Fence was installed with portion on neighbors land, requested they move it onto my land but now they are not returning my phone calls.
Lamar was my POC with the company to install a fence; contract was signed and payment of $4700 was made on August 8th 2018. Due to weather and other issues fence was not completed until about 20-21 Aug if I remember correctly. About a week or two later I was cleaning up the dirt around the fence posts and noticed he had installed a post/poured concrete around a sprinkler head from the neighboring plot. Before contacting Lamar I double checked the wooden plot stakes, fence was clearly over but also worked with the builder to confirm metal/permeant plot points in case the sprinkler was on my land but it was not. I then called Lamar on 5 Sept, leaving a message and again on 6 Sept where I requested to schedule having the fence moved onto my property. Lamar assured me he installed it correctly and told me it shouldn't be an issue to leave it as is and he would work with the builder. I asked him to update me on what happens. Later that week I saw the builder again and we discussed; issue is the unknown of what the new owner will want when the plot of land is sold that has my fence installed on it. Due to the hurricane and Lamar saying he had a death in the family the last time we talked I did not follow up until 18 Sept, leaving a message. When I did not hear from him I also called on 24 and 26 Sept leaving messages with no reply back.

Desired Outcome

I am open to having Lamar return to remove the section of fence and install it correctly on my property. If he is unable to do so I would request a refund in the amount it would cost to have another company complete the work. I will have to obtain a quote for an exact dollar amount. My estimate would be $2,500 since the company would be removing and then installing and the section of fence is roughly half of the complete job.

Lamar was paid $1850 on Dec 16, 2017 for a fence, mulch and edging. The fence is incomplete and unprofessional and he damaged my irrigation system.
On 12/16/17 Lamar was paid $1850 for a wood fence, and $225 for mulch and metal edging. He told us he would stain the fence and have it completed before Christmas. He started work on the fence by putting post down and burst through our irrigation system pipes during the process, but did not inform us of this. We noticed a broken sprinkler head lying on the ground and had to call and ask him about it. He told us he would replace it. For days we did not hear from Lamar and once we did, he came up with different excuses such as food poisoning, cold weather and worker issues. In the middle of January Lamar showed back up and told us he would try to finish off the fence but needed to go the store to pick up the caps for the posts. He never returned. As of 01/15/2018 he is refusing calls, the fence is half complete, the gate handle is on the ground, there is nails sticking out of the wood and our irrigation system needs to be repaired. He also only put the mulch and edging down half way and left the remaining bags of mulch. We will be filing a civil suit against Lamar.

We are seeking a full refund of $1850 for the fence and $225 for the mulch/edging that is not complete. There also needs to be repairs for the irrigation pipe/head that he damaged while digging.
