "due process". I don't understand "due process". I am enclosing copies from the dealership-- Humboldt, Chrysler, Dodge, Jeep; their assessment and estimates of the damages (the causes of the damages); and cancelled checks and receipts showing my payments to the dealership for the repairs. As of date, I owe $100.00 more and the repairs will be paid in full. I have also contacted [redacted] and made them aware of my proceedings with the Revdex.com and the Consumer Complaint Dept. with the [redacted] of [redacted] Since the towing company did not give me a receipt, invoice, or contract for this service, I am waiting for [redacted] to do so.Filing a claim against his insurance would involve my personal homeowners automobile insurance. Per my personal homeowners insurance, my deductible would far exceed the cost of damages/repairs/costs to have my vehicle repaired. My personal homeowners insurance is not involved in this complaint. The complaint is between the towing company and me. I am requesting a full refund from the towing company, as I will have paid Humboldt Chrysler Dodge Jeep for the repairs ($247.32). I stated that [redacted] road side services dispatched this call and attached please find the fax dispath . Also please find attached a copy of the receipt that [redacted] refused to sign . As I indicated in my previous letter , the receipt is for the person paying the bill . If [redacted] would like a receipt , I recommend that she ask [redacted] for that . It's obvious that [redacted] has been very hard to work with from the instant we arrived to recover her vehicle . Starting with her not signing the receipt and this was before she even knew her vehicle had a noise from her suspension. In the business of towing and recovery , we run into various situations on a daily basis . We remove vehicles from ponds , ditches , wood lots , obstructed highways and etc. In performing these duties we make the best judgement calls according to that drivers experiance . [redacted] is very quick to call someone a LIER , when in fact I only asked that she follow proper proceedure . As I stated in my previous letter , when a vehicle needs to be recovered it's because the driver put that vehicle in a situation that it was not designed for. In this case it was off pavement , in the back of a lawn after a rain . If it pleases [redacted] and the Revdex.com I will agree to half of the repair bill . Although the cause of this repair was that [redacted] stuck her mini van in muddy terrain . I have been the owner of Able's Towing for 4 years and 2 other companies for more than 10 years . The driver [redacted] and I have worked together to keep ALL of our customers happy. I will look forward to a response , have a great day.
