#000000} span.s1 {font-kerning: none} span.s2 {font: 12.0px Helvetica} span.s3 {text-decoration: underline ; font-kerning: none} span.Apple-tab-span {white-space:pre} The facts and information Ms. [redacted] included within her complaint are false, misleading and exaggeratory.  Achievement Driving School provided quality, respectful and professional service within the scope of the NM state driver education rules.   We are also very clear on our school’s policies and every parent initials that they have read and understood them. Furthermore, Ms. [redacted] is demanding both our records of services to be transferred to another school and a full refund, thereby attempting to receive “double recovery” for the services rendered by Achievement Driving School.  I provide every parent and student my personal cell phone number for 24/7 communication purposes and respond to every inquiry within 24 hours.  Ms. [redacted] and I have had a lot of communication which was positive and civil and she was continually satisfied until the one time when I could not meet her excessive demands.  Ms. [redacted]’s discontent started when she incurred a non-negotiable late fee for cancelling an appointment within 24 hours which is our company policy to which she refused to pay. Furthermore, she bullied me by abusively threatening to ruin my business if I didn’t waive her fee stating the fee was stupid and I needed to “Pay it with my own money!”. I took her threat very seriously, so I agreed to waive the fee, unfortunately, even after I waived the fee, she continued to be incredibly aggressive, abusive and threatening with all communication that transpired between myself and the other staff at Achievement Driving School. Additionally, she still posted an false, unwarranted scathing review of my business on the internet.  In July of 2016, Ms [redacted] signed a 6 month contract with Achievement Driving School when she enrolled her student acknowledging that she understood Achievement Driving Schools policies and she agreed to them. Included in the 6 month contract signed by Ms. [redacted]: There are NO refunds for any reason after the course has begun.  A non-negotiable $30 reschedule fee will be assessed if a student cancels an appointment within 24 hours. Students will be charged a $30 reschedule fee if they are late or miss an appointment for any reason including traffic or illness.  Students are allowed 1 hour of drive time every 10 days to allow for practice and improvement between lessons.  Achievement driving School recommends 1 hour of Drive Time per month to allow for maximum impact and benefit of the driving lesson’s objectives. Ms. [redacted], not only refused to pay her fee, she also demanded special services beyond the scope of her contract.  Achievement Driving School recommends 1 hours of drive time per month but students are allowed 1 every 10 days, allowing up to 3 hours per month. I was working with Ms. [redacted] and had already scheduled her son for 5 hours in only 3 months. I tried explaining to Ms. [redacted] that the state requires all students to drive on their learners permit for 6 months so her son had 3 more months to complete his final 2 hours. She called me a liar and told me her other child attended a different school and didn’t have to do any of the State requirements.  She then began bullying me again and demanded I schedule her son immediately for his last two hours because she was busy and just wanted to be done. She was so abusive, I felt like I had no choice but to inform her that I would give her tuition back and she could start her son’s education over elsewhere. Ms. [redacted] agreed to go elsewhere. She then demanded I turn over my records so she could transfer them to another school. I informed Ms. [redacted] we provided her professional, quality service which she had no reason or right to be dissatisfied and she could either have my records or a refund but not both as that would be “Double Recovery”.  After receiving the request from the State for our records, and because we wanted to help her son, Achievement Driving School made another attempt to appease Ms. [redacted] and offered to finish her son’s final 2 hours within the 3 months remaining on her contract, to which she refused our services and demanded our records so she could go to another school thereby Ms. [redacted] forfeited her refund offer.  After researching other schools, Ms. [redacted] contacted us again in late November asking for a refund of $100 to which we denied BUT we agreed to work with her again because we wanted to help her son finish his final 2 hours of Drive Time. We asked for her patience while we located a private coach who would be willing to finish her son’s requirements. Less than 2 hours later, she sent a message stating “We weren’t worth her time!” I honestly think there is no appeasing Ms. [redacted]. She is completely unreasonable and thinks by threatening, bullying and abusing myself and my staff, she will get results. There are state rules, requirements and company policies in place for a reason and she was fully informed of all of them prior to signing her son up for our program.  Achievement Driving School has received highly satisfactory monitoring visits and evaluations from the State Traffic Safety Bureau. In only 3 years of operation, Achievement Driving School has received hundreds  of positive reviews and comments from our very satisfied clients. I, Sherry L[redacted], am in fact the owner of Achievement Driving School and I give every parent and student my personal cell phone number when they register for my driver education program so I can be reached at any time with any concerns or questions.   Conclusion: At Ms. [redacted]’s request, Achievement Driving School’s records for her son, documenting the driver education services rendered, were submitted to the Traffic Safety Bureau to be transferred to another driving school. The services rendered, as per contract, to Ms. [redacted]’s son included: the State Written Permit Exam, All Classroom Instruction requirements including the final exam and 5 of the 7 required hours of Behind The Wheel Training all within the first 3 months of her 6 month contract.  [redacted] has refused several attempts by Achievement Driving School to complete her son’s requirements. Furthermore, Ms. [redacted] has acknowledged the services already rendered by Achievement Driving School as evidenced by her request to transfer aforementioned services to another driving school. In accordance with Achievement Driving  school’s contractual policies, No refunds are given after a program has begun which Ms. [redacted] Initialed off on when she began with our school. Ms. [redacted] is attempting to receive  “double recovery” and therefore no refund will be issued.
