Good Afternoon,Mr*** *** is not telling the correct information. We sold the Mitsubishi Galant to him on May 9, 2017. When we sold him the car there was a verbal and paper agreement that Mr*** signed stating that he was going to be responsible for the inspection
(I have enclosed a copy of that paper with this response) Even for the inspection; it only needed wiper blades, lug nuts and a brake light which we put on for him after he bought the parts.We never knew anything about the fuel pump until yesterday which was July 5, 2017. He never once called us and said that the fuel pump or even that he thought that the fuel pump was bad. We sold the vehicle off this lot as-is, so with that being said even tho he is still making payments on this vehicle it is still Mr*** responsibility for the up keep and maintenance on this vehicle. (I also enclosed the buyers guide that is marked NO WARRANTY signed by Mr***) The only time we ever heard about anything going on with he car was when Mr*** brought the car up to the lot asking if we could look at it because it had died on the road while he was driving (that was roughly month ago when he was suppose to bring his first payment)We looked at the car and noticed that is had a small crack in the air box. We did patch it up and told him that he would need a new one if he didn't want to leave it that way. It was in good working order up until now I guess. Mr*** even came to make his payment on June 23, 2017 which was weeks late and didn't say one word about the car having problems. I also enclosed a copy of a signed security agreement that show when car was bought and how much he was paying for the vehicle.I would like to add...Mr*** sent my secretary a message on Facebook telling her at 3pm on the 4th of July when we was closed because of the holiday. It isn't her responsibility to answer or talk about work while she isn't at workAlso...We told Mr*** that he would have to bring the car to us, then we could talk as grown people money wise about getting the car fixed or even making sure it is really the fuel pump. We offered for us to have the car fixed if he would just get it to us.I even seen that he has a different address which is against the agreement signed between usHe has to inform us with in days if he moved or the vehicle would be repoedI don't understand why Mr*** even went this far when we only found out the vehicle had a problem two days ago. I am the owner of ACA AUTO SALES. Honestly I do not even know his customer, I have...

never met him face to face; [redacted] has never been on my lot during business hours. I have only had communication via telephone. [redacted] called me late May early June 2015 telling me that he bought a 1999 Volvo S80 from me that I parked at MR. [redacted]'s (our friend) house/land to be parted out. Mr. [redacted] and I have a agreement allowing me to do so, I have a copy of agreement if necessary, I will provide.
After the Volvo was there for about 2 weeks [redacted] calls me. [redacted] tells me that he looked at the vehicle and said that he figured out why it wasn't starting. Then [redacted] proceeds to tell me that his sister was interested in the Volvo. I told him that I couldn't sell it because I didn't have the title.( this is why I was going to proceed to part out the car) I explained to [redacted] that it was a trade-in and the guy that traded it in hadn't brought me the title (I am correctly still waiting on the title for the trade-in). When I explained that to [redacted] I told him to tell his sister because she wanted to purchase the Volvo. She had been driving it without my consent while it was suppose to be sitting at [redacted]s land. Apparently he didn't relay the message to his sister and allowed her to drive it. I also told him that if she didn't want it to just bring it back to the lot and I would pay him for the repair that he did since he got it to start, so I can sell the car off the lot, once I was able to get the title. But I kept my word and will continue to do so and sell it to [redacted] for the $600.00 because he is a close friend of ours. (That is a steal because if I was to sell it off lot it would be going for $3000.00.) From what [redacted] told me she wanted to pay it all with her tax money(by the end of March).
Well then all of a sudden at the end of May early June Mr. [redacted] called me and was wanting to title for the Volvo. Me not even knowing who [redacted] was, I explained the situation; told him that I was going to have to talk to [redacted] because to my knowledge his sister decided to go ahead and purchase it. I was never aware it was sold because I never got paid the $600.00 that I was charging [redacted] to buy it. [redacted] told me that he had already purchased it form [redacted] and has taken it up to Arizona and called asking me for the title. I had asked him that why did he pay for a vehicle that didn't have the title at the time of the transaction. He had a silence response because he had nothing to say about that. I also explained to him that I have to get a hold of the previous owner because I didn't have the title. I even tried to go to the Department of Revenue to request one but they said I couldn't because I wasn't the owner of the vehicle. I then told [redacted] that I would contact him as soon as I could find something out or talk with Mr. [redacted]. I was not rude at all, I try to keep my costumer happy. I have never had any complaints until this one and I strive to help him with this situation but because Mr [redacted] is not cooperating with [redacted] nor I. My hands are tied and I have already tried my best to get the title on my own. Mr [redacted] and [redacted] made the transaction without my consent or even the title in hand.
As of 07/24/2015 [redacted] called me again asking what was going on with the title or if I had heard anything. I told him that I was still working on it. As for that I was able to get ahold of the previous owner as I was talking to [redacted]. The previous owner told me that he was going to go up to the Department of Revenue on Monday 07/27/2015 to file for a lost title, he even apologized to me for not doing it sooner as I asked him a month ago.
Know when [redacted] says that he has been dealing with this for 2 years is not accurate because the vehicle that he was trying to get in the first place was a 89 Chevy 1500 that I had sold to a individual on 10/1/2013 and he had it for about 4 months which would make it Feb of 2014, The rear end went out of it and I gave him another car which was a 2003 Durango. The Chevy truck was then sent to [redacted]s land to be parted out as well. Mean while the man that traded the Chevy passed away before I could file for a affidavit saying that he didn't want the truck. Therefore it took awhile to figure out how to get the title but I finally got it figured out through the Department of Revenue. Then [redacted] told me that one of his neighbors wanted to buy it and I told him that it was fine but it needed a rear end and it would be ASIS he said that the guy didn't care because he was just going to use it as a farm truck. He also said that this guy didn't care weather or not it had a title. I do currently have the title of the 89 Chevy. I wasn't even aware that this same guy that wanted the Chevy was the same guy that has illegally purchased this Volvo from [redacted].
Other than waiting on the title, I wont release it until [redacted] comes to the office/lot and pays the rest of the money($300.00) that he owes for the vehicle. Considering I sold the Volvo to [redacted] and I have tried to contact [redacted] via telephone but I have not been able to get ahold of him.
Now if [redacted] says that he has payed ME (ACA AUTO SALES) directly then he will have a paper receipt with my signature on it. Now if he says he payed [redacted] or his son then they will have a receipt. If they don't then they are the responsible party to either pay [redacted] back or pay me the rest of the $300.00. But regardless I still need $300.00 from either [redacted] or [redacted]'s son to get the title released.
Also when he mentioned in his statement to Revdex.com that his son works for ACA Auto Sales is false because my husband is our mechanic and has been since our business was opened in Sep, 2013. Also as [redacted] stated in his complaint, I have never said that I needed a extra $500.00 to get the title. I am only paying the previous owner $11 to file for a lost title.
I also have to say that I do not "get smart" with anyone, I tell my side of the story but [redacted] is stating that I sold the Volvo to him yet he made a transaction with [redacted] off the street with out my consent and title in hand. I'm not sure what the deal was between [redacted] and [redacted] but until I get full payment from [redacted] of $300.00 and title sent to me the Volvo will remain in property of ACA Auto Sales.
