this is a responce to the complaint case# XXXXXXXX. The apartment complex manager was notified by the manager of family dollar,...

[redacted] that no vehicle is allowed to park in the family dollar parking lot unless they are a customer or employee of the store. due to the overwhelmeng amount of trash and debre and illigel activity after close of business hours. we have posted two signs by each entrance 48 hours prior to any impound. we have a 24 hour signed contract due to the the regulatory compliance manager, [redacted] due to people parking in the parking lot where the empoyees can not get out of their vehicles in the morning, due to company rules, untill security has cleared the parking lot for the employee to be safe to get out of their vehicle. The vehicle is not registered to the consumer who has filed the complaint against my company. the comsumer who came to pick up the vehicle, to my understanding, was a boyfried of the person who owned the vehicle. that person could not show up because that person was at work, who we spoke to on the phone. where the consumer pleaded with us to realease the vehicle to him because the girlfried was already at work. our yard opened at 9 am that morning of 7/27/2015 and the consumer did not show up till around 11:30 or so. We have pictures and a signed tow slip and a letter from the family dollar manager stating the purpose of the impound. As for the complaint of the charges and fees the city of colton impound charges are $250.00 which every tow company follows. the vehicle was picked up sunday morning at 4:12 am and the consumer did not call my company untill 6:30 pm in reguards to the vehicle. Our tow yard was closed so we made arrangments to have the vehicle picked up the next day, which at that time was an additional $50.00 storage fee. and the vehcile that was removed off the property with a flat bed tow truck and the use of go jacks due to the vehcile tires being turned to the right. the vehcile was also lowered and our driver did not want to damage the vehcile so there was an additional charge of $35.00 for the go jacks for safe removal of the vehicle. for a total cost of $335.00. we do not feel that we should have to pay wages for the consumer due to the fact that the vehicle does not belong to the consumer filing the complaint. the registered owner of the vehicle impounded was already at work. I feel that my company has followed all the rules and regulations for colton's impound procedures. if you have any further questions or need any futher information please feel free to reach me at XXX-XXX-XXXX
Initial Consumer Rebuttal /* (3000, 10, 2015/08/18) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not for one simple fact. I have pictures of the signs they supposedly posted at the entrances if the parking lot. There are 2 separate entrances and only 2 signs total were posted in the parking lot. Neither one facing the entrance to the parking lot. And after I turned in the complaint to the Revdex.com. The towing company moved one of its 2 signs to the other side of the parking lot near the main entrance. Yet they still failed to face the entrance as you pull into the parking lot. This company knows they are liars and knows that they are crooked. And I'd be glad to provide the pictures to dispute their claims that they are really following the state laws. And even after they moved the 1 sign they still fail to meet state laws. Again I'd be glad to provide pictures of the parking lot and the signs they posted to prove that they do not meet the state laws. THANK YOU
