Mrs. [redacted] brought her son in for an introductory class. At the end of which, I suggested she sign her son up for a one year program. I used both the phrases; one year and 12 months. She signed said agreement and I made and gave her a copy. She then signed an acknowledgement of Receipt for said...

copy. I said to her, 'This piece of paper states that gave you that piece of paper." She seemed to understand what she was agreeing to.After all of this, we then discussed payment options. She chose auto — draft on a monthly basis. She then signed another form to set up payments.[redacted] came for six hours of class. He was doing quite well. Well enough that I suggested they move him from the half hour 6 and under class to the one hour 6 and over class. Although the younger kids class has lots and lots of room, the 6 and over class was crowded. This is why we have doubled the size of the school. If Mrs. [redacted] was concerned about the crowding, she could have easily put her son back in the half hour class.Mrs. [redacted] complains that we put her son in the back row, even though he has a vision impairment . All new students go to the back row. We normally put a helper in the back row. New students do not normally like to be in the front row where they feel everyone is watching them. Mrs. [redacted] did not write down limited vision as a physical impairment on her application. Nor did she come to me and mention any of her concerns. As the father of a blind son, t would have been happy to accommodate her, if she had but mentioned this problem.Mr. [redacted] called me and said they were canceling their program. I tried to explain that his wife had signed up for a year and suggested she call me, as she was the one who enrolled her son.Mrs. [redacted] called me and when we started to discuss the matter, she stated she was in clinicals and would call me back. Mrs. [redacted] has yet to call me back, as promised.We at the Academy of Okinawan Karate of Texas, Inc. intend to teach the classes as promised and look to Mrs. [redacted] to keep her word and written agreement.

I am rejecting this response because:Because of my schedule my husband made attempts to speak to the owner. I also tried to contact the owner via the email he provided on his business card. The email went unanswered and the owner refuses to discuss business  matters with my husband. When I spoke to the owner via phone I stated the main reason we were pulling our son is because he is struggling academically at school and will be needing additional tutoring. This is a situation that I have been working closely with the school principal and teacher with. The owner at AOK refused to accept the sitatuation as a reason to stop attending karate despite me stating that we would give Karate a try once my son has adjusted to tutoring and is improving in school.When the owner was explaining the contract to me he never stated that we could not break said terms given certain situations in fact he requires a signature on the front of the page but does not address the fine print on the back side of the form where it discusses legal ramifications should we not pay for the agreed upon term. At the time he was explaining the terms of his studio I understood what he was saying but he was never clear about us not being able to cancel. I asked him if my son's vision was a something to list on physical impairement and he stated no as long as he is fine with his glasses. The opener also did not suggest we move my son up based on his ability. He stated with his age that he has the choice to attend either class. The 6  and over class was crowded and the 6 and under class did not have enough helpers as one was assistant teaching the hiring ranking belts and the other was busy helping two students that had disabling mental impairments and required constant redirection and hands on assistance. I understand why the owner wishes students to continue on for 12 months but at the age of 7 that is difficult to demand especially when other factors may occur. My son is faced with poor vision and now the possibility of having multiple learning disabilities at the age of 7. I have to give him the time and help with his academics and the owner of AOK seems insensitive to that regardless if he has children of his own that has had similar issues. It's my decision as a parent on how to best help my son not the owners and I do not  feel that Karate will help my son learn how to read and write.
