Accurate General Construction

This Company was hired to install an 8'fence. Currently, the gate is inoperable and several post warped. Numerous failed attempts to resolve. On January 17, 2014, an 8 ft fence was installed on my property. After several conversations in person and email, an approved fence with improvements from the contractor ([redacted]) was installed. Currently the fence has numerous warped posts and an inoperable gate. A neighbor informed me that my post where warped. I called Mr.[redacted], at which time, he stated "that his back was out". Understanding the nature of the problem, I awaited a return call. Which I'm still waiting on to date. I called and recorded for two weeks attempts to resolve the problem. Unfortunately, the problem remains unresolved. I further attempted to resolve with a certified letter which was delivered to your address on January 6 (no authorized recipient available). Re-delivery scheduled and delivered on January 9, 2015 at 4:37pm. Desired SettlementUnfortunately, the problem remains unresolved. I am hereby requesting that a refund amount of $1000.00 to have someone else repair the fence.Business Response I responded to my customer with an email informing her that there is no warranty for a treated wood product that she chose. I quoted her a higher price that included using cedar post but she declined. I did give her a free upgrade using larger post for her gates not included on[redacted] bid. I matched[redacted] price. I also told her that I am willing to help her with this. I will not pay for new material and once again the post can twist regardless of what company installs it. All of her post were installed 2 feet in the ground and completely encased in concrete. The price difference with using cedar post vs treated is $50.00 per post. There is never a warranty from my company or the manufacturer of the post that it will not twist. I am willing to help but it will not be free but it would be less than $1,000.00. This is part of the fence from the back. I use 4 frame stringers instead of 3 and screws instead of nails. All of my work is high quality but I warn my clients about using treated material. However, if they choose treated post, I am selective in what part of the tree the post was cut from by looking at the grain. If only a few post twisted that's pretty good considering the height and length of this fence. But I warrant that it won't come apart under normal circumstances. I am sorry this has happened to her fence. If I replace the post with same then it can most certainly happen again. Thank you for being the "go between" for both of us. According to the quote there were Know upgrades known to me (perhaps only to him). A discount was mention because of a big contract he had and the place he purchased. This response and the email both state different. I quote from[redacted] was never given to Mr. [redacted]. I do understand that post twist but not as quickly as they did ( within 30 days of install). There are several nails that are hanging from the posted not screws. I'm very sorry I used this company. I wished that I would have used another company that my neighbor used. His post are treated and are not warp. I've tried to reach out to this company for a year (via calls and certified letter) and I'm only getting a response because of the Revdex.com. I'm still waiting for the willingness he mentioned above. ThanksFinal Business Response Revdex.com, I am not going to continue to write letters back and forth about he said, she said. I have already stated my position in a previous response. The fact that she did not accept my response doesn't change anything. My customer said there were no "known" upgrades and she did read the[redacted] quote to me via a phone conversation. The upgrades from me were 6"x6" post at both gates, 4-2x4 frame boards per section and screws to attach frame to post. All of this while staying within a budget that she told me and a price from[redacted] that she told me as well that did not include large post, 4 frame boards with screws As for the nails, there might be a few nails but they were used for tying a string up and making reference lines. Since my first rebuttal ms [redacted] sent me an email saying "let her know 24 hrs prior to coming to her house". And that she doesn't want me on her property without her presence. I understand but I will be sending out a rep to meet her propose a price/plan. The last thing I want to say is about her neighbors fence that apparently has no twist; ms [redacted]'s fence is 8' tall which has a high potential for twisting when using treated post. Maybe her neighbors fence is 6' tall. ?? Regardless, I will be following up with her as soon as the weather is decent. This is is a business disagreement and I will help her and I hope she comes to realize I have not done anything malicious as she has somewhat implied. Thanks.
