Review: supposedly got a verbal authorization from an employee that answered the phone to place a yellow pages ad. The employee has no authorization to do this and was probably tricked into saying yes. No owner authorization or contract was signed.

Response:

We are in receipt of the complaint filed by [redacted], referenced in our system as [redacted]. UBS tried to resolve this matter professionally to no avail. ACDR Corporation purchased the debt from the original creditor through assignation of debt on April 12, 2012. The debt was validated with the owner with documentation provided to [redacted] April 5, 2012. The client may dispute the debt incurred, however, clients have an obligation once validated to seek proper resolution for the debt. The agent handling this file has been attempting to work out settlement arrangements on the outstanding amount. There was no conversation on July 17, 2013 as stated by Ms. [redacted]. The owner refused to talk to us and someone from phone number ###-###-#### kept calling our company that day and hanging up once we answered our phone. Please have the complainant contact the agent handling this account and they will gladly work with them to settle and close the account amicably. Best Regards, Rick Michaels ACDR Corporation###-###-####[redacted]

Review: Back in May 11,2010 a company named UBS Inc for advertising services called offering me their services. I never agreed to anything and I never received anything. After being called by this company several times about owing them money for "services rendered" I looked them up in Google and found that there were many people stating that they were scammed by this company.May 14, 2013 I received a fax from ACDR Corp stating that they bought a debt from UBS Inc and that payment was due. ACDR Corp stated:"ACDR Corp has acquired account number [redacted], now referenced in our system as [redacted] by assignation of debt. This debt was incurred on 5/11/10 with advertising services duly authorized by [redacted] and services have been confirmed rendered by UBS Inc as of 5/21/10. The above reflects a current statement of account including any payments rendered. At this point the account is PAST DUE. As the account is now active within our system, payment arrangements must be made in order to avoid the debt being reported as delinquent to all three major credit bureaus. Interest will continue to accrue at a rate of 1.5% monthly until payment is rendered. Once payment is rendered this account will be removed from our system and no further collection procedures will occur. Please contact me at ###-###-#### as soon as possible to make arrangemtnts in regards to settling this debt. Regards, Saul Rosenberg, Commercial Credit."I would like them to stop calling me and harassing me for payment and to inform other business of this scam. Thank you.[redacted] & [redacted]Desired Settlement: I would like this information available to other companies so that they will not have to go through this.

Re: Complaint Id [redacted] – [redacted], Inc.Dear Ms. [redacted]:American Credit & Debt Recovery Corporation is a commercial collections firm and as such we havethrough assignation of debt acquired this delinquent account. The order was authorized by [redacted] on May 11th, 2010. The third party recorded authorization was done in accordance with FTCregulations. A copy of the recorded contract is being provided with this response for the Better BusinessBureau’s records showing a clear commitment by the client to engage UBS’s Inc. services. The priceterm and the order were acknowledged by the client. The only scam being perpetrated is the client filing a false complaint using slanderous comments in anattempt to avoid paying a validated debt. The client knowingly filed a false complaint. We recommend that the debtor contact the agent who is handling their file and work out a fair andreasonable settlement amount. Failing such the file may be reported as delinquent to all major creditbureaus as is within our legal rights.Best Regards,Rick MichaelsACDR Corporation

Response:

A company, ACDR called stating that they had bought my debt and are now trying to recover it. This Corporation has repeatedly indicated that they have an authorized signature for the purchase of some product related to advertising of our Business. I have not authorized for anything nor to date have I ever received any products. They continue to try to collect a bill that was not authorized. They will call over and over and over and each time they start to yell and threaten me. On May 21, 2013 they called and I informed them that if they kept calling that I would file harassment charges Saul Rosenberg started to yell and threaten me then they called back 7 times in a row. They continue to fax and call many times a day. The phone numbers vary each time, some state 'withheld'. They have some bogus account number for us #[redacted]. In researching about this company I have found that there are so many reports on this scam that date back to 2009. I will be filing a complaint with the Virginia Attorney General today. Regards, [redacted]

ACDR Corp is a corporate collections firm which and as such we are authorized to contact debtors andseek resolution on outstanding debts. According to the notes on the file, the client has been repeatedlyhanging up on our agents and using abusive language. Our agents have attempted to provide validatingdocumentation to the client and each time the client has resorted to profanity and terminating the call. There has been no reasonable attempt by the debtor to resolve this issue to date. The Revdex.com has been provided with a copy of the authorization to provide services as wellas the agreement to pay for services. At this point the debt has been validated through our previouscorrespondence. We advise the client to seek legal counsel to explain to them their obligations, rights, and liabilities in thismatter.Best Regards,Rick MichaelsACDR Corporation###-###-####[email protected]

Response:

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. This is in continuation of our complaint # [redacted]. ACDR continues to harass us! They send daily faxes, and today have called 13 times so far! To date this company has been unable to provide us with any proof of service or product. They have not provided us with anything. The man is always extremely rude. Today he called me a liar, said I have bad credit (which is untrue and frankly non of his business), he said I didn't care about my family, and he said [redacted] is so far north we might as well be Canadian. These people need to stop with the harassment. We don't have time for this nonsense, and they are tying up our phone lines by calling repeatedly. As I'm typing this the calls continue...we're up to 15 now.Desired Settlement Stop harassing us. Stop calling and stop faxing.Desired Settlement: Other (requires explanation)Regards,[redacted]

Review: We are receiving harassing calls from ACDR Corp. They claim to be a debt collection company who has purchased bad debt from a company called UBS ([redacted]). They fax and call repeatedly, sometime several time per day. They have been threatening and abusive to several members of my staff, and directly to me. They claim to have a voice recording of my office manager purchasing an add from UBS. I do not believe our company purchased any such add. The recording they play is so garbled as to be unintelligible, although it does sound like my office managers voice. They claim we owe the original bill from December of 2010, plus interest and expenses, which total over $1,000. The man who is making the calls calls himself Agent Saul Rosenberg. I asked him to send me complete documentation of the case in writing by mail, and he confirmed he would. Once he said that the information had been sent via certified mail, and that I would have to sign for it, but nothing has come to us. I asked for copies of all recorded conversations in their entirety, and they said I would have to pay for them. I gave them my attorneys telephone number, and told them to take up the matter with her. They called back and said the attorney had never heard of us. Our attorney has no record or recollection of a call from ACDR Corp. I told Mr. Rosenberg that I have found a warning regarding ACDR Corp on the Revdex.com web site, and he dismissed the warning, citing as a reason that "the Revdex.com is a for profit business who extorts money from legitimate businesses" or something very close to that phrase. I attempted to contact the Registered Agent for ACDR Corp. (from the Delaware Division of Corporations: SPIEGEL & UTRERA, P.A. Address: [redacted] City: DOVER County: KENT State: DE Postal Code: [redacted] Phone: ###-###-####) but they refused to allow me to talk to the attorney who is the agent. I called a second time, and again was not connected to the attorney, but left a message with the receptionist asking to be called back. I have not been called back to date. It is my belief that the original charge from UBS is fraudulent, and that the attempts of ACDR Corp. to collect the debt is fraudulent. Additionally, the methods utilized by ACDR Corp to collect the supposed debt are at least unprofessional, are certainly not in keeping with the acceptable practices of the Fair Debt Collection Practices Act, and may be unethical or even illegal.Desired Settlement: Of greatest importance to me is that other companies and individuals be warned about these companies, and this activity. Second to that I would like the calls and faxes from ACDR Corp to stop.

Review: I was contacted by ACDR Corp. a while back in reference to an unpaid invoice from 2009 from an advertising agency named UBS. I never did any advertising through that firm and never gave authorization for any advertising. I told them it must be a mistake and they e-mailed documents to my e-mail which I could never open. In an attempt to stop them from harassing me with calls daily I sent them $200.00. Immediately after that faxes starting coming in daily with an invoice for $1200.00. Then repeated calls to which I authorized an ACH payment from my bank for another $300.00. The faxes continued to come daily never reflecting any payments. My bookkeeper in an attempt to stop all the caos went on line to find their fax number which was omitted from their faxes to us. Instead she found the Revdex.com site showing others who have apparently been scammed also. Now I am out $500.00 for absolutely nothing. My bookkeeper contacted Mr. Saul Rosenberg who was the contact person assigned to us from ACDR Corp.and told him of her findings through the Revdex.com site and he promised to never call or fax again. We will see if that happens but I would like to get back the $500.00 paid on a bogus invoice.Desired Settlement: Would like to get back the $500.00 paid.

Re: Complaint Id [redacted] – [redacted], LLCDear Ms. [redacted]:This account was settled internally for $500.00 with the client paying the settlement amount includingobtaining a conditional release of the debt in lieu of the full outstanding balance of $1,318.26.The client had contacted our agent and was advised that their file was closed as agreed and per the debtsettlement agreement. No further action is being taken by our firm in regards to this debt unless the client wishes to invalidate thesettlement agreement.Best Regards,Rick MichaelsACDR Corporation

Review: This company has called me at work. I have asked them to remove my work number from their files but they refused to do so.Desired Settlement: I asked for a callback number which I will use to address the situation. I cannot be contacted at work.

No, they are not contacting me about advertisement or any other matter associated with my place of employment.[redacted]

Review: We have been receiving daily faxes from a [redacted] about a bill from 2009 for 4 months now. The fax stated that we owe $459.95 to an advertising company USB. I had heard the recorded conversation with our employee agreeing to the service. I checked and found no record of a bill or a payment to the company so wrote a check to the advertising company (instead of the collection agency) to pay the advertising bill only of $459.95. ACDR is now pestering me still for the full amount of $1209.43 which includes $749.48 of late fees, interest and transfer fees. I am not really sure if this was a real bill as USB NEVER any bills or notices of past due. There is no fax number and when I call to talk to [redacted], I get only a recording.Desired Settlement: I would like for this company to quit sending a double page fax (last one I received was 6/21 but fax was dated 4/30) and leave our company alone. I do not feel we owe them a thing and that this ACDR is a scam.

We are in receipt of the complaint filed by The [redacted], referenced in our system as 723[redacted]. ACDR Corporation purchased the debt from the original creditor through assignation of debt onJanuary 15th, 2013 of this year. The debt was validated with the owner with documentation provided to[redacted] on March 4th, 2013.The agent handling this file has been attempting to work out settlement arrangements on the outstandingamount. During this process the client made a payment of $459.95 towards the outstanding balance.Surely the customer does not believe that paying the original amount on a debt that was over three yearsdelinquent would lead to closure on the account. While the remaining outstanding balance with interestand fees is currently $740.05, we are willing to settle the remaining outstanding amount for $280.10. Thisoffer is valid until July 12th, 2013, following such date the offer will be considered null and void. Please have the complainant contact the agent handling this account and they will gladly work with Ms.[redacted] to settle and close the account.Best Regards,Rick MichaelsACDR Corporation###-###-####

Review: [redacted] was contacted by ACDRC claiming unpaid invoice for UBS Inc. in 2009. The daily faxes from ACDR references a UBS "advertising service" which was not authorized by a company executive and we have no record of an invoice from UBS. We believe this to be a fraudulent claim.Desired Settlement: Cease and desist all contact with ACDR

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. The business continues to contend that this debt is valid and must be resolved. THE DEBT IS NOT VALID!The business contends that they have a signed contract which I have requested a copy of. No copy forwarded to me by business. The business contends that the debt is "validated". I do not understand how a debt can be validated if it is disputed. There are only two people in my office that are authorized to enter into contract(s) with any outside vendor. Neither of those individuals entered into agreement with UBS. We never authorized nor received whatever the business claims we ordered. We never received an original invoice back in 2009. If we had, I would have disputed the invoice from day 1!We have indicated to the "Agent" that calls our office daily and sends multiple faxes daily that the charges were not authorized by the company. That no agreement exists, that no services or goods were ever provided to us and that we will not pay this invoice. This is a total SCAM! I have already spent more time on this than I need to. I am in the process of filing complaints with the West Virginia Attorney General's Office, the Massachusetts Attorney General's office and the Federal Trade Commission. Regards,[redacted]

Review: Supposedly American Credit & Debt Recovery Corp. has purchased an unpaid invoice from UBS in Winston-Salem, NC who sold us an advertising listing. We never paid the invoice because UBS never furnished us with a sample of the product. As far as we're concerned UBS and American Credit Debt Recovery Corp are working together on a scam. We contacted our local Revdex.com and found that there have been a lot of complaints filed against both of these companies for possible scam/fraud. We have received faxes from ACDRC every day threatening legal action. We don't know what to do and are looking for advice and help. The invoice to UBS is under [redacted]'s name but [redacted] is handling this if you could please call to speak to her we'd appreciate it. ###-###-####Desired Settlement: We feel that we are subject to a scam, how do we find resolution and get these people to go away? Thanks

Response:

ACDR Corporation is a commercial collections firm following all applicable government standards inaccordance with FTC regulations and the UCC. ACDR Corporation acquired the file by assignation of debton April 15th, 2013. We have been attempting to resolve this debt since said time. The client in the complaint filing freely admits to placing the order as he is the owner of the company.Although, he states that no proof of listing was ever provided by UBS, we have documentation showing thatproof of listing was provided on February 27th, 2012 via email as requested at the time. ACDRCorporation’s agent provided additional validation of debt to their accounts payable department on May2nd, 2013. The client clearly authorized the order. Please find the attached authorization. The debt has been validatedwith the client and credit reporting is scheduled. It is obvious that the advertising was provided to [redacted] LTD for the duration of the term in accordance with the agreement in place. There has been noattempt to settle this debt in a fair manner by the client to this date. The client should either seek to makesettlement arrangements with the agent contacting them or seek legal counsel to advise them of their legalliabilities should the file be escalated. The client should be mindful of the consequences of slandering a company as there is legal recourse at thisjunction as he has made the claims in writing. It is unacceptable for a company owner to order a service, agree to pay for it, and then attempt to slander a company using “scam” in an attempt to avoid paying avalid debt. Response:

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. ACDR Corporation is a “F” rated “business” from the Revdex.com, there are 41 complaints filed against this company. And I quote off of Revdex.com’s website about ACDR: This company first came to the attention of Revdex.com in November, 2011. Business owners stated they received invoices for unordered, unauthorized directory services from UBS, Inc. UBS, Inc. is located in North Carolina; the following is a link to their Revdex.com Business Review: http://www.Revdex.com.org/northwestern-north-carolina/business-reviews/publisher... The business owners informed Revdex.com they had disputed the charges with UBS and had thought the issue resolved. The complainants stated they began receiving threatening debt collection calls from ACDR, on behalf of UBS, Inc., often for more than double the amount invoiced by UBS. Research also linked ACDR to Infocom USA, Inc. (http://www.Revdex.com.org/northwestern-north-carolina/business-reviews/publishe... and Transcontinental Debt Recovery http://www.Revdex.com.org/northwestern-north-carolina/business-reviews/collectio... Both of these companies are located in Pilot Mountain, NC. Consumers who receive abusive collection calls from this or any collection company are advised to file a complaint with Revdex.com, the FTC and the VA State Attorney General’s office. Contact information is: Virginia Department of Agriculture & Consumer Services at www.vdacs.virginia.gov or toll free in Virginia: ###-###-#### or outside of the area at ###-###-####, and the Federal Trade Commission at www.ftccomplaintassistant.gov or ###-###-####. Revdex.com files indicate that this business has a pattern of complaints regarding product quality and reimbursement issues. Consumers allege being contacted by ACDR, a collections agency representing USB, Inc., stating they owe money for a directory listing. Each complainant has stated that they have not agreed to any services provided by UBS, Inc. Some consumers also state they continue to be contacted by ACDR after sending them a Cease and Desist letter, this is against FTC regulations. Both companies are operated by Randall Keirl. UBS, Inc. has an "F" rating with the Revdex.com in Winston-Salem, NC. The link to their review is http://www.Revdex.com.org/northwestern-north-carolina/business-reviews/publisher... On 6/26/12, Revdex.com contacted the firm regarding their pattern of serious complaints. ACDR responded by stating they “…have noticed a recent influx of complaints regarding certain accounts from USB, Inc…” but contend the consumers owe the money. After reviewing ACDR’s full response, Revdex.com determined they did not address the seriousness of the pattern of complaints. Un-quote. We are another example of this exact issue. The mistake we made was answering the phone that day from UBS. They obviously had a good sales pitch that roped [redacted] into agreeing to something that he didn’t understand, nor falls under his job description. We were never provided a directory or proof of product. A screen shot of some database is not a valid proof of product. We ask that [redacted] from ACDR stop faxing and calling our office. We will not pay for a fictitious product. Revdex.com also reports this about ADCR: American Credit Debt Recovery (ACDR) has a Post Office box in Cana, VA. However, we have not been able to locate a physical address for the firm. It appears the firm is not located in Cana. Randall Keirl is listed as the Administrative contact on ACDR's web site domain registry. Mr. Keirl is also listed as the President of Infocom USA, Inc. in Pilot Mt., NC. Infocom USA, Inc. has an "F" rating with the Revdex.com in Winston-Salem, NC. Here is a link to their Revdex.com review: http://www.Revdex.com.org/northwestern-north-carolina/business-reviews/publisher... Mr. Keirl is also listed as the President of UBS, Inc. of Winston-Salem, NC. UBS, Inc. has an "F" rating with the Revdex.com in Winston-Salem, NC. The link to their review is http://www.Revdex.com.org/northwestern-north-carolina/business-reviews/publisher... . According to information we are receiving from consumers, the firm appears to be a collection agency for UBS, Inc. of Winston-Salem, NC. UBS is sending out invoices to businesses for a listing in a business directory. Revdex.com records show a pattern of complaints received about this business. Please see the Additional Complaint Information section of this Business Review. As far as we’re concerned this issue is closed and if anyone from ACDR would like to pursue this any further they may contact our lawyer. His name is [redacted] with [redacted] Maine with the telephone number of ###-###-####. Regards, [redacted]
