Now he left the job, and he is not finishing the job. he is using the excuse of not completing the job as me and my neighbour for harassing his employees, which is base less. he is not returning the calls and not completing the job, I paid him $2000 in advance and he did not complete any things he promised now he is not even giving me the money. this is not acceptable. please help me.

Dear Mr. B. It is very sad and disturbing that after all that we did for you, above and beyond our original contract agreement, that you decided to lodge a complaint to the Revdex.com that is a very misleading and inaccurate account of what really transpired with your renovation project. Firstly, it is not good business practice or ethical to manipulate our original business agreement with you for you and your neighbours' benefit. By only paying a $2,000.00 deposit instead of the full deposit of $3,727.50, which you agreed to in the original contract terms, you breached the contract right from the beginning. Our business arrangement with you has been based on both parties following ethical and respectful Canadian Business Practices where we both benefit. We are a customer focused business that have gone above and beyond what we have agreed to provide you and unfortunately you have decided to take advantage of this for the exclusive benefit for you and your neighbour only. Your neighbour was never part of the original contract terms and agreement. Despite not receiving the full deposit, we proceeded and completed a lot of work for you which was well beyond the $2,000.00 partial deposit that you paid to us and contrary to what you had mentioned in your complaint to the Revdex.com. You also failed to mention in your complaint that we already provided numerous extra services, free of charge, BEFORE your complaint was lodged with the Revdex.com. AND as you had indicated in your complaint, you and your neighbour did indeed harass us and our staff.

Here are the factual details of what we provided to you and your neighbour (who was not part of the business arrangement):

1) You had agreed to pay the full deposit of $ 3727.50 prior to us starting but you only paid $2,000.00 after we started working on your project on Friday, August 30/19. You still owe us $1737.50 not the other way around! Legally, we can put a lien against your property for what is owing to us. But in fairness to you, and in following good Canadian Business Practices, we would prefer that you pay us what is due to us rather than going this route.

2) Despite receiving only a partial deposit, we proceeded with your job and offered many extra, free services that were not part of the contract terms. The following Tuesday, September 1, 2019 (after the Labour Day holiday) I brought 2 crews, one crew that dismantled and dug for a gravel parking lot in the back of the house and the second crew who cut the concrete for a separate entrance and removed your old storm door and the front door of your home. We supplied 2 brand new doors with locks and actually installed them contrary to what you said in your complaint. We also dug and poured 5 piles of concrete for a retaining wall including rebar. You also did not mention this in your Revdex.com complaint.

3) As a courtesy to you we provided the following free services above and beyond the contractual agreement:
a) We removed the pavers of the existing sidewalk and moved them up the hill to your neighbour in our trailer and unloaded and stacked them as a courtesy for both you as our client and your neighbor, free of charge.
b) We also removed a bunch of lumber that was stacked in the parking lot where we were supposed to be digging. We asked you on the Friday before that all the debris and garbage was to be removed before Tuesday. Again we removed this because it hadn't been done, free of charge.
c) You then asked us to move this lumber to your neighbour's house, also free of charge. Which we did, again as a courtesy to you.
d) We also removed the back fence and the front gate, free of charge. You failed to mention all of this in your Revdex.com complaint.

4) Our staff installed both doors even when your next door neighbour kept harassing and telling them what to do every time I left the job site to do some errands for your renovation project. You hired me as the contractor to oversee the project and not your neighbour. Perhaps you could have told your neighbour to consult with me when I was there and not harass my staff when I was not present.

5) We have gone to great lengths trying to secure a contract with you, at our own expense, for the last 2 years. For example, we went to your place 5 times in the last 2 years to give free estimates to you but you never proceeded until now. I never got paid for any of those free estimates thereby incurring staffing and vehicle expenses in doing so.

6) Lodging a distorted account of our business dealings with you to the Revdex.com after all the work we did for you, which was well beyond the $2,000.00 that you chose to pay as the deposit, and not the full amount of $3,727.50 that you had originally agreed to, is yet another form of the harassment and manipulation that you have shown towards us. Should you have chosen to commit to and abide by a mutually beneficial and ethical business arrangement you should have paid the full amount of $3,727.50, which you had agreed to, and in providing a respectful and welcoming work environment so that we could have proceeded with the rest of your renovation project to our mutual satisfaction. But sadly you chose otherwise.

This is an abandoned (extension of driveway plus the repair of part of the existing driveway) project after payment of 90 percent of the invoice.
Since the first down-payment of 50 percent on July 9, 2019, and the second down-payment of 32 percent of 50 percent of the balance, the contractor has since refused to be on site to complete the job. I have been calling him leaving voicemails without any response/success.

Please note that only one window was installed as against two windows indicated in the work scope. The contactor visited the site and confirmed the possibility for two windows in my secondary suite, hence the amount in the quote. During the construction, the contractor then realised that it was not possible to put the window in the Den room. Right there and then, the contractor agreed that since the second window was not feasible, the price of not installing the second window would be $1200 plus tax hence the difference in the overall estimate.
The unwarranted delay being caused by the Contractor will not only affect getting the City of Calgary's approval to make my secondary suite legal but also making me not to rent the suite thereby losing money on monthly basis.
