Contractor paid to repair flooring left holes in the wall, trim damaged , flooring not level , broke hot water tank never returned to replace or repair it.Desired SettlementRefund the 5800 paid to repair the 1390 cost to replace hot water tank.Business Response Contact Name and Title: [redacted]Contact Phone: XXX-XXX-XXXXContact Email: [redacted]@hotmail.comCLIENT was a referral to Accurate Services Group. Once receiving the referral I, [redacted] scheduled an appointment to view the job, which at this time I was told by CLIENT that she had an insurance claim due to water damage. CLIENT advised me that several other contractors had looked at job, but she was not satisfied, because they could not reach a settlement with her insurance company. I explained to her at that time, that my company could negotiate a fair settlement for her, and do the work based upon the final estimate provided by the insurance company. I made a point to advise her that all of the insurance proceeds would go towards the repairs in the estimate agreed upon. On November [redacted] the CLIENT agreed to all terms discussed, which at that time CLIENT signed a standard insurance restoration contract stating the following: THE OWNER AGREES TO PAY THE CONTRACTOR PER THE FINAL ESTIMATE PROVIDED BY "INSERT NAME OF HER INSURANCE COMPANY HERE".The final estimate amount is $9,933.97. As of [redacted] only $5,800 has been received from the CLIENT. CLIENT never expressed any concern about the quality of work at any time while repairs were underway, during our final walk through, or before she moved in. It is only when payment was requested did these issues arise. I have several before and after pictures to show the quality of the workmanship we put into her home.CLIENT called and told me that her water heater was leaking and that we broke it. I explained to her that it was nothing we could have done to it by just detaching and resetting it. I reminded her that I previously told her the tank was old and rusted and needed to be replaced anyway. I told her that I took pictures of the water tank before we even touched it. Before we detached the water heater we noticed that it was: (1) not hooked up properly(2) leaking (3) had visible signs of rust on top and sides and bottom(4) the rating plate with the model # and age of W.H. had been removed(5) visibly old and needed to be replaced I advised CLIENT before we removed the water heater all of the things listed above. I recommended that now would be a good time for her to purchase a water heater, she stated that the water heater was new, which it clearly wasn't.I will attach photos of the water heater and you can clearly see that it was in bad condition. Here is a email forwarded to me from CLIENT'S insurance adjuster:Client,Based on our phone conversation this morning I am aware that you still have some concerns with the quality of work that your contractor Accurate Services Group provided to your property. You also mentioned that the hot water tank that they removed and then reset is no longer working and that they did not take responsibility for it because it was very old, wore out and needing to be replaced. I am really sorry that you have not been able to come to any sort of resolution with your contractor, however I have verified with them that all the work that Farm Bureau estimated and paid for to be done has been completed. Accurate Services Group has requested that we release the final check for the remaining Overhead and Profit that is owed and we are obligated to do so. The check will have your name and their name on it and will be mailed directly to you. With that in mind, any issues you have with the repairs that were done on your home will need to be directed to your contractor. I hope that y'all will be able to work it out.Even though it is not our responsibility we still offered to buy her a new water heater for $500 which is more than what her water heater cost. Client stated she was still not going to pay her deductible or endorse the final check because we already had been paid too much, we had not done what SHE FELT like was $9933.00 worth of work. We did everything on the insurance estimate as stated in the email from her adjuster. In addition we gave her upgrades plus did extra work in several areas but she still refuses to pay. CLIENT visited the house daily, did a walk-through, and moved back in the house with no complaints. Its only when payment is requested do these claims of poor workmanship arise. This is a clear breach of the contract she signed on November [redacted] Even on her complaint here CLIENT states that she has only paid $5,800 of the $9,933.37 We are taking the necessary legal steps to collect the balance of $4,133.97 from this client. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)When Mr.[redacted] first came to review my claim I explained to him the problems I had with the insurance adjuster and the contractor. He was to review the claim and to see If it was correct and I ask him if so did he think the job could be done for the amount stated. Once we signed the contract and got a final estimate from the insurance company .Mr [redacted] said he could do the job.Before any materials were purchased he asked how was he getting paid I asked Was he going to use the 5800 to do my house and get the overhead and profit at the end . He stated " he was not going to wait on that so He said he charged 5800. I Told Mr [redacted] I had no problem paying my deductible when he asked for the payment I gave it to him In full prior to completion he didnt say it was missing the amount of the deuctible. On the#3rd day of the renovation I brought to [redacted] attention that the tile w was cut incorrectly before the grout was placed I have pictures they grouted it anyway.2weeks after the hotwater tank sat in the garage he mentioned the rust on the top . On November [redacted] I stopped by my house Mr [redacted] and a plumber was there attempting to fix the hotwater tank. He tried to tell me that I needed a new one I stated it worked before they took it out. On November ** I came home the tank was leaking water . I called Mr. [redacted] he stated he didn't know why and that he was not going to pay because he would not be making any money from the job. Also I brought to his attention the hole in the bathroom wall, the caulk around the sink, the tile standing outside the door and the trim in the kitchen that per the estimate was supposed to be sanded and restained it was just put back in looking damaged.On Nov. 26 Mr. Berkly returned and put wood polish on the trim and caulk in the hole in the wall.I called [redacted] on December 1 concerning the tank he instructed me to call the adjuster and tell him it was not working. the adjuster told me told contact Mr [redacted]. On [redacted] I contacted Mr [redacted] he stated if he replaced the tank could I have it installed .I agreed but no amount or arrangements were made. He asked me other than that tank was I satisfied I said I noticed that there were humps underneath the tile floors he installed as well as the hardwood he installed . He never offer to come look or explain why this happened. On [redacted] 5 the adjuster emailed me requesting that I send him my concerns and to include Mr. [redacted] in the email I did . In his respone he had no explain as to why he work had failed . In the contract it states the work should not fail before two years.I had to replace the hotwater tank on my own I called [redacted] and let him know He became rude and yelling never offering to bring me a check for it . I will forward the emails. between him the adjuster and I. [redacted] talked about money the whole time during the renovation he accused me of being money hungry. I also have pictures of trash and debris left in the garage as well in my yard that was stated he would remove in the estimate.Final Business Response Below is the solution offered by the clients insurance adjuster in the emails the client submitted."After you and I spoke, I sat down with my supervisor and expressed your concerns and unfortunately [redacted] cannot hold a check that is owed for work that is done. The check will be sent to you, so what you can do is offer to give Mr. [redacted] the check after he agrees to make things right at your home.Hopefully this helps"This solution is acceptable to us. If Ms. [redacted] agrees to uphold the terms of the contract she signed and endorses the final check made payable to us along with her deductible of $1000.00 we will be more than happy to address her concerns.I will attach a copy of the contract the client signed.Below is the email the client sent to her adjuster concerning the work she was dissatisfied with:From : [redacted]@gmail.comSent [redacted] 05,XXXX XX:XXAMTo: [redacted]@hotmail.comSubject Finished workAdress humps in hall floor . fill hole in bathroom wall humps in den and kitchen floor.1)ADDRESS "HUMPS" IN HALL FLOOR:The client had 3/4" hardwood floors glued to the slab. This was the wrong product for this type of installation. We replaced with the right product which is a 3/8" engineered wood floor glued directly to the foundation. Any slight variances would be do to the foundation. We were not paid to nor would we recommend disturbing the foundation to correct a very slight variance in the floor. The 3/4" wood that was there before would have hid any imperfections in the foundation because it is twice the thickness. In my response to her adjuster and to her complaint I stated the slight variance in the floor are not even close to being a trip hazard. We fixed several trip hazards at no additional charge to the client that were already there do to very poor workmanship. I will post additional pictures of these areas.2)FILL HOLE IN BATHROOM:This "whole" is one of the 3 things we addressed during the walk through. The client said they were satisfied. If they now are not satisfied we will refund her $100 to get it fixed to her satisfaction. This "whole" was 1/8" wide by 3x4" tall. I would also like to note that we spent several hours filling wholes in the two rooms that we painted. We painted these rooms free of charge.3)"HUMPS" IN DEN AND KITCHEN FLOOR:The client had sheet linoleum in the den and the kitchen witch is flexible. We upgraded to ceramic tile at no additional charge. The tile was installed over the concrete foundation. Again there may or may not be some slight variations but if they are they are do to the foundation. 4)We truly feel bad for the client about her water heater but as her insurance adjuster explained "You cannot hold the insurance company nor your contractor responsible for something that was old worn out and damaged". However even though the it was already damaged and we are not responsible in order to reach a common ground we will refund $600 to the client for the water heater. This is more than the cost of the water heater the client had previously.
