Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
[redacted] is lying in his response.  A report to the [redacted] Police Department will clearly state the truth. [redacted] knew when I had called him originally - the condition of the pool and what time of year it was.  In a series of texts he said it would run from be $3 to $500 to open it dependent on how much chemical needed.  He said, following that we could hire them year around or seasonally and quoted those prices.  In the next week to ten days total, his people broke our timer (which is still broken) - his people put our motor on a pile of ants ruining its wiring - causing us to have to get it repaired. His workman did not clean the filter, as he stated.  My wife witnessed one of his men shaking it and pounding it to the ground (not hosing or rinsing it) and replacing it.  Of course it would not work. [redacted] wanted to sell me a completely new system, filter and motor was all I could determine. In a very short period of a week or so - nothing visibly was being done with the pool so I simply fired [redacted], by phone text.  This was my right to do.  Within an hour he was trespassing, pounding on our back yard windows screaming threats.  "How dare you!" "How dare you!" he screamed peering in the windows with cupped hands.  I had my checkbook in hand prepared to pay him from $300 to $500 as he quoted just to make him go away. I opened the side door and told him to leave immediately and he yelled, "How dare you - and then he threatened - "I'm going to charge you $1,000. I have all the trucks connected with GPS and can pile time up." I said, "I won't pay you $1,000 - you quoted $3 to $500 depending on chemicals - and you broke our system. Please leave."  [redacted] screamed in the middle of our front lawn that he would put a mechanics lien on the house.  Fearful of harm, my wife's attorney wrote the Police Department telling them what had happened.  [redacted] then sent a bill nearly $1,800 and called the attorney - admitted to screaming and making the threats but laughed them off - and suggested $1,100 settlement.  The attorney recommend to me that we settle it just to remove further threats, so he said yes to [redacted]. Then [redacted] did the 'bait and switch' again.  After agreeing to $1,100, he wanted my wife and I to sign a release - releasing him of further liability.  (He knew he had broken our timer and motor.) I told the attorney no and that I would handle it without attorneys - through small claims court.  We took the matter away from the hands of the attorney.  It was my decision to pay the full amount - advising [redacted] to have no further contact with the attorney (It would be at his own expense.)   Unless I get the $1,000 OVERCHARGE returned to me, I will sue [redacted] and his pool service in small claims court for misprepresentation, bait and switch selling practices, shoddy work and personal threats.  We are senior citizens. My wife is almost afraid to return to the property, a property she has lived in for decades.  After firing [redacted] and his company, the person I hired to clean and open the pool had it spotless and in perfect working order in four days.  He also told us a pool could not begin to be opened until it was vacuumed - a detail [redacted]'s company never considered.  They just tried to sell us a completely new system each day.  He is also lying about the credentials of the new pool man.  I purposely asked our new pool person not to have the timer repaired so I would have evidence in court about [redacted]'s company's scare tactics.

Review: There should be a police report in [redacted] about this. A [redacted] of the company quoted $300 to $500 to open our pool in [redacted]. In the first week they broke our motor and the timer and I fired them. [redacted] screamed and threatened me and said he was going to bill me $1,000 - PLUS put a mechanics lien on the house. He then sent a bill for $1,880.72 which I paid for fear of harm. The timer is still broken and I have an affidavit that almost none of the work was done. I do know that [redacted] told me they have GPS on the trucks and they could bill me whatever he wanted by using those. There was a time or two within that week he would send two trucks - but they would just talk. You should warn the elderly in [redacted] about Tri M Pools practices. I intend to sue the company for fraud and let a court decide.Desired Settlement: The company should be required to replace the timer they broke. We had the motor fixed. They should charge only the $300 to $500 they said originally. They should warn people that without written contract they might be at the mercy of unscrupulous pool cleaners.

Response:

In response to [redacted] claim:

[redacted] was quoted 335 to summarize the pool plus chemicals. Since we did not close the pool I told him I had no idea what the chemicals would run. Usually out total cost including the initial vacuuming is 700ish. Sometimes if the pool was really bad it can be over 1000 especially since he called us in the middle of the season and the pool probably would be green. He agreed to the work. We got there and attached the equipment and added chemicals. Usually as I told [redacted] it can take 1-2 weeks to get the pool ready, more if it is bad. The water was almost black. We returned daily if not 2 times a day to check on the pool. We noticed after 3 days the filter had slowed down. We took it apart, cleaned it and it ran for 24 hours. The pump was making a noise as well. His outlet for the pump was not working because there were ants throughout the timeclock so we plugged it into another outlet. Since in the beginning the pump needs to run 24/7 anyway. After a week we put a loaned filter grid in and also a loaner pump…. In 3 days after that the pool started to get clear, but [redacted] was not happy as when I got there personally that evening I noticed almost 3 feet of leaves on the bottom of the pool. Since we were told a professional pool company he had for a long time closed the pool it was assumed the proper job was done and it was vacummed before the cover was put on. At that point after one of my employees was there in that morning and said it looks better, I shocked the, it should clear up by later today or tomorrow [redacted] told me he hired another pool company and they were there an hour ago and look how good the water looks. I said we were there, etc.. he insisted. I told him that we have been here daily and if he keeps us we usually discount the opening especially if you are going to use us for weekly service. He said no, I said then you will be billed for everything we did without a discount. He said sue me, im not paying you a penny. Weeks later I receive a letter from [redacted] with an attached letter from another pool company. This person is not a registered pool company and he claimed he was a member of the pool association. The fraudulent number he used was from a different compant. He also claimed he was a [redacted] where at that time there may have been under 1000 in the entire country. Since I am a [redacted] I asked and thet told me he was not a [redacted]. So [redacted] hired another compant who has a reputation of bad mouthing other companies and lying to gain peoples confidence. [redacted] had his lawyer contact me and w tried to arrainge a settlement but [redacted] refused and advice from his lawyer. He finally paid me in full. Now he wants to sue me, how crazy

[redacted] screamed in the middle of our front lawn that he would put a mechanics lien on the house. Fearful of harm, my wife's attorney wrote the Police Department telling them what had happened.
