Has the proposal in writing with the warranty and it very clear, the work we performed was surface repair and the issues he has is from underneath the pavement and not related to the work that was performed. This has been...

explained in detail to Mr. [redacted] and please share for him to look at the warranty. Workmanship and materials did not fail and are not the source of the issues he has at this time. The winter and snow contributed hugely to the problems he has at this time and the only way to correct that is to remove the driveway, remove the soil below and replace soil and replace the asphalt and that also has been explained to him and like all around the state people are having issues with 9 feet of frost and moving ground moving and causing cracks and potholes and sink holes.

To our knowledge, we have never received a written warranty from ACI. The only correspondence we have ever had with the company is verbally through the representative that we understand is no longer with the company. If what ACI is stating as far as the winter months creating the problem, then why did our driveway crack in September 2013?. The initial patch/resurface job was June 2013. They had to come out twice in June to fix faulty workmanship. We have an email documenting the conversations with the employee indicating that cracks were back. He told us to wait until spring and he would take care of everything at that time. This happened before the cold and the frost line would of been a factor. Once spring hit, we contacted the company and were told that that representative we had been working with no longer works for the company and that [redacted] L was taking his place. Which brings us to where we are at now. [redacted] L/ACI is refusing to address the issues at hand, and blaming the soil vs. workmanship and materials. If we would of been told that we have a soil problem prior to spending approx $4000.00 we would of removed the driveway all together and done it the correct way. Why would anyone spend $4000.00 for a temp fix? We were mislead by that employee and now the company refuses to resolve the issue. We trusted a professional representative with that company to assure us that this patch and resurface would be the correct fix and was told it would last 10 years, which is why we opted to go that route. We cant help it we were mislead. What we are seeking is our money back so that we can repair our driveway the correct way.

We have NEVER received a written warranty or a proposal from ACI, even after asking for one several times. So,we are still asking for a full refund of the faulty repair patch job, so we can finally repair our driveway the correct way. This company does not stand behind their warranty, nor does it stand behind its employees proposals.
