July 28, To Whom It May Concern:This letter is regarding the above complaint that has been filed against my office.I have reviewed the complaint filed and do not agree with the customer’s statement.I would first like to clarify that the complaint was filed against the
incorrect company that I ownThis claim was handled under Aclaim Adjustment Agency, which is the company that the complainant signed a contract with on December 12, Please see copy of attached contract.Regarding the complainant’s statement, on June 26, via email the insured was provided a copy of the dry cleaning bill and insurance company’s estimate for cleaning/repairsPlease see a copy of the email and attachmentsWhen the cleaning services were offered to the complainant, it was explained that the insurance company would be paying for these services in the estimate once the claim settled; therefore no fees would be incurred upfrontAdditionally, you will see on page of the estimate from the complainant’s insurance company that the entire cleaning amount total was $7,and per there services based on the insurance company’s estimate the restoration company only charged $3,but lowered their by $as a courtesy to attempt to resolve any issues that insured had with their services/billTherefore, the restoration company did not bill for services that were not performed.Additionally, the insured further decided to forward documentation directly to her insurance company to settle the claim while I was still negotiating additional money on her claim, outside of my knowledge.In closing, on July 10, the complainant had her husband, *** ***, contact my office with a resolution to the restoration cleaning*** *** stated that his wife, the complainant was willing to accept $2,and faxed the signed check authorization agreeing to the amount discussed on July 11, Please see attached documentation for verification

I am rejecting this response because: There was no cleaning from restoration company, I agree that he brought women to the house and showed me solution that was going to be put in bucket and they were going to use long handle sponges to wipe the wallsNever did he state this cleaning was the restoration cleaning and that it would be billed to insurance company or that it was not included in his 25% since they worked for his companyWhen I read over the items listed that the insurance company itemize for payment the individuals did not do, neither did the two men that showed up laterWhen I first took this complaint to the *** office, the woman at the front desk read the complaint and said they don't handle dispute involving what a company chargesMrPa*** is filing a fraudulent claim because there was no restoration company and he is taking money that was allotted to me to do the repairs that was neededThis case was in Dec, after months of trying to talk to MrP*** concerning my case I eventually called the insurance adjusters with my concerns about MrP*** and asked if they could take out his 25% and send me the restThey stated the check had to be issued in both our namesMy homeowners insurance was to help me with restoring my houseI believe MrP*** knows all the ins and outs of the insurance business and he knew he was going to pay those individuals small fee then take a larger fee for his selfIn reading the claims statement it talks about fraud well if I file a fraudulent claim I would have to pay restorationI agree to his 25% and if he wants a fee for the light house keeping cleaning I am willing to have that deducted, but not $he has listed for restoration feeI could of got the merry maids for to sweep, mop, wipe, dust because that was the extent of itOh and put some loose household items in small green trash bags and stuck in closetIm now left with the expenses of getting house painted, powered wash, mattress & box spring, sofa & love sofa cleaned, windows, cushions dining room chairs etc...The dry cleaners gave me company booklet tagged all my belongings and billed $and I signed for thisI have no issue with portion being deducted from the total amountWhere is the itemize bill listing for the cleaning from restoration company for cleaning he claims was doneIf everything was done that my homeowners authorize payment for we would not be having this disputeJust because he shows what my homeowners itemize list for payment does not mean he his entitle to make claim if all the services were not renderedJust because they would pay for cleaning does not give MrP*** the entitlement to make claim & bill for services that was not renderedHad they taken my complaint at *** *** office *** office I would not accepted $Six months later I'm stuck trying to get things doneAnd he states additional $was taken off to satisfy meMy husband said to take the $but if I filed claim and it was three years later I would be order to pay restoration fee or jailed and it's that does not justify that I can not file complaint if a business practice unfair business practicesIf I had this office information I would of filed this complaint long time agoI will be willing to forward that itemize list with those things highlighted that my homeowner insurance authorize payment for and services were not done, but billed for from Acclaim Adjustment OfficeThere is no bill with my signature authorizing cleaning and payment render from insurance company laterThere is one on file for dry cleaning but not restoration cleaning because I never authorize it for payment or additional payment from insurance companyMrP*** said he would have them to wipe walls since I had been out of my home for two weeks, I thought since they worked for him this was part of his 25% and he never said anything about additional payment
If customer was overcharge by error or fraudulently charge to much does not mean that corrective measures should be taken to correct the issueI'm do refund larger then the $2,from Acclaim Adjustment Agency (MrP***)

Review: Mr. P[redacted] refused to give a copy of printed bill from restoration company and the dry cleaning service for services that was billed ( listing all work that was provided from the restoration company) and the copy of the bill sent to him for dry cleaning. As a consumer I have a right to see the bill and know what restoration company did the work that he claims to have provided service. He fraudulently claim it was a legitimate company that did the work and they did not provide all the services that should of been done furniture cleaned, mattresses box spring cleaned, upholstery on dining room cleaned. Etc.Desired Settlement: Provide a bill with my signature for restoration cost. He never said that the people he brought to my house in his motor vehicle to wipe the walls down , mop, dust was additional fee from his 25% and he's charging a restoration fee when he did not use legitimate company to bill for service rendered. This is fraud. He brought those individuals to clean never said it was an additional fee nor did he present me with documents listing a cost for service,. I would like bill from the company .

This claim was handled under Aclaim Adjustment Agency, which is the company that the complainant signed a contract with on December 12, 2013. When the cleaning services were offered to the complainant, it was explained that the insurance company would be paying for these services in the estimate once the claim settled; therefore no fees would be incurred upfront. Additionally, you will see on page 17 of the estimate from the complainant’s insurance company that the entire cleaning amount total was $7,591.60 and per there services based on the insurance company’s estimate the restoration company only charged $3,889.03 but lowered their by $300.00 as a courtesy to attempt to resolve any issues that insured had with their services/bill. Therefore, the restoration company did not bill for services that were not performed.Additionally, the insured further decided to forward documentation directly to her insurance company to settle the claim while I was still negotiating additional money on her claim, outside of my knowledge.In closing, on July 10, 2014 the complainant had her husband, [redacted], contact my office with a resolution to the restoration cleaning. [redacted] stated that his wife, the complainant was willing to accept $2,500.00 and faxed the signed check authorization agreeing to the amount discussed on July 11, 2014. Never did he state this cleaning was the restoration cleaning and that it would be billed to insurance company or that it was not included in his 25% since they worked for his company. When I read over the items listed that the insurance company itemize for payment the 3 individuals did not do, neither did the two men that showed up later.

Review: [redacted], Aclaim Adjustment Services, was hired on 2/20/13 to work as my public adjuster for 25% commission. My home sustained water damage and [redacted] was hired to document and submit the losses, negotiate a reasonable settlement and expedite my claim with [redacted]. I had notified [redacted], Aclaim’s operation manager, on 3/1/13 that mold was growing on my walls. At that time, [redacted] told me that she would contact their restoration company to remove the mold and restore the walls. [redacted] said I would not incur any charges because they would bill [redacted] for the services. On 3/8/13, I received a phone call from [redacted] telling me that [redacted] would be coming out on 3/13/13 to do an estimate with [redacted]. I reminded [redacted] about the mold growth and she informed me that the restoration company would be in contact with me to schedule an appointment. On 3/15/13, I called [redacted] back to follow up on scheduling the restoration appointment as I had yet to hear from them and to make sure [redacted] would still pay for the services even after they had visited on 3/13/13. [redacted] informed me that [redacted] called and spoke to [redacted] to get the approval and she would have the restoration company meet me on Saturday 3/16/13. The restoration company is called [redacted] aka [redacted]. When [redacted] came out on 3/16/13, they informed me that [redacted] told them to remove the ceilings where it was leaking which is approximately 9 feet in length from the living room to the dining room. I called [redacted] immediately to inquire about the restoration services and he informed me that [redacted] was only at my home to remove the mold damage and that I would need to pay for the restoration with my claim settlement monies. [redacted] then said he and [redacted] mutual would need to come out for a re-inspection visit after [redacted] came back to pick up their mold removing machines which had to stay on in my house for 48 hours.

A little over a week went by and I received a call from [redacted] on 3/26/13 informing me that [redacted] sent a settlement invoice and check for which [redacted] reviewed and felt it was a fair settlement. I disagreed, reminded her that no re-inspection visit ever occurred and asked to speak to [redacted] about it for which she replied that [redacted] would not talk to me until I reviewed the settlement documents for myself. I received the document by email on 3/27/13 and after review I immediately recognized major omissions of the damages to my home in addition it did not appear [redacted] had any participation in the settlement amount. Due to the ongoing communication problems with trying to speak to [redacted] directly I replied by email to the agency on 3/27/13 expressing my concerns about their services and non-existence of negotiation with getting my claim settled. There were some previous incidences where I left messages for [redacted] regarding updates and he did not return my phone calls. [redacted] called me rather angry about my email on 3/28/13 but then informed me he would work on my getting my claim rectified as soon as he hung up with me. Two weeks went by and I got no follow up from [redacted] so I reached out to [redacted]’s Claims department on 4/12/13 to confirm whether [redacted] was working on rectifying my claim. I was informed that [redacted] had not been in contact with them regarding a re-inspection visit nor did he notify them about the [redacted] services. I called [redacted] to inquire about [redacted]’s report, he initially refused to tell me anything claiming he was not in the office and would call me back by 3:30pm. When 4:30pm came, I emailed the agency to inquire about what negotiations they have been doing to get my claim rectified since 3/28/13 and I wanted proof. When [redacted] called me back about 5:30pm, he gave me no explanation, just that he would email [redacted] and forward me a copy of the email by 4/15/13. I emailed Aclaim on 4/15/13 to ask where the email was? [redacted] sent me the email on 4/16/13 claiming they sent the email to [redacted] on 4/12/13. The email contained some new invoice and an additional request for the [redacted] Adjuster to reply as to whether he needed to do a re-inspection visit.

On 4/28/13, I contacted [redacted] to get a status update and they told me my claim was closed. I called [redacted] and left a message regarding [redacted]’s report and the frustration I have been enduring dealing with him. I called the office today and spoke to a staff member expressing my frustrations and feelings that [redacted] was committing some type of fraud against me. I stated that not only has [redacted] not been working on my claim he has yet to distributed the original check [redacted] mailed to his office for me back on 3/15/13. [redacted] called me back irate and we got into an argument. [redacted] lied and said to me that I refused the check after he told me to come to his office and sign for it, which he never ever told me nor did anyone else from his office. I had no idea all this time that [redacted] had cashed in the check, taken his 25% portion and had my portion at his office. I assumed, before I fully recognized he abandoned work on my claim, that he was holding off cashing the check until my claim was rectified.

According to [redacted]’s adjuster [redacted] on 4/29/13 at 3:29pm, [redacted] has not done any negotiations with him ever and [redacted] has not forwarded the necessary documents or pictures of work completed by [redacted] services in order to get my claim rectified. Today, 4/29/13, I had to email copies of my damaged ceilings to [redacted] for him to reopen my claim. The only reason that [redacted] new of the [redacted] services being completed was due to my phone call to him on 3/28/13 inquiring if [redacted] had been in contact with him.

I do not trust [redacted] nor his company whatsoever. I feel deceived and cheated. [redacted] has not done his job and our working relationship is extremely poor and argumentative. I don’t feel comfortable talking to him because I feel he is just going to lie and argue with me.Desired Settlement: I want this agency to contact [redacted] and release me from this contract immediately. I want the current contract revoked and I no longer want to be under any obligation whatsoever with this agency. They have not reasonably earned the 25% commission that they have charged me and I deserve to be refunded and they are not to collect any further monies from my claim.

I just saw the agency's response to my Revdex.com complaint. [redacted] statements are just twisted up lies. [redacted] is calling both myself and the [redacted] Adjuster liars in his statement. If [redacted] had been doing his job and made reasonable and good faith efforts, this situation would have never escalated. My counter answer is exactly what I stated in the original complaint. Furthermore, the last time I talked to [redacted] he was so hostile and belligerent that I believe if he had been in front of me I would have been assaulted. As I stated before the working relationship with [redacted] is very poor and I don't see how any consumer would feel safe around him after what I have experienced.

Additionally, he waited over a month to respond to this complaint which shows proof he has a pattern of negligent behavior and unethical conduct. My home continues to be in disarray, he still has my claim settlement checks in his possession since March 2013 and now he is trying to force me to sign a document giving him permission to endorse my name on the checks. This company is completely untrustworthy.
