Mr. [redacted] contacted our office on 6/14/16 to request our help in removing the suspension of his driving privilege which was suspended by the NC Dept of Motor Vehicles for two DWI convictions. It is noted he...

has a total of three DWI convictions in our state. Mr. [redacted] completed the necessary paperwork and a NC DWI Certificate of completion was forwarded to the NC Dept of Motor Vehicles to clear a DWI conviction on 2/16/99 and 1/7/2000. A fee of $150 was charged and paid for our services, and Mr. [redacted] was advised of same. After receiving notice of Mr. [redacted]'s complaint, we contacted the NC Dept of Motor Vehicles who advised Mr. [redacted] telephoned their office on 12/19/16, to inquire as to why he was still suspended. He was told at that time that according to NC DWI Statures he is required to have a NC DMV hearing as a result of 3 DWI convictions. In addition, he was given the procedure on how to arrange for a hearing. Also, in order to obtain a hearing he must have the previous 2 outstanding DWI's cleared which included a Drug and alcohol assessment and substance abuse outpatient treatment, which he completed in his home state of PA. At this time we have fulfilled our obligation to Mr. [redacted] by having the 2 DWI's cleared and as previously stated and due to the number of DWI convictions a NC DMV hearing is required. The decision for the hearing is made by NC DWI Statue, not our agency.

In regards to Mr. [redacted]'s complaint please note that the hearing was mandated by the North Carolina DMV, not our agency. A hearing is required due to the number of DWI convictions a person has.  Again, in order to have the hearing our agency completed the necessary forms for Mr. [redacted]o to even apply for the hearing.  He could ask for a hearing by mail and state the reason for the request; however this decision is made by the NC DMV.  Our agency did not deceive Mr. [redacted]o.  Our paperwork clearly outlines the steps to clear the DWI's for licensure re-instatement consideration.  It does appear that it is Mr. [redacted]o's decision not to follow through with the process to re-instate.  Also, there is no time limit on the hearing so if it is not convenient at this time, perhaps he can arrange the hearing at a future date.  Again, we did not deceive Mr. [redacted]o in the process; we did exactly what he hired our agency to do.   Thank you,Jan B[redacted]/CSACACDM Assessment and Counseling of Guilford[redacted]

I am rejecting this response because:on grounds of deception. Problem at hand is about deception and how I was deceived into believing that if I paid the fees and completed the classes, I was told that then I could go to Pa.DMV and get my liscense restored. I was never told about the hearing that I would have to go to North Carolina for until after I went to the DMV and called ACDM and after I paid the $150. Bottom line is if ACDM would have told me that I was going to have to go to N.C.for a hearing at the beginning of my claim, I would have dropped everything and not applied because I cant afford to go all the way to N.C.for a hearing. In other words, ACDM waited until they got their $150 before telling me about the hearing and I should have been told before I paid the $150 admin. fee. NOW Im no farther ahead with getting my liscense restored then I was when I first began.Sincerly yours,,[redacted]
