Review: On Monday May 6, 2013 my Daughter was involved in a single car accident, losing control of her car on a wet road. The car slid off the road and was severely damaged.Big K'S towing was dispatched to recover the vehicle. She was quoted $218.00 for the tow. She had $100 cash on her. The tow company told her they would accept the $100 and the title to her car as payment. Being upset and not knowing what her options were she agreed.Big K's does work with are scrap yards and will recover ~270.00 ($320.00 less a $50 recovery fee) from the car. She was not made aware that this was an option for her.Desired Settlement: The amounts of money involved are trivial but the predatory nature of the transaction is not.I would request that she be refunded the $170.00 in residual value. Additional storage fees should not be assessed as these fees would be solely created by Big K'S Towing not resolving the matter honestly Monday evening.The scrap value and normal policies were obtained from [redacted]'s [redacted] at [redacted] ###-###-####

On Tuesday May 7, 2013 the owner of a 1999 white Pontiac grand am gt came to Big K's Towing Service where her car was brought after being winched out of a ditch, -following an accident she had on May 6,2013. The tow bill and charges were explained to her in detail, tow $93.75, winch out $75.00, clean up $50.00, bringing the total amount owed on the bill to $218.75. The owner stated that she didn't have full coverage on this vehicle and that she only had $100.00 with her. She was given the option of coming back the next day with the full amount due to pick up her vehicle, which would have been $218.75 plus one day of storage @$15.00 a day, or we would accept the $100.00 and she could turn over the title for the remaining balance owed, which was $118.75 at that time and remove her personal items. The vehide owner discussed these options with her friend, and she decided to pay the $100.00 and turn the title over for the remaining balance of $118.75.

The conversation between the owner and the office manager took place in the presence of the owner of the business and the friend who was with her.

On or about May 7 or May 8, 2013 the owner's father called a complaint in to our office, which was returned to him later that afternoon by the office manager. All the options that she had been given were explained to her farther. He was also given the option to pay the remaining balance owed $118.75 plus the one day of storage ($15.00) bringing the amount owed at that time to $133.75, and the title would have been returned to her and she could have removed the vehicle or had the vehicle removed and taken to a destination of their choice.

The company prefers to have the customers pay the fees and remove their vehicle. Her father declined to accept this offer.

I am rejecting this response because:

The final claim is an abject falsehood. That offer was not extended to me. Clearly; the business has no legal obligation to act with honor in this case So I expect no resolution. I only want it noted that they can be expected to work underhanded deals of this nature.
