Access Ford, LtdAccess RdCorpus Christi, TX 78754Phone; ***Fax: ***To Whom It May Concern:My name Is *** ***, General Manager, Access Ford, LtdI received your letter, Complaint #*** reference customer *** *** involving the purchase of a Dodge
Ram Mega Cab with multiple suspension, lighting, and cosmetic upgradesI took over as GM on July 1, I was not here when this vehicle was sold, however I have reviewed the paperwork and found that on the “We Owe Document" that the only thing that was promised was a wash and state inspection, fuel, and a vacuumThe customer did have a limited warranty provided by the company for a period days or miles (whichever came first) on covered components listed on the federal "As Is" Document which clearly states anything other than factory installed options are not coveredThis is also the case with any extended warranties that are purchased to extend the warranty life of the vehicle, The customer did sign these documents stating that he understood the coverageHe states that the mirror on the truck was covered, which Is a factory installed itemThis vehicle had 76,miles on It when the customer took deliveryTo my knowledge he has not provided any estimates or documentation requesting anything and waited over months to state this claimI am providing a copy of the "As Is" form and a copy of the t'We Owen form of which his signature appears on each, I did what investigation that I could but with change in personnel and months gone by, the only thing I have to go by is the customer file, I have also included invoices showing how the vehicle was alteredThis equipment falls under the non covered equipment in any extended warrantyAgain I only have the file to go by. I am rejecting this response because:As the dealership has stated, no I was not there at the time of this transaction My husband did not do the research to see the NADA value of my Corvette Isn't it funny though, the dealership only gave him the payoff amount of the Corvette I NEVER once threatened them The only reason why I agreed to look at another vehicle is the dealership told me that they could NOT do anything on the Ford Focus to go down any lower, but if I I found another vehicle they could tweak those figures to get me where I was before The dealership was the one that told me to look around and take another vehicle home with me, which I did As for the Ford Escape which I took home over the weekend The price of it was around $33, They offered me the Escape for around $31, The so called $2,was the incentives, which by the way, anybody can getThis was no peace offering as they have statedThey did not offer me any more for my Corvette This is what the whole complaint is about I really did like the Ford Focus I only took home the second vehicle, is because they told me that they could lower the price to get me where I was before As it turned out, the Ford Escape would of been between 5,and $6,more All I wanted was the get the correct trade in value for my car I would love to see what they sell the Corvette for Again I did not threaten the dealership
Regards,

While we appreciate the patronage and return business ofthis customer, at no time during the initial transaction was this person(***) ever involved. Her husband arrived at the dealership in theafternoon and asked for assistance in trading his Corvette. Heselected the white
Ford Focus on our showroom and we took the time toprofessional appraise his trade in and assess its market valuation andcondition. Based on live market data, live market analysis and realtime transactional data, we offered Mr*** the fair market value for hisvehicle. The used car director spoke to him personally and presented allof the figures in full disclosure format. Both the used car director andMr*** agreed on the terms and both signed the full disclosure statement ofthe terms. Mr*** drove his new Focus off of the showroom floor for anice test drive and returned happy. He signed all of the necessary legaldocuments to consummate the purchase, leaving immediately afterwards to finishthe paperwork at his bank. He called the sales professional several timesover the course of the next couple of hours to ensure that we had receiveddrafting instructions (how a bank transmits funds) from his bank. Once wereceived drafting instructions, everyone was happy. At no time duringthis process was it ever mentioned that there was anyone else involved orinterested. It wasn’t until the following day that we met Mrs.***. Executive management met with Mrs*** and her neice for a goodamount of time Mrs*** consistently demanded ‘trade value’ for hervehicle, which was thousands more than it’s live market value, siting her‘banker’ and her relative who operated a car dealership in the Valley, as wellas the NADA guide as her sources for what she considered it’s value. After explaining in detail how we use live market data and reconditioning coststo determine value, not a paper book or guide, we failed to reach a mutualagreement about this information. After leaving the room to make severalphone calls, threatening to get the bank to recind the loan and threatening tocall the police, calmer heads prevailed and the dealership offered to trade herout of her new focus into something else that she selected as a compromise forall parties. The dealership offered for Mrs*** to be able to drivethe new model home for the weekend to make sure she enjoyed it. Thatoffer was accepted. After returning on Monday, she again met withexecutive management and discussed the new terms, which were offered. Despite her earlier statement, the factory incentives that were already givento her were not the only concessions offered. The dealership offered theexact same ratio of discount to amount financed as her previous purchase, plusan additional $2,000. Her son, who was with her on Monday, agreed andunderstood that the deal was $2,better in their favor as a peace offeringthan the transaction that her husband consummated. The dealership demonstrated with full discosure all of the terms and figures, which includedgiving her exactly what she paid for her new focus as a trade in value. The terms were unacceptable to Mrs*** who kept repeating that the onlything we were giving her were factory incentives. Her son seemed tounderstand and nodded in agreement. At the end of a long discussion, Mrs.*** again threatened to have her bank recind the loan. At this point, the dealership had done everything professional possible to assist Mrs***,who again was NOT the customer that originally purchased the car. She wasNOT involved in the original transaction in any way. We spoke toher out of courtesy, out of respect and out of a desire to assist her. All of our attempts were denied. Our transaction is legal and binding andwas consummated in a professional, legal, moral and ethical manner with theoriginal customer, whom has never called, visited or expressed any concernabout his purchase

I am rejecting this response because: the salesman did not write anything down he just told me to turn it into warranty.
