Revdex.com received phone call from Timothy B*** stating he has decided to provide a refund of $and will put a check in mail on Monday, August 28,

Received deposit refund check for $320 on August 31st; will cash it today (9/1).Thanks for your help.

I am rejecting this response because:  inaccurate stating of several facts by Tim B[redacted] (owner of Above & Beyond Painting), AND refund offer is short of verbal offer made May 9th to return unearned deposit.  Specifically...1)  Response by Tim B[redacted], wherein he did *not* view meeting again (in May) was important (he used the word "inexcusable"), and could be done via email is poor business practice.  When an exterior painting project involves review of the project and paint colors, six months later since September 2016 when original project scope was discussed, it is never inappropriate for the homeowner to want to verify everyone is on the same page; this is a large amount of money, and color and project scope is critical before starting; no one wants to pursue a change after the project is well underway (that would not be a good experience).  Thus, to not be able to coordinate schedules by the contractor signifies to me, that the customer is not valued.2)  Once I cancelled, I did *not*, ever say yes or request to be back on the project schedule.  Tim B[redacted] offered via text to put us back on the schedule (Thursday May 11th); wherein on Friday May 12th, I texted that "Thanks for reconsideration; but I am sorry that I understood you would not perform the work, so I pursued another painting company; they provided an attractive bid proposal; arrangements are underway to move forward."  The entire record of the text messages is/was provided as part of this complaint, and can be viewed therewith; it does *not* fully match with Tim B[redacted]'s listing of the events.3)  Text message, dated May 9th (at 3:38 pm) from Tim B[redacted], stated he would "send the $320 deposit back within the next 30 days."  Following up with him on Monday June 5th about the $320 refund that was not received, Tim B[redacted] started his variation of refund responses (see text message log) wherein he reduced it to $160; then to no refund; and with the complaint reply, now $160.Note:  Please refer to the "Text Messages" log attached to this complaint, for an accurate recording of the communication efforts since cancellation.Thus, is $160 acceptable to me?  The Revdex.com can now read Tim B[redacted]'s offer via his response on the complaint; and $160 is better than none at all.  If Tim B[redacted] wishes this complaint filing to be removed entirely and/or considered resolved, then a prompt refund of $320 will accomplish that.

-Went in contract with Mr. [redacted] in the Fall of 2016-I mentioned before signing that if we cant provide services before the cool temperatures appear we would complete project "by the end of the spring of 2017" made it very clear I would need to the end of the spring because of other projects I...

had already scheduled. Also offered to reduce the price if homeowner had to wait. -Mr. [redacted] agreed to $500.00 non refunded deposit as it states on contract that all signed documents deposits are not refundable. However if I see the excuse for the terminating contract is legit, my being a honest fair business man. I could refund full deposit. -weather did not permit my company to complete project in the fall of 2016 -Mr. [redacted] reached out in the spring of 2017 to make sure we are set to go I told him we would be there soon to pressure wash and schedule the project to be completed by the end of spring as promised -After pressure washing I reached out to the revisit the contract to make sure we are clear of the scope of work and go over other choices. This is simply a professional suggestion on my part, nothing did not have to happen Mr. [redacted] could have just simply sent via email or text. I Understand the scope of work that needed to be preformed. Again this was simply a professional suggestion since contract went over winter months-After trying to connect with Mr. [redacted] on a couple of occasions to review project and get orders, our schedules were not available to do so. I then noticed that we could send color choices and we could move forward. -Mr [redacted] contract because we couldn't get together to roster project?? and wanted deposit returned I mentioned again that he could send colors and we could proceed. My thoughts that terminating a contract because we couldn't review the project was in excusable, other meeting wasn't necessary! I reached out to Mr. [redacted] to voice my concern about terminating a signed document with no excuse as my contract clearly sates I had to the end of spring to complete project Mr. [redacted] decision to terminate was after we had already pressure washed and less than 1 week away from starting project "weather permitting" -Mr. [redacted] make contact to say he wanted me to complete his project after all. over after he originally wanted to terminate contact I was received to have and reached out to lot after know i've put his project back on the schedule to complete. He then says he has moved on with another company?? At this time I consulted my business attorney about the project Mr [redacted] wanted to be returned. I deposit was $500.00 we had already pressured washed $180.00 leaving $320.00 I did mention I would return $320.00. of the $500.00 before he changed his mind and wanted me to complete the project. My business attorney and I agreed that to be fair to both parties and the fact that Mr. [redacted] has changed her position we agreed to offer me. [redacted] $160.00 and I keep $160.00 as I have only a certain amount of work in the exterior season to make my income weather permitting. I feel like I was 100% prepared to complete my end of the signed document. Mr. [redacted] but he cold could terminate without a legitimate excuse to do so. And wanted full deposit after pressure washing. I'm still waiting to refund 160.00 from through my contract clearly states no return of deposits on all signed documents My position with the Revdex.com is very important to me and I hope Mr. [redacted] will see that I'm going above and beyond to be fair in effect to resolve this matter.
