Review: [redacted] of Absolute Green Home/ Absolute Remodeling was hired to do a design for our lower level and to produce full building plans. The agreement we had in both verbally and then confirmed in email after our meeing was that if we used his services the cost of the plans would be applied to the job however if we did not use him we would be in possession of the full plans. [redacted] when asked for the plans went with out responding to any form of communication previously used. Phone messages, texts, and emails were ignored. Finally when I gave a dead line before going to court he responded and attempted to change our agreement. To date I have not received anything of value from [redacted] and he is attempting to keep my $6000 fee.Desired Settlement: I want a refund of $6000. I no longer wish him to produce the plans. All I have recieved are some drawings that are for informational purposes only "not for construction" that are not what was represented to be the end product.

The agreement between us and the [redacted] both verbally and in emails was "if they were to use our services the drawing and proposal fee of $6,000 would be fully deducted from the project."

Apparently, the [redacted] understood something else: "if we did not use your services we would walk away from our engagement with fully executable building plans".’ That is incorrect. “Executable” is simply not part of my vocabulary. Never did, never will.

What I did say is that our designs and our plans are also serve as ‘blueprints’, and that WE would be submitting the same plans to the building department for the permit application. That is why each of the detailed proposal copies that you have in hand (including the two or three revisions) show a line and a price for this, right at the beginning of the proposal, the very first line, which I am copying and pasting, along with attaching a copy of the last proposal.

In addition, I am doubtful any building department would accept drawings with our name on it if we are not the one applying for the permit, and the contractors working on your project. There is also liabilities involved here.

My complaint has not been resolved because I have not received anything of value in exchange for $6,000 payment. It was represented by [redacted] to both my wife and I that we were buying "full" building plans with the option to be included in the building costs if he completed the project. Since we disclosed that we built our house from scratch one potential was that we would GC the project ourselves. It was understood that at the end of our engagement that we would have plans in place to be able to do so. My wife and I are willing to sign sworn statements to this effect. The logic represented by [redacted] makes no sense; if we were to use him the plans are included but if we don't we are out our full $6000 with nothing in exchange but a worthless proposal? Who would agree to this type of one sided arrangement? In essence because we decided to not use the builder he decided to pocket the money and not pay the architect to finish the plans out of spite. I no longer want plans from Absolute Green Homes or his partners as I don't trust their professionalism. At this point I want a full refund. They didn't do any work for the fees paid and only provided a stock building proposal with some simple sketches made from an AutoCAD program that can be done online. I dont understand how [redacted] could be worried about legal issues with supplying architectural building plans when he is a professional builder/designer working with an architect. I have called a number of local architectural companies to get building plans for a lower level can be done for a fraction of what [redacted] is attempting to charge and not deliver. The line item in the proposal for $1600 is for presenting the plans to the town boards; I am not requesting this service I am asking for the plans that he needed to complete to bring to the board.
